Subject: Testimorny in favor of Bill 106 and NOT in favor of Bill 49
Aloha Council Members, April 18, 2009
My name is Frank Commendador President of the Fern Acres Community Association. I
represent approximately 900 homeowners and 1100 lot owners here in Mountain View, Hilo.
The Board of Directors and Community Members met today at our community center.
The above subject of purchasing open space/ public land (Bill 106) as mandated in previous
legislation was part of our agenda. Along with discussion of the Mayor's request in the form of
Bill 49 to suspend payments for 2 years into the 2% land fund (Bill 257).
It was unanimously decided by a motion on the floor to "support" Bill 106.
As a matter of record it was also voted unamiously "not to support" Bill 49
and it's intent to suspend payments into the 2% land fund for two years.
It was also expressed by the majority present that the $8.5 million dollars already in the land fund
account should not be used now or in the future to balance the Hawaii county budget.
We again urge the Hawaii County Council to seriously look at the short coming of the past and
current administration and there inability to take swift corrective action to collect all monies due
our county IE.
1- Per Director Stanley Sitko - Real Property Tax - There are delinquent taxes of over $16
million dollars of real property tax that have yet to be collected by his department.
2- Per Councilman Guy Enriques - the Land Fill tipping fees that are suppose to be paid to Hawaii
County are in arrears in the sum exceeding $1.5 million dollars.
I do not need to tell anyone these delinquent accounts are staggering and is no way to manage our
county government.
To allow this to continue year after year is not serving our best interest, a grave dereliction of duty
and a breach of public trust you all are suppose to protect?
To allow the inflation the current operating budget (2009-2010) with vacant positions and then
fund these positions to a tune of $9.5 million dollars is also suspect and not in the best interest of
the county or the in keeping with the Mayor's promise to freeze hiring of non essential positions.
It also does not give the people a clear picture of the alleged budget short fall?
Please, we urge our Hawaii Council to direct our Mayor to revisit his budget and find another way
to balance it.
We need to trust in your ability to see through the strategy being employed to pursuade you to
vote for Bill 49. ^

I am sure we all are aware of political gambits that suggest the perspective presented or the
interpertation of some of the gathered statistics are the only way to solve this alleged budget short
fall?
Vote NO on Bill 49
Vote YES on Bill 106
