ORDINANCE NO. 9'7 26
AN ORDINANCE TO AMEND THE HAWAII COUNTY CODE 1983 (1995 EDITION)
RELATING TO THE BUILDING CODE.
BE IT ORDAINF,D BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 5-2.2.1 of the Hawaii County Code 1983 (]995 Edition) is hereby
amended to read as follows:
"Section 5-2.2.1. Applicability of code.
This Code sets forth design requirements for the efficient use of energy in new
buildings and new construction in existing buildings as further defined in this Code.
This Code applies to buildings or portions of buildings that provide facilities or shelter
for human occupancy. Included are shell buildings, speculative buildings and
warehouses, or portions thereof, that are converted to use as facilities or shelter for
human occupancy The requirements apply to building envelope; distribution of
energy; and systems and equipment for ventilating, air conditioning, service water
heating, lighting, and energy managing."
SECT[ON 2. Section 5-2.2.2 of the Hawaii County Code 1983 (7995 Edition) is hereby
amended to read as follows:
"Section 5-2.2.2. When code not applicable.
This Code does not apply to:
(a) Areas of buildings intended primarily for manufacturing or for commercial or
industrial processing;
(b) Buildings or separately enclosed identifiable areas having any combination of
dedicated space heating, service water heating, ventilating, air-conditioning and
lighting systems whose combined peak design rate of nonrenewable energy
usage for these purposes is less than 1.0 watt/ftz or 3.473 Btu/h-ft2 of gross
floor area. Site generated wind, hydro or solar electric power are exempt; [and]
(c) Buildings of fewer than one hundred square feet of gross Floor area
(d) Moved buildings
and factory built structures."
SECTION 3. Section 5-2.3.1 of the Hawaii County Code 1983 (1995 Edition) is hereby
amended by adding the following definitions to read as follows and to be placed in
their appropriate order:
"'Factory built structure' means any structure which is fabricated or assembled at
dace other than the building site."
"'Service establishment' means aretail-]ike lacility including watch repair, real
estate office auto and fire service facilities, parts deparfinents ,travel asencies, and
similar facilities in which the customer obtains services rather than the direct selection
of Qoods."
SECTION 4. Section 5-2.4.4 of the Hawaii County Code 7983 (1995 Edition) is hereby
amended to read as follows:
"Section 5-2.4.4. Requirements.
(a) Basic Requirements. All building designs shall meet the requirements of sections
5-2.5.3, 5-2.6.3, 5-2.8.3, 5-2.9.3, 5-2.10.3 and 5-2.11.3 of this Code.
(b) Prescriptive and/or System Performance Criteria. In addition to the basic
requirements of subsection (a), either the requirements of this subsection, the
prescriptive and/or system performance criteria, or of subsection (c), the cost
budget method, shall be met.
(1) The lighting design shall meet either the prescriptive criteria of section 5-2.6.4
or the system performance criteria of section 5-2.6.5;
(2) The roof of the building envelope shall meet the prescriptive criteria of
section 5-2.8.4. Walls may meet either the prescriptive criteria of
section 5-2.8.4 or the system performance criteria of section 5-2.8.5;
(3) The heating, ventilating and air conditioning systems design shall meet the
prescriptive criteria of section 5-2.9.4; and
(4) The service water heating systems and equipment design shall meet the
prescriptive criteria of section 5-2.17.3.
(c) Building Energy Cost Budget Method. The building energy cost budget method
(division 13) may be used instead of the prescriptive and/or system performance
criteria of subsection (b).
(d) Plans and Specifications. Plans, specifications and necessary computations shall
be submitted to indicate compliance with the Code. Plans and specifications for
work to comply with this Code shall be prepared, designed, or approved by a
duly registered professional engineer or architect as required by chapter 464 of the
Hawaii Revised Statutes. The plans shall include a certification by the responsible
engineer or architect that the design conforms to this Code.
(e) Information on Plans and Specifications. The plans and specifications shall show
in sufficient detail all pertinent data and features of the building and the
equipment and systems as herein governed including but not limited to: exterior
envelope component materials, U-values of the respective elements including
insulation, R-values of insulating materials, size and type of apparatus and
equipment, equipment and system controls, and other pertinent data to indicate
compliance with the requirements of this division [article]
SECTION 5. Section 5-2.6.2.(c) of the Hawaii County Code 7983 (1995 Edition) relating
to Lighting (Scope) is hereby amended to read as follows:
"(c) The lighting requirements in this division (article] shall apply to new lighting
systems installed in existing buildings where such lighting systems are for an
entire floor or an otherwise definable area larger than one thousand square feet
and shall also apply to the first tenant improvement in shell or speculative
buildings or converted warehouses re ag rdless of area."
SECTION 6. Section 5-2.6.3.(a) of the Hawaii County Code 1983 (1995 Edition) is
hereby amended so that Table 6-1 relating to Exterior Lighting Unit Power Allowances
reads as follows:

SECTION 7. Section 5-26.3.(c)(1) of the Hawaii County Code 1983 (1995 Edition) is
hereby amended to read as follows:
"(c) Lighting Power Control Credits
(1) Lighting Power Control Czedit (LPCC). When de~**++i*+i*+g compliance of
the actual design with the lighting power allowance established by either
section 5-26.4 or 5-26.5, the connected lighting power (CLP) for lights
automatically controlled by occupancy sensing, daylight sensing control,
lumen maintenance control, or programmable timing control, may be
reduced by subtracting control credits on a specific area-by-area basis. This
credit is termed the lighting power control credit (LPCC) and shall be
determined in accordance with Equation 6-1:
LPCC = CLP x PAF Equation 6-1
where:
LPCC =Lighting power control credit (W)
CLP =Connected lighting power for the luminaires controlled
by the automatic control device (W)
PAF =Power adjustment factor
The adjusted lighting power (ALP) is then equal to [CLP x LPCC] CLP -LPCC."

SECTION 8. Section 5-2.6.4.(b) of the Hawaii Cottnty Code 1983 (1995 Edition) is hereby
amended so that Table 6-5 relating to Prescriptive Unit Lighting Power Allowance (UEFA) reads
as follows:

SECTION 10. Section 5-2.8.L(a) of the Hawaii County Code 1983 (1995 Edition) relating
to Building Envelope (Scope) is hereby amended to read as follows:
"(a) The requirements of this division apply to all buildings or portions of buildings
which provide shelter or facilities for human occupancy unless exempted by
section 5-2.2.2 or section 5-2.2.3. The requirements apply to new buildings and
to additions which increase the floor space of existing buildings. These
requirements also apply to shell or speculative buildings and to warehouses that
are converted to use as facilities or shelter for human occupancy if the building
was permitted after March 31, 7997."
SECTION 11. Section 5-2.8.4.(d) of the Hawaii County Code 1983 (1995 Edition) relating
to Prescriptive Criteria is hereby amended to read as follows:
"(d) Horizontal Glazing (Skylights).
(1) The horizontal projection of skylight area shall be limited to a maximum
fraction of the horizontal projection of roof area which is specified by the
following equation:
A = 0.025/SC Equation 8-9
Where:
A =Maximum allowed skylight area measured as the skylight's
horizontal projection. Expressed as a fraction of the horizontal
projection of roof area. Shall be less than or equal to 0.75.
SC =Shading coefficient of skylight; may be from manufacturer's
literature.
(2) Exceptions.
Low-rise residenfial buildings that are not air-conditioned or those in
locations with greater than eight hundred heating degree days (base
sixty-five degrees Fahrenheit) or with elevation greater than two
thousand five hundred feet above sea level (where degree day data are
not available).

SECTION 12. Section 5-2.9.3.(a) of the Hawaii County Code 7983 (1995 Edition) relating
to Basic Requirements for Heating, Ventilating and Air-Conditioning (HVAC) Sytems is
hereby amended to read as follows:
"Section 5-2.9.3. Basic requirements.
(a) Load Calculations.
(1) Calculation Procedures.
Cooling system design loads for the purpose of sizing systems and
equipment shall be determined in accordance with the procedures
described in the ASHRAE Handbook, 1989 Fundamentals or a similar
computation procedure. For those design parameters addressed in
subdivisions (2) through (9), the values specified shall be used.

(B) Exceptions.
(i) Desien load calculations need not be submitted for new. individually
~errnitted, cooline svsterns of less than 65,000 Btu/hr capacity that
provide less than 37 Btu/hr of installed capacity per square foot of
conditioned floor area.
Cti) Desien load calculations need not be submitted when existing
coolin¢ equipment is replaced with equipment of equal or less capacity."
SECTION 13. Section 5-2.9.3.(8) of the Hawaii County Code 1983 (1995 Edition) relating
to Materials and Construction is hereby amended so that Table 9-1 relating to
Minimum Pipe Insulation reads as follows:

SECTION 14. Material to be repealed is bracketed. New material is underscored. In
printing this ordinance, the brackets, bracketed material and underscoring need not be
included.
SECTION 15. if any provision of this ordinance, or application thereof to any person or
circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of this ordinance which can be given effect without the invalid provision or
application, and to this end, the provisions of this ordinance are declared severable.
SECTION 16. This ordinance shall take effect on April 1, 1997.
