RESOLUTION NO. 186 09
RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER
INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT
OF DEFENSE, STATE CIVIL DEFENSE, PURSUANT TO HRS 46-7, FOR
THE EMERGENCY MANAGEMENT PERFORMANCE GRANT
WHEREAS, since 1999, the State of Hawaii Department of Defense, State Civil
Defense has been the recipient or grantee of Emergency Management Performance
Grant (EMPG) Program allocations; and
WHEREAS, EMPG funds are currently provided through the U.S. Department of
Homeland Security, Office of Grants and Training, to sustain and enhance emergency
management capabilities at the State and local government levels; and
WHEREAS, these program funds have been traditionally used by State and county
civil defense agencies to partially reimburse program expenses for salaries, planning,
preparedness projects, readiness exercises, training, travel, and for emergency
operations center utilities; and
WHEREAS, the funds are provided to the Hawaii County Civil Defense Agency to
support a comprehensive emergency management that is able to respond to natural and
manmade hazards, homeland security-related incidents, and other emergencies that may
threaten the property, safety and well-being of the citizens and communities; and
WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county
departments obtain the consent of the council to enter into agreements with the federal or
state governments respecting action to be taken pursuant to any of the powers granted
by law to furnish, expend, and receive any funds or other assistance in connection with
projects being or to be undertaken pursuant to those powers.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor
of the County of Hawaii is authorized to execute, on behalf of the County, the
Memorandum of Agreement with the State Civil Defense, attached hereto and
incorporated herein by reference as Exhibit "A", to enable the County of Hawaii to receive
the Emergency Management Performance Grant.
BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is
authorized to sign the above-referenced agreement and any related documents on behalf
of the Office of the Mayor and the County of Hawaii pursuant to the Hawaii County
Charter.
BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall
transmit copies of this resolution to the Office of the Mayor, the Finance Department, the
Hawaii County Civil Defense Agency.

For
FY 2008 8e FY 2009 Department of Homeland Security Grant Program
Program: Emergency Management Performance Grant
Award Number: 2008-EM-E8-0039/2009-EP-E9-0032
SUBGRANTEE: Hawaii Civil Defense Agency
I. PROGRAM DESCRIPTION
The FY 2008 & FY 2009 Emergency Management Performance Grant in the amount of $111,224.00 for
each year is provided to the County of Hawaii. These grant funds are provided to the Hawaii Civil
Defense Agency to support a comprehensive emergency management able to respond to natural and
manmade hazards, homeland security-related incidents, and other emergencies that may threaten the
property, safety and well-being of the citizens and communities.
II. AUTHORITIES
The Emergency Management Performance Grant is supported under the Department of Homeland
Security Consolidated Appropriations Act of 2008 (P.L. 110-161) and Act of 2009 (P. L. 110-329)
Both State Civil Defense and Hawaii Gvil Defense Agency shall follow the guidance listed in the Catalog of
Fede21 Domestic Assistance (CFDA), The CDFA Number of the FY 2008 & FY 2009 Emergency
Management Performance Grant is 97.042.
III. PERIOD OF PERFORMANCE
The Period of Performance shall be for a twelve (12) month period effective January 1, 2008 through
December 31, 2008 for FY 2008 Emergency Management Performance Grant and January 1, 2009
through December 31, 2009 for FY 2009 Emergency Management Performance Grant.
The Hawaii Civil Defense Agency shall not incur costs or obligate funds for any purpose pertaining to the
operation of the project, program, or activities beyond the expiration date of the period of performance.
IV. AMOUNT AWARDED AND DISTRIBUTION
This Memorandum of Agreement for the FY 2008 & FY 2009 Emergency Management Performance Grant
funds supports the Hawaii Civil Defense Agency to structure the emergency management programs
based on identified needs and priorities for strengthening capabilities that address all hazards.
The Emergency Management Performance Grant program funds shall be used for emergency
management programs to accomplish the following initiatives:
1. National Preparedness. Support the National Preparedness Goal and Priorities and the Target
Capabilities List which identifes 37 national preparedness capabilities for Federal, State, and local
jurisdictions.

2. Implement a common, shared approach to support the National Preparedness Goal. Establish a
program designed to achieve the target levels of capability to sustain and enhance the
effectiveness the Hawaii Civil Defense Agency's emergency management program.
3. Emergency Management Organization Program. Progrems must continue to fund necessary
aspects of the emergency management that support day-to-day preparedness, response, and
recovery activities, including mitigation.
4. Emergency Management Accreditation Program. Emergency management programs should take
steps to move toward compliance with EMAP standards.
The Emergency Management Performance Grant funds can be used to support regular salaries (no
overtime) and associated fringe benefits; travel; utilities; and supplies expenses.
The Emergency Management Performance Grant will be made available to the Hawaii Civil Defense
Agency on a reimbursement basis. Reimbursement of funds will be made payable by check to the Hawaii
Civil Defense Agency provided appropriate documentation of payments made are submitted to State Civil
Defense.
FY 2008 & FY 2009 Emergency Management Performance Grants Program Guidance and Application Kit
can be obtained from the Department of Homeland' Security website.
Hawaii Civil Defense Agency is not permitted to sub grant funds to another county agency.
V. COST-SHARE/MATCH
There is 50-50 match required for these grant funds, If costs exceed the maximum amount of funding,
the Hawaii Civil Defense Agency shall pay the costs in excess of the approved budget. Hawaii Civil
Defense Agency agrees to allow the excess costs over the approved budget to be used as additional non-
federal cost share match for the State.
VI. MAINTENANCE OF EFFORT/SUPPLANTING OF FUND
The purpose of these funds is to support the Hawaii Civil Defense Agency emergency management
programs and shall be used to supplement and shall not be used to supplant county funds dedicated
to this effort.
VII. ADMINISTRATNE COST RESTRICTION
The Emergency Management Performance Grant funds cannot be transferred between the Homeland
Security Grant Program funds, Law Enforcement Terrorism Prevention Program, Citizen Corps Program,
Metropolitan Medical Response System, or the Urban Areas Security Initiative program funds.
IX. FINANCIAL REPORTS
FINANCIAL STATUS REPORT: State Civil Defense shall submit financial reports (Financial Status Report
to the Office of the Comptroller within 30 days after end of each quarter. Reports are due January 1,
April 30, July 30, and October 30. Final financial reports are due 90 days after the closeout of the grant.
Semi-annual biannual strategy implementation reports providing updated obligation and expenditure
information is due to Department of Homeland Security July 30th and January 30th.

The Hawaii Civil Defense Agency shall provide a status report to State Civil Defense on a quarterly basis
so as to allow compliance with the quarterly and semi-annual reporting requirements,
REPORT SUBMISSION: The Hawaii Civil Defense Agency shall submit quarterly reports to State Civil
Defense, Attn: Admin, by the 5th day of the month following the ending of each quarter.
