HomeMy WebLinkAboutRES 191 Draft 01 2008-2010COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 191 09 RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO COMPROMISE A CLAIM FOR SURPLUS FUNDS IN ACCORDANCE WITH SECTION 19-3(12), HAWAII COUNTY CODE. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. WHEREAS, Remar Sylvester has made claims for the surplus funds from the sale of his father's properties that were sold by the County of Hawaii at its tax sale in December 1989; and WHEREAS, while his mother did receive notices of the tax sale and notices to claim the surplus, she understands no English and did not attempt to have the notices translated; and WHEREAS, due to these unfortunate circumstances, the family not only lost the three parcels that the father had owned, but the surplus funds went unclaimed, until now, when the family finally learned what has happened to the parcels; and WHEREAS, while the parcels cannot be returned to the family, the Director of Finance needs Council approval in order to recognize these claims for surplus funds, due to the length of time involved, pursuant to Section 19-3(12), Hawaii County Code. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it hereby authorizes the Director of Finance to compromise and settle the claims of the Remar Sylvester family and pay the surplus fund claims. BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (I) the Mayor; (2) Nancy Crawford, Finance Director; and (3) Remar Sylvester, 548 Makalika Street, Hilo, Hawaii 96720.
