Re: Resolution Creating Positions
With the sunset of State's Act 90 in June 2007, County departments were required to look
at their existing contracts and develop plans to eventually eliminate the need to contract
out services for work that was historically and customarily performed by civil service
employees. The Traffic Division currently has a traffic striping contract that will expire at
the end of this fiscal year. In an effort to prevent a delay in service with the expiration of
that contract, they are requesting for additional personnel to fulfill that function. Without
the requested positions, the workload will create a backlog for the Traffic Division and no
striping would be available for the resurfacing pavement project conducted by the
Highway Maintenance Division.
Enclosed is a resolution that creates five (5) new positions in the Traffic Signs and
Markings Section of the Department of Public Works' Traffic Division. These positions
include a Lead Traffic Signs and Markings Painter, two (2) Traffic Signs and Marking
Painters, and two (2) Traffic Signs and Marking Helpers.

Public Works, Traffic Division.

B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
With the sunset of Act 90 in June 2007, County departments are required to look at their existing contracts
and develop plans to eventually eliminate the need to contract out services for work that was historically and
customarily preformed by civil service employees. The Traffic Division currently has a striping contract that
will expire by the end of this fiscal year. In an effort to prevent a delay in service with the expiration of the
contract, we are requesting additional personnel to fulfill this function.
In lieu of Act 90, legislature passed a bill adding another exemption under Section 76-77 which allows for
personal services with private persons or entities lasting no more than one year and a cost of no more than
$750,000. (Without an upper limit this contract would probably reach $900,000 to $1,000,000.) The current
contract will expire on June 30, 2009. Therefore without the requested positions, the workload will create a
backlog for the Traffic Division and no striping would be available for the resurfacing pavement project
conducted by the Highway Maintenance Division. We will be requesting to fill the position after the start of
the new fiscal year.

1. Give reasons how new duties arose (statutes enacted, ordinances, newly
authorized programs, basis for increased workloads, etc.):
Under Act 90, the Traffic Division contracted out the traffic striping function since it
was more cost effective to do this than to hire a crew and purchase the equipment,
materials and supplies needed to perform this function. With the sunset of Act90 in
June 2007, the Traffic Division was able to enter into a contract for the striping
services not to exceed one year, which will expire on June 30, 2009. Without the
ability to continue contracting this service out, we are requesting the creation of
additional crew members in order to maintain the level of service required. This
function is critical to public safety whenever roads are re-surfaced or constructed.
2. Can new duties be assigned to existing positions or handled in other way such as
short term contracts, etc.
Since the issue is to take on additional work to replace existing contracts, we do not
feel the work can be performed by existing staff. The current staffing is adequate for
the current workload. If the Traffic division is to take on the additional workload from
the contract, it would create a major backlog.
3. How will the new positions increase the efficiency/effectiveness of operations? (Use
productivity measurements where possible.):
With the creation of the additional crew, the Traffic Division will be able to take on
more projects at the same time. Without the additional workers, a backlog would
be created if we were not able to continue with the current contracts.

Keeping the existing contract costs the County more money than if these positions
were created (including the purchase of new equipment).
5. Why were manpower needs not planned through budgetary process?
The Traffic Division did budget for the new positions in their 2009-2010 fiscal year.

The creation of these positions will help to settle the pending grievance with UPW. If
the grievance is not settled, we expect that it will be pursued through arbitration and
will cost the County even more money in the long run.
