Contingency Relief funds from Council District 5 will be appropriated to the Civil Defense
Agency to provide financial support to the Big Island Resource Conservation and Development
for the Rat Lungworm Education Project.

This modifies our letter of the above date in which we stated that you
would be treated as an organization that is not a private foundation until the
expiration pf your advance ruling period-
Your: exempt status under section 501(a) of the internal Revenue Code as an
organization described in section 50],(c)(3) is scill in effect. Based on the
information you submitted, we have determined that you are not a private
foundation within the meaning of section 509(a) of the Code because you are an
organization of the type described in section S09(a)(1) and 110(b)(1)(A)(vi).
Grantors and contributors may rely on this determination unless the
Internal Revenue service publishes notice to the contrary. However, if you
lose your sect4on 509(a) (1) status, a grantor or contributor may not rely on
this determination if he or she was in part responsible for, or was aware of,
the act or failure to act, or the substantial or.material change on the part of
the organization that resulted in your loss of such status, or if he or she
acquired knowledge that the Internal Revenue Service had given notice that you

RE: Resolution No. 86-09 Transferring/Appropriating an Appropriation Out and
From the Designated Fund Account and Crediting Same to a Designated Fund Account
For Rat Lung Education Project $2,000.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai'i, this written request is submitted with my approval that the above-referenced matter be
waived from the Finance Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval is granted and the
matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Finance Committee
for placement on its future agenda.
