UNFINISHED BUSINESS Serving the Interests of the People of Our Island Hawai `i County is an Equal Opportunity Provider and Employer PSPRC-7 Page 2 May 19, 2009 Comm. 262: AN ORDINANCE AMENDING CHAPTER 24, HAWAII COUNTY CODE 1983 (Bill 66) (2005 EDITION, AS AMENDED), RELATING TO INATTENTION TO DRIVING (adds a new section making it a violation to use a mobile electronic device while operating any vehicle, unless used with a hands-free device, subject to a maximum fine of $150; or if such uses causes an accident, a maximum fine of $500 or not more than 30 days in prison or both) From Councilmember Pete Hoffmann, dated April 8, 2009, transmitting the above bill. Recommend passage of Bill 66, as amended to Draft 2, on first reading; and close file on all related communications. Ayes: Committee Members Ford, Hoffmann, Ikeda, Naeole, Onishi, Yagong, Yoshimoto, and Chair Enriques. Noes: Committee Member Greenwell. Absent: None. (NOTE: Committee Member Naeole voted "kanalua times two.") Comm. 262.2: From Councilmember Pete Hoffmann, dated April 29, 2009, submitting the following proposed amendments to Bill 66, relating to inattention to driving: 1) removes the penalty of 30 days imprisonment; 2) exempts drivers holding an operator license issued by the federal communications commission; and 3) changes the effective date from upon approval to October 1, 2009. Comm. 262.5: From Police Chief Harry S. Kubojiri, dated May 6, 2009. Comm. 262.6: From Councilmember Dennis Onishi, dated April 30, 2009 submitting a proposed amendment to Bill 66 to change the effective date from upon approval to January 1, 2010.
