Re: Wastewater Improvement Projects
Enclosed is a bill for an ordinance authorizing the Mayor to enter into an intergovernmental
agreement for a loan from the American Recovery and Reinvestment Act of 2009 portion
of the State Water Pollution Control Revolving Fund for wastewater improvement projects
and authorizing the issuance of general obligation bonds for the purpose of financing the
following projects:
Komohana Heights LCC Replacement
Honokaa LCC Replacement
Queen Liliuokalani Village LCC Replacement
North Kona Sewer
North Kona Effluent Reuse Upgrade
The Department of Environmental Management will be submitting an application for a
loan(s) funded by the American Recovery and Reinvestment Act (ARRA) of 2009 portion
of the Water Pollution Control Revolving Fund. The State Department of Health has
indicated that $7,500,000 of the ARRA funds will be made available to the County of
Hawai'i as a zero interest, zero fee loan with principal forgiveness. To be eligible for these
funds, projects must be ready to go and meet the required timelines and it is believed the
projects listed above can meet the requirements, however, as with any project, a number
of things could cause a delay for any of these projects.
At this time, the available ARRA funds will be expended on the Komohana Heights LCC
Replacement and Honokaa LCC Replacement projects with the other projects listed as
alternates should either of these projects encounter any delays. Due to the strict
deadlines associated with the ARRA funds, it is our intention to maximize the utilization of
these funds by directing the funds to any combination of the above listed projects based
on project readiness. 3

In order to expedite the authorization and execution of the loan agreement(s) so that
construction on these projects can begin as soon as possible to comply with the required
timelines, the Department of Environmental Management kindly request a waiver from the
Finance Committee and have this bill heard at the Council meeting scheduled for
May 20, 2009./

A. REQUEST:

RE: BILL NO. 83 AN ORDINANCE AUTHORIZING THE MAYOR OF THE

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Finance Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval is granted and the
matter be placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Finance Committee
for placement on its future agenda.
