AN ORDINANCE DESIGNATING TMK (3) 4-8-004:006 AS THE "WAIPI`O COMMUNITY PARK," PURSUANT 'r0 CHAPTER 15, ARTICLE 8, SECTION 15-67 OF THE HAWAII COUNTY CODE 11983 (2005 EDITION AS AMENDED); AND AMENDING CHAPTER 15, ARTICLE 8, SECTION 15-68.1 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), TO ADD THE "WAIPI°O COMMUNITY PARK" TO THE PARKS AND RECREATIONAL FACILITIES SCHEDULE. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAPI: SECTION 1. The purpose of this ordinance is to designate this parcel as a new park under the County of Hawaii Department of Parks and Recreation for passive use while the community determines its vision for the long term use of this property. The parcel, formerly known as the "Rice property," was acquired by the county pursuant to the provisions of chapter 2, article 42, Hawaii County Code, the Public Access, Open Space, and Natural Resources Preservation Fund. SECTION 2. Pursuant to chapter 15, article 8, section 15-67(a)(2)(A), Hawaii County Code 1983 (2005 Edition, as amended), the approximately 1.8 acre property situated at TMK (3) 4-8-004:006 is hereby designated as the "Waipi`o Community Park." SECTION 3. Chapter 15, article 8, section 15-68.1, Hawaii County Code 1983 (2005 Edition, as amended), is amended by adding the following facility to the Hilo/Hamakua parks and recreational facilities schedule, to be appropriately inserted and to read as follows: "Waipi`o Community Park" SECTION 4. Severability. If an), provision of this ordinance or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 5. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 6. This ordinance shall take effect upon its approval.
