Dear Ms. Parong:
Subject: Change of Zone Application (REZ 08-000084, RS-20 to RS-15),
Driveway Access to Volcano Road, Hawaii, Puna, Keaau, TMK: (3) 1-7-016:028
We received your letter dated April 23, 2009 requesting reconsideration of the requirement made
in our April 1, 2009 (DIR 0279-2009, HWY-PS 2.1385) letter to you that the "portion of the
existing driveway within the State highway right of way must be reconstructed." As explained in
your letter, road lot TMK: (3) 1-7-016:050 is a private road serving three other parcels rather
than a driveway to a 'single parcel. Further, requiring you to solely bear the cost of such
improvements would be a financial hardship.
Based on the above, we concur with your request and waive this requirement. By copy of this
letter, we also hereby notify the County of Hawaii, Planning Department that we rescind our
November 3, 3008 letter to Mr. Christopher Yuen (HWY-PS 2.9695) and have no objections to
Change of Zone Application (REZ 08-000084).
