The County of Maui, Department of Fire and Public Safety, 200 Dairy Road, Kahului, Hawai'i 96732, recognizes the need for having additional emergency fire vehicles in order to meet the growing needs here in the County of Hawai'i and wishes to assist the Hawai'i Fire Department in providing such vehicles to meet those needs. Their donation, consisting of two (2) 1991 Seagrave Model JB50DH 1500 GPM Fire Pumpers with miscellaneous equipment, has a total estimated value of $100,000. As a municipal corporation, considering the age of the vehicles, it is to be expected that the County of Maui would want full immunity and indemnification for its proposed donation. REQUEST: Prepare a resolution for the Hawaii County Council, on behalf of the County of Hawaii, to accept a donation of two (2) Seagrave Fire Pumpers from the County of Maui, and to enter into a related "Release, Hold Harmless, and Indemnity Agreement", for any and all liability resulting from the transfer of ownership and control of these vehicles, as a condition of the donation. Please send a copy of the resolution and letter acknowledging this donation to: Mr. Mr. Jeffrey A. Murray, Fire Chief, County of Maui, 200 Dairy Road, Kahului, Maui, Hawaii 96732. B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): The Hawai'i Fire Department (HFD) desires to accept this donation. The donation consists of two Fire trucks , Vehicle Identification Numbers Z-78351 1 F9EW28J8MCST2155 and Z-78350 1 F9EW28JOMCST2148, manufactured and originally purchased by Maui County in 1991. Maui has purchased newer models and no longer needs these vehicles. The HFD's Chief Mechanic and Auxiliary Services Battalion Chief traveled to Maui to inspect these vehicles and found them to be mechanically sound and well-maintained, and not requiring any immediate cost to bring them up to HFD standards. Corporation Counsel has reviewed the above-mentioned agreement and found it to be acceptable. As recommended, a written statement has been obtained from Maui regarding any post-manufacture modifications made to the vehicles, of which there were none. HFD intends to add these vehicles to its reserve fleet, which is tapped in the event of vehicle breakdown. Many vehicles in the HFD reserve fleet are of earlier vintage than the proposed additions.
