Re: Resolution Transferring Funds
Recently, the County was ordered by the courts to pay approximately $1,658,000 in damages
resulting from the Coupe condemnation. Payment is needed to obtain possession of the real
property to complete the Mamalahoa Bypass Highway. With approximately $684,000 available
in the Miscellaneous Insurance Claims and Judgments account, the remaining funds will come
from the Health Benefits account. There are monies available in the Health Benefits account
since the Employer Union Trust Fund (EUTF) did not increase the rates for retirees this year as
was previously reported to us. While we have saved this year due to the EUTF utilizing reserves
available to cover the current year's increase; the increase in FY 2010 for the retires has been
set at 15 percent.
Enclosed is a resolution transferring $974,000 out and from the General Fund's Health Benefits
account and crediting it to the Miscellaneous Insurance Claims and Judgments account.
Because of the urgency of having the funds transferred during this fiscal year, we would like to
request a waiver from the Finance Committee and have this resolution heard at the Council
meeting scheduled for June 2, 2009.

RE: RESOLUTION NO. 181-09 : A RESOLUTION TRANSFERRING/APPROPRIATING
AN APPROPRIATION OUT AND FROM THE DESIGNATED FUND ACCOUNT(S)
AND CREDITING SAME TO A DESIGNATED FUND ACCOUNT(S)
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Finance Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval is granted and the
matter be placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Finance Committee
for placement on its future agenda.
