Re: Resolution Authorizing Finance Director to Compromise a Claim for Surplus Funds o
Enclosed is a resolution authorizing the Director of Finance to compromise a claim for surplus
funds for the Remar Sylvester family, which due to unfortunate circumstances lost three parcels
of land at a County real property tax sale in December 1989. Although the 2 year claim period
has passed, the Director of Finance can compromise and settle the claims of the Remar
Sylvester family and pay the surplus fund claims of $4,787.69, with the approval of the Council.
To settle this matter in a timely fashion, we would like to request a waiver from the Finance
Committee and to have this resolution heard at the Council meeting scheduled for June 2, 2009.

RE: RESLOUTION NO. 191-09 : RESOLUTION AUTHORIZING THE DIRECTOR OF
FINANCE TO COMPROMISE A CLAIM FOR SURPLUS FUNDS IN ACCORDANCE
WITH SECTION 19-3 (12), HAWAII COUNTY CODE.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Finance Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval is granted and the
matter be placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Finance Committee
for placement on its future agenda.
