Subject: Bill 49 first reading
Council members:
I ask that you vote NO on Bill 49 in an attempt to use the 2 pecent real estate tax funds for other
purposes.
You need not purchase any land this year, but honor the majority vote of the people to save the 'aina
and maintain the integrety of the fund.
The funds will be lower this year as assessments will probably reflect a 30 percent drop and it is bad
government business to become a pickpocket to maintain funding at a level that must reflect the realism
of the conomy. Think of how much will be lost when the inevetable court case follows.
The Corporate Counsel suggests the funds are vulnerable because the assessment ordinance was passed
before a two thirds majority requirement to modify ordinances was passed. Unless the ordinance the
Corporate Counsel refers to specifically grandfathers the 2 percent land ordinance to adhere to older law,
it will not stand a test in the courts. Think of it. That is like saying any law that goes before the US
Supreme Court needs a majority of votes from number of justices seated when the law was passed to be
affirmed or denied. The number of US Supreme Court Justices varied from 6 to 10 but has stayed at 9
members from 1869.
Vote NO on Bill 49.
