Subject: Request for Deferral - Communication No. 149, Bill Nos. 34 & 35
State Land Use (SLU 08-000021) and County Rezoning (REZ 08-
000085) - Hawaiian Rainforest Water Co., LLC
Keaau, HI. TMK: 1-6-003: 18 & 23
It is our understanding that the subject matter has been agendized for your March 2
committee meeting. Thank you very much, as the applicant would want to have this matter
decided upon in a timely manner.
Over the past few months, we have been in discussions with the owner of the private road
leading to the subject property. These discussions have revolved around matters such as
ownership, maintenance, and the like, matters that may not necessarily be pertinent to the subject
applications themselves but, nevertheless, important to the owner of the road. The parties believe
that an amicable resolution is imminent, and if so, that would minimize potential distractions from
the applications themselves. However, additional time is needed to see this matter through
possible fruition. If a resolution cannot be reached, the applicant is prepared to proceed with the
subject applications before your Committee.
Accordingly, we respectfully request that this matter be deferred to your next committee
meeting, tentatively scheduled for Tuesday, March 17 in Kona. Thank you very much.
