SUBJECT: BILL 66, DRAFT 2, PHONE USE WHILE DRIVING
The Hawaii Police Department supports the passage of revised Bill 66, as amended, a
proposed County Ordinance, Relating To Inattention To Driving.
The current version of Bill 66 is a proactive approach to the growing trend of society
desirous of communicating or being entertained while driving on our roadways. The
safe operation of a motor vehicle is the primary duty of the driver, who should not be
distracted or have their attention divided by these devices. The use of such devices
while operating a motor vehicle poses a safety risk not only to the driver and occupants
of the vehicle, but to all vehicular, pedestrian and cyclists that share the same roadway.
As I previously testified before the County Council, studies have shown there is little to
no cognitive difference (distraction) between holding a device to one's ear and using a
"hands-free" device while operating a motor vehicle. The proposed Bill is not a "cure
all" intended to eliminate the many distractions associated with the safe operation of a
vehicle; however, it is a practical and reasonable proposal in the right direction.
