No. 05-01 Applicant - Automotive Supply Center, Ltd., TMK: 2-2-49.26 On January 5, 2005, the County Council approved the subject ordinance, which became effective on January 11, 2005. The subject rezoning ordinance allowed the development of an automotive supply building. The conditions (some of which will be summarized) of Ordinance No. 03-84 and responses (in italics) thereto follow: (A) The applicant, successors or assigns shall be responsible for complying with all stated conditions of approval. Please be informed that the subject property is still owned by the then applicant, who intends to develop the property. As such, it will be responsible for complying with all conditions of approval. (B) Prior to the issuance of a water commitment by the Department of Water Supply, the applicant shall submit the anticipated maximum daily water usage calculations as recommended by a registered engineer, and a water commitment deposit in accordance with the "Water Commitment Guidelines Policy" to the Department of Water Supply within ninety days from the effective date of this ordinance. The two existing 518-inch meters will be replaced by one 518-inch meter along Lanikaula Street. (C) Construction of the proposed development shall be completed within five (5) years from the effective date of this ordinance. Final Plan Approval by the Planning Director in accordance with the Zoning Code shall be secured by the applicant prior to commencement of construction. Development plans shall identify existing and proposed structures, fire protection measures, paved Mr. Christopher Yuen, Director January 9, 2009 Page 2 driveway access and parking stalls, and other improvements associated with the proposed development. Landscaping shall be included in the development plans to mitigate any potential adverse noise or visual impacts to adjacent properties in accordance with Planning Department's Rule No. 17 Isemoto Construction Company has started construction and will be finished before the first half of 2009. (D) Access to the subject property from Lanikaula Street shall meet with the approval of the Department of Public Works. This is reflected in the plans for Plan Approval and building plans. (E) All driveway connections to Lanikaula Street shall conform to Chapter 22, Streets and Sidewalks, of the Hawaii County Code. This will be done in conjunction with the processing of the driveway permit. (F) Provide improvements to the entire frontage of Lanikaula Street consisting of, but not limited to, pavement widening with curb, gutter and sidewalk, drainage improvements and any required utility relocation, meeting with the approval of the Department of Public works. The improvements shall be located within a five-foot widening strip along Lanikaula Street frontage and be dedicated to the County of Hawaii prior to the issuance of a Certificate of Occupancy. This is reflected in the project civil plans. (G) Streetlights and traffic control devices shall be. installed as required by the Traffic Division, Department of Public Works. Relocated street light and telephone pole is reflected in the project civil plans. (H) A drainage study of the subject property shall be prepared and submitted to the Department of Public Works for review and approval, prior to submittal of plans for Plan Approval review. Drainage improvements, if required, shall be constructed, meeting with the approval of the Department of Public Works prior to the issuance of a Certificate of Occupancy Permit. The plans for the building permit will include civil drawings that reflect the needed drainage improvements. Mr. Christopher Yuen, Director January 9, 2009 Page 3 (I) All development generated runoff shall be disposed of on site and shall not be directed toward any adjacent properties. A drainage study shall be prepared and submitted to the Department of Public Works prior to the issuance of Final Plan Approval. Any drainage improvements shall be constructed, meeting with the approval of the Department of Public Works prior to the issuance of a Certificate of Occupancy. The study was completed, and the required improvements will be done in conjunction with the construction of the project. (J) A Solid Waste Management Plan shall be submitted to the Department of Environmental Management for review and approval prior to the issuance of Certificate of Occupancy. The applicant will be working on this with its engineering consultant. (K) Should any remains of historic sites, such as rock walls, terraces, platforms, marine shell concentrations or human burials be encountered, work in the immediate area shall cease and the Department of Land and Natural Resources - State Historic Preservation Division (DLNR-HPD) shall be immediately notified. Subsequent work shall proceed upon an archaeological clearance from DLNR- HPD when it finds that sufficient mitigation measures have been taken. This will be adhered to during the construction phase. (L) Should the Council adopt a Unified Impact Fees ordinance setting forth criteria for the imposition of exactions or the assessment of impact fees, conditions included herein may, at the developer's election, be satisfied by performance in accordance with the requirements of the Unified Impact Fees Ordinance. The Council has not adopted such an ordinance, as such, the applicant is not in a position to evaluate the alternatives and iffeasible, avail itself to this option. (M) The applicant shall comply with all applicable County, State, and Federal laws, rules, regulations and requirements. This is on going and will be complied with during the permitting and construction phases of this project. Mr. Christopher Yuen, Director January 9, 2009 Page 4 (N) An annual progress report shall be submitted to the Planning Director prior to the anniversary date of enactment of the ordinance. The annual report shall include, but not be limited to, the status of the development and to what extent the conditions of approval are being complied with. This condition shall remain in effect until all of the conditions of approval have been complied with and the Planning Director acknowledges that further reports are not required. This report is for January 2009. (O) An initial extension of time for the performance of conditions within the ordinance may be granted by the Planning Director.... The applicant believes that it can develop the project without having to go through a time extension. (P) Should any of the conditions not be met or substantially complied with in a timely fashion, the Director may initiate rezoning of the subject area to its original or more appropriate designation. We trust that you can determine that the applicant has made a good faith effort in complying with the various conditions of approval and, as such, find no need for any zoning initiation. We trust that the aforementioned adequately addresses the annual report requirement.
