Ordinance No. 39
AN ORDINANCE TO FORBID THE
CUTTING, MUTILATING OR DES-
TROYING OF CERTAIN TREES
WITHIN THE COUNTY OF HA-
WAII.
Be it Ordained by the County of
Hawaii:
Section 1. It shall be unlawful for
any person, association, partnership
or corporation engaged in the business
of transmitting electric power or con-
ducting atelegraph or telephone bus-
iness, or any other person, associa-
tion, partnership` or corporation in
any manner whatsoever to cut, trim,
mutilate, destroy or appropriate any
shade, ornamental, fruit or other tree
growing upon any sidewalk, highway
or private property within the County
of Hawaii without first ~traving the
written permission so to as provid-
ed by this ordinance.
Section 2. The owners cf any pri-
vate land within the County of Ha-
waii may permit any of the persons
designated in Section 1 of this ordin-
ance to cut, trim, mutilate, destroy m•
appropriate any tree growing upon
such private land by Written permis-
sion setting forth the time within
which and the manner by which such
person may cut, trim, mutilate, de-
stroy or appropriate any tree or trees
growing upon such land.
Section 3. This ordinance shall be
taken to supersede so much of Sec-
tion 892 of the Revised Laws of the
Territory of Hawaii as relates to the
appropriation of any trees growing
by Nature.
Section 4-Written permission to
cut, trim, mutilate, destroy or appro-
priate any tree or trees growing upon
any sidewalk or highway within the
County of Hawaii may be obtained
only from the Board of Supervisors
of the County by resolution adopted
at a regular meeting of such Board
setting forth the time, place and man-
ner in which any tree or trees may be
so cut, trimmed, mutilated, destroyed
or appropriated and setting forth the
peculiar tree or trees. Such written
permission provided by this section
shall not operate to exempt any party
from the penalties of this ordinance
until the written permission of the
owner of the property abutting the
sidewalk or highway immediately in
front of said tree or trees shall be
obtained.
Section 5-Any person who shall
violate any of the provisions of this
ordinance shall, upon conviction, be
Punished by a fine of not more than
One Hundred Dollars ($100.00) or by
imprisonment for not more than six
(6) months for each tree so cut,
trimmed, mutilated, destroyed or ap-
propriated.
6ection 6. This ordinance shall
take effect from and after the First
day of August, 1909.

at a meeting of the Board of Sup-
ervisors of the County of Hawaii,
held at the County Seat upon the
8th day of July, A. D. 1909, and
upon being put to vote said Ordinance
was adopted by a majority of the Sup-
ervisors at said meeting,
