AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 4 OF THE HAWAII COUNTY
CODE 1983 (2005 EDITION AS AMENDED), VEHICLES AND TRAFFIC, RELATING TO
FEES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`L•
SECTION 1. Pumose. The purpose of this measure is to change penalties for
delinquency from a percentage calculation to a flat fee. This will simplify penalty calculation for
the public and for County staff, and will be consistent with the method for charging similar
penalties in the other counties.
SECTION 2. Section 24-18, Hawaii County Code 1983 (2005 edition) is amended to
read as follows:
"Section 24-18. Motor vehicle tax; minimum tax; penalties for
delinquency.
(a) The minimum tax assessed under section 24-17 shall in no case be
less than $6.
(b) Effective r=~ :; ~ 9o=i July 1, 2009, any vehicle weight tax
imposed by section 24-17 for any year and not paid when due,
shall become delinquent and a penalty of [ten-percent] $8 for
vehicles taxed at the passenger car rate and $20 for vehicles taxed
at the commercial vehicle rate shall be added to, and become a part
of, the tax collected."
SECTION 3. Material to be repealed is bracketed and stricken. New material is
~ underscored. In printing this ordinance, the brackets, bracketed and stricken material and
underscoring need not be included.
SECTION 4. If any provision of this ordinance, or the application thereof to any person
or circumstance is held invalid, such invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid provision or application, and to this
end, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
