ORDINANCE NO. 9`7 5U
AN ORDINANCE AMENDING CHAPTER 24, OF THE HAWAII COUNTY CODE
1983 (1995 EDITION), RELATING TO VEHICLES AND TRAFFIC.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 24, article 8, division 1, section 24-190
(Picking up or discharging passengers), of the Hawaii County Code,
is amended to read as follows:
Section 24-190. Picking up or discharging passengers.
(a) Except when necessary to avoid conflict with other
traffic, or in compliance with law or the directions
of a police officer or official traffic-control
device, no person shall stand or park a vehicle,
whether occupied or not, except momentarily to pick up
or discharge a passenger or passengers:
(1) In front of or within four feet of a public or
private driveway[,] or within [thirty] a distance
>>n to seventy-five feet of a public or private
driveway when [special] appropriate signs or
markings are installed;
(2) Within fifteen feet of a fire hydrant;
(3) Within thirty feet of a [marked or unmarked]
crosswalk[, except where designated by a parking
stall;] or within a distance up to seventy-five
feet of a crosswalk when appropriate signs or
markings are installed;
(4) Within thirty feet of an intersection[;]
within a distance up to seventy-five feet of an
intersection when appropriate signs or markings
a~ installed•
(5) Within twenty feet of a driveway entrance to any
fire station and on the side of the street
opposite the entrance to any fire station within
seventy-five feet of such entrance when properly
marked;
(6) Within seventy-five feet upon the approach to any
traffic control signal except when designated by
a parking stall;
(7) At any place where special signs or markings
prohibit standing;
(8) Except where otherwise specifically provided for
by ordinance applicable to driveways located upon
the following streets, in front of or within
thirty feet of any driveway located on Aupuni and
Pauahi Streets in the City of Hilo; or
(9) Within the turn-around area of a dead-end street,
when special signs are erected.
(b) The department of public works shall indicate by signs
or by markings painted upon the curbings the areas
within which parking has been prohibited by this
division.
SECTION 2. Material to be repealed is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material and underscoring need not be included.
SECTION 3. If any provision of this ordinance, or the
application thereof to any person or circumstance, is held invalid,
such invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 4. This ordinance shall take effect upon its approval.
