" COUNTY OF HAWAII STATE OF HAWAII BILL NO. 117 ORDINANCE NO. 97 1-21- AN ORDINANCE AMENDING ORDINANCE NO. 97-82, AS AMENDED, RELATING TO PUBLIC IMPROVEMENTS AND FINANCING THEREOF FOR THE FISCAL YEAR JULY 1, 1997 TO JUNE 30, 1998. WHEREAS, Resolution 397-88, adopted by the Hawaii County Council on March 15, 1988, provided an additional 3.8 cents per gallon in fuel tax revenues to be expended for highway improvements in a five- increment project plan over a ten-year period; and WHEREAS, Resolution 351-91, adopted by the Hawaii County Council on August 7, 1991, amended the provisions of the Fuel Tax Increase Expenditure Plan and provided that revenues in excess of the monthly amount projected for any increment be made available for circle island roadways; and WHEREAS, to embark on Increment V of the project plan, road improvement projects need to be appropriated. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Ordinance No. 97-82, As Amended, Relating to Public Improvements and Financing Thereof for the Fiscal Year July 1, 1997 to June 30, 1998, is hereby amended by establishing the following district appropriations: . . SECTION 2. Funds for these projects shall be provided from that portion of the Highway Fund which is designated as the Fuel Tax Increase Accoun~ No. 3104.06, and which consists of the increase fuel tax revenues created pursuant to Resolution 397-88. SECTION 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 4. This ordinance shall take effect upon its approval.
