Subject: Transmittal of Bill 385, Draft 2, Which Repeals Chapter 5, article 2, Hawaii County
Code 1983 (2005 Edition, as amended), and Adds a New Article Incorporating the
International Energy Conservation Code
Please find attached Bill 385, Draft 2. Bill 385, Draft 2, is a product of amendments contained within
Communication No. 141.7 that were duly approved by the council at its Public works and
Intergovernmental Relations Committee meeting of March 17, 2009.
Bill 385 amends chapter 5, article 2, Hawaii County Code 1983 (2005 Edition, as amended),
Building Energy Efficiency Standards, by repealing chapter 5, article 2, Hawaii County Code 1983
(2005 Edition, as amended) in its entirety and replacing it with the International Energy Conservation
Code 2006 (IECC). Deletion of chapter 5, article 2, caused the deletion of provisions for Indigenous
Architecture created by Ordinance No. 07-164. Bill 385 includes SECTION 4, which creates a new
article (article 3) to retain those provisions relating to Indigenous Architecture.
