1. APPLICANTS: MICHAEL K. & THUY FUJIMOTO - Applications for a State Land
Use Boundary Amendment from Agricultural to Rural District and a Change of Zone
by changing the district classification from Agricultural (A-5a) to Residential and
Agricultural (RA-2a) for approximately 5.0001 acres of land. The property is located
in Anekona Estates Subdivision between Kawaihae Road and Kanehoa Drive and
approximately 1,450 feet east of the Kawaihae Road-Anekona Street intersection, Ouli,
South Kohala, Hawaii, TMK: 6-2-11:6.

2. APPLICANT: PUALANI ESTATES, INC. - Request to amend Condition C (time to
secure Final Subdivision Approval) of Change of Zone Ordinance No. 93 76, amending
Ordinance No. 90 63, which reclassified approximately 99.3 acres of land from
Unplanned (U) to Single Family Residential (RS-7.5 and RS-20) zoned districts. The
property is located mauka of the Queen Ka'ahumanu Highway extension approximately

3. APPLICANT: VVAIKOLOA DEVELOPMENT COMPANY - Request to amend
Condition Nos. 3 (commence operations) and 12 (life of the permit) of Special Permit

the south (Kona) side of Waikoloa Road approximately 2 miles mauka of its intersection

4. APPLICANT: SCD KAHAKAI, LLC - Request to amend conditions of Change of
Zone Ordinance No. 9121, which reclassified approximately 108.336 acres of land

Management Area Use Permit No. 304, which allowed the development of a 353-lot.
residential subdivision and related improvements. The proposed amendments to the
applicable conditions are to reflect the reduced density from a 353 to a 98-lot
subdivision. Thee property is located between Kuakini Highway and the proposed Ali'i
Highway, north of Kahakai Elementary School and Alii Kai Subdivision, Puapuaa 1st
and 2nd, North Kona, Hawaii, TMK: 7-5-20:1.

9. PLANNING COMMISSION - Continued hearing on the initiation of proposed
amendments to Rule 9 of the County of Hawaii Planning Commission's Rules of
Practice and Procedure. The amendments are being proposed to bring Rule 9 into
conformance with changes made to Chapter 205A, Hawaii Revised Statutes, and also to
include certain procedural requirements.

10. PLANNING DIRECTOR - Continued hearing on the initiation of a proposed bill to
amend Chapter 25 (Zoning Code) of the Hawaii County Code, relating to Bed and
Breakfast establishments.

ADJO T NMENT
The purpose of the public hearings is to afford all interested persons a reasonable
opportunity to be heard on the above requests. According to Rule 1 (General Rules) of the
Planning Commission, a person desiring to submit oral or written testimony shall indicate
her/his name; residence address; and whether the testimony is on her/his behalf or as a
representative of an organization or individual. If testimony is being submitted on behalf of an
organization, documentation showing membership ratification should accompany the
testimony. Written testimony shall he submitted with an original and nine copies prior to
testifying. The Commission would appreciate timely submittal to the Planning Department at
least one week prior to the hearing date to allow for mailing and thorough Commission review.
Testimony which is irrelevant or unduly repetitious may be limited by the Chairperson
pursuant to Rule 1.
Maps showing the general location and boundaries of the areas under consideration
and/or plans of the proposed developments are on file and open to inspection during office
hours in the office of the Planning Department in the County Building at 25 Aupuni Street,
Room 109, Hilo, Hawaii, and in the Planning Department's West Hawaii Office at 75-5706
Kuakini Highway, Suite 109, in Kailua-Kona, Hawaii.
Pursuant to Rule 4, Contested Case Procedure, of the County of Hawaii Planning
Commission Rules of Practice and Procedure, any person seeking to intervene as a party
to a contested case hearing on agenda Item Nos. 3, 4 (SMA only), or 5 is required to file a

written request which must be received in the office of the Planning Department no later
than seven (7) calendar days prior to the Planning Commission's first meeting on the
matter. Such written request shall be in conformity with Rule 4, in a form as provided in
Rule 4 Appendix A "Petition for Standing in a Contested Case Hearing." The written
petition/request shall be filed with the Planning Commission at 25 Aupuni Street, Room
109, Hilo, Hawaii 96720, and accompanied by a filing fee of $100 payable to the Director
of Finance. Any party may retain counsel if that person so desires. Rule 4 may be
inspected or purchased ($2.50) at the above-cited location.
