Your Committee on Finance, to which was referred Resolution No. 9, reports as follows:
Resolution No. 9, transmitted by Corporation Counsel Richazd Wurdeman, via
Communication No. 10, dated November 20, 1996, authorizes the acceptance of real
property from Richard U. Shinto. Also included aze copies of the wan•anty deeds.
The subject properties, TMK: (3) 9-2-067-071 and 072 aze located in the Hawaiian Ocean
View Estates in Ka'u. Each lot consists of approximately 43,610 square feet.
Pursuant to Article XIII, Section 13-12 of the Hawaii County Charter, the Council, on
behalf of the County of Hawaii, may accept gifts or donations of real property.
Deputy Corporation Counsel Gerald Takase was present to respond to concerns expressed
by Your Committee. Concerns included potential monetary obligations associated with
the acceptance of donated pazcels and the need for protocol in inspecting these properties.
Your Committee could not recommend the Resolution for adoption because it lacked
sufficient information to make an assessment in the financial, environmental and legal
impacts of such acceptances by the County.
A motion asking Your Committee on Finance to approve Resolution No. 9 failed by the
vote reflected below. Your Committee recommends that Resolution No. 9 be filed.
