April 7, 2009 TO: J Yoshimoto, Chair cNn and Members of the Hawaii County Council FROM: Kenneth Goodenow, County Clerk RE: Bill to Amend Various Chapters of the Code to Conform to the Charter Amendment Creating Windward and Leeward Planning Commissions Attached for the council's consideration is a bill that amends certain sections of six chapters of the Hawaii County Code, in accordance with the charter amendment creating windward and leeward planning commissions. The Legislative Research Branch analyzed the County Code for all instances specifically mentioning a singular planning commission and thus requiring amendment. The attached bill is the result of that analysis and subsequent drafting to remedy those instances. The only instance of "planning commission" appearing in the Code that was not addressed is in chapter 8, section 8-4, paragraph (7), which reads: "(7) A planned unit development project for which the planning commission has held a public hearing prior to December 27, 1977;" This provision relates to actions that have already occurred; therefore amendment to reference two planning commissions is not feasible. The purpose section of the bill contains explanations for those amendments that could be potentially unclear as to their rationale. Providing a legislative history can be a convenient and effective mechanism to discover such critical information. A representative of the Legislative Research Branch will be available at the designated committee meeting to explain the basis for any amendment the council desires clarification on. KG/jdh Comm.
