Re: Acquisition of Kawa, District of Ka'u
The Hawai'i County Public Access, Open Space and Natural Resources Preservation
Commission cited Kawa (aka Kawa'a) as a site where there are "Lands or property
entitlements with high public interest, imminent needs for acquisition, and largest benefit to the
general public". Resolution No. 451-06, passed by the County Council on October 16, 2006,
authorized the Director of Finance to enter into negotiations for various parcels collectively
known as Kawa'a or Kawa'a Bay (Kawa).
On October 10, 2007, the County of Hawai'i, applied for funding by grant from the State of
Hawai'i, Department of Land and Natural Resources, Legacy Land Conservation Commission,
for the acquisition of Kawa. The Legacy Land Conservation Commission approved the
County's application and granted the amount of $1,500,000, which the Board of Land and
Natural Resources approved on May 9, 2008.
Enclosed is a resolution authorizing the Mayor to enter into an agreement with the State of
Hawai'i Department of Land and Natural Resources, Legacy Land Conservation Commission
and to accept funds for the acquisition of Kawa, District of Ka'u, Island of Hawai'i.
Since the funds must be encumber by the state on or before June 30, 2009, the Department of
Finance is requesting a waiver from the Finance Committee and have this resolution heard at
the next Council meeting scheduled for June 16, 2009.

A. REQUEST:
Prepare resolution authorizing the Mayor to enter into an agreement with the State of Hawai'i, Department of
Land and Natural Resources, Legacy Lands Conservation Commission to accept funds for the acquisition of
Kawa Bay.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The County of Hawai'i applied for grant funding from the State of Hawai'i, Department of Land and Natural
Resources, Legacy Land Conservation Commission for the acquisition of Kawa Bay on October 10, 2007.
The State of Hawai'i Board of Land and Natural Resources approved the Legacy Land Conservation
Commission's grant of $1,500,000 to the County of Hawai'i. The Board of Land and Natural Resources must'
encumber these funds on or before June 30, 2009. Attached are: 1) Copy of resolution No. 451 06. 2) Board
of Land and Natural Resources approval dated May 9, 2008. Copy of resolution No. 240 07.

RE: RESOLUTION NO. 198-09 RESOLUTION AUTHORIZING THE MAYOR TO
ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF
LAND AND NATURAL RESOURCES, LEGACY LAND CONSERVATION
COMMISSION, AND TO ACCEPT FUNDS FOR THE ACQUISITION OF KAWA,
DISTRICT OF KAU, ISLAND OF HAWAII
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Finance Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval is granted and the
matter be placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Finance Committee
for placement on its future agenda.
