Ordinance No. 63
AN ORDINANCE REGIILATING THE
SPEED OF VEHICLES AND PRO-
ViDiNG PENALTIES FOR VIOLA-
TIONS THEREOF.
Be it ordained by the Board of Sup-
ervisors of the County of Hawaii:
DEFINITIONS.
Sectlrou 1. The definitions used in
the "Traffic Ordinance" shall apply
to this Ordinance.
Section 2. SPEED LIMITS. The
speed limits in the County of Hawaii
are hereby declared to be as follows:
Dietrict A. All of that section oY
the City oY Ailo bounded on the north
by the Mahiulu Stream; on the west
by a straight line from Mahiulu
Stream to Ponahawai Street, running
through the South Hilo Sail at right
angles to said Ponahawai Street;
thence by a straight line from the in-
tersection thereof with the line from
said Mahiulu Stream to Waiakea
Mill; thence by a straight line Prom
said Waiakea Mill to the shops oY the
Matson Navigation Company at Reed'a
Bay; thence by the shore line from
the said shops to the mouth oY said
Mahiulu Stream; and also all the vil-
lages in the County of Hawaii.
District B. Corners of meeting or
intersecting streets within the limits
prescribed in District A, and also all
sharp street carves.
District C. Passing a public garage
entrance or e--it on the side of the
street next the garage; passing a
school house on school daps between
the hmxrs of R:00 a. m. and 4:00 p. m.;
and approaching an iron, steel or
wooden bridge of ten feet span or
more.
Distr£rt D. Entering streets from
garages or private places by crossing
sidewalks.
Distriot E. All other places not in-
cluded in Districts A. H C. and D.
RATES OF SPF.F.D WITHIN SPEED
LIMITS.
Section 3. District A. No person
shall operate, drive or propel any ve-
hicle and no owner thereof riding
thereon or therein shall Douse or per-
mit such vehicle to be operated, driven
or propellod on any street within Dis-
trict A at a rate of speed exceeding
fifteen miles an hour.
Section 4. District B. In turning or
passing a corner of meeting or inter-
secting streets within Dietrict A,
tho person operating, driving or pro-
pelling any vehicle shall not proceed,
nor shall the owner of any such ve-
hicle riding thereon or therein cause
or permit the same to proceed, nor
shall any person riding or driving any
animal cause such s,nimal to proceed
at a rate of speed exceeding eight
miles an hour.
Section 5. District O. In passing a
public garage entrance or exit on the
side oY the street next the garage, or
in passing a school horse nn school
days between the hours of 8:00 a. m.
and 4:00 p. m., or in approaching a
steel, iron or wooden bridge of ten
feet span or more, the person operat
ing, driving or propelling any vehicle
or riding or driving any animal shall
not proceed at a rate of speed exceed-
ing ten miles an hour.
Section 6. District D. In entering
any street from any garage or any
private place by crossi°.g a sidewalk,
no person shall operate, drive or pro-
pel any vehicle nor shall the owner oP
any such vehicle cause or permit auoh
vehicle to cross such sidewalk at a
rate of speed exceeding four miles an
hoar.
Section 7. District E. No person
shall operate, drive or propel any ve-
hirle on any street or place not in-
cluded in Districts A. B. C. and D at
a rate of speed exceeding thirty miles
an hour.
EXCEPTIONS TO APPLICATION OF
THIS ORDINANCE.
Section 8. Nothing contained in
once as to specafio rates Dot spieed shall
apply to any of the following vehicles,
to-wit:
(a) Vehicles which run only on
rails and tracks.
(b) Vehicles, wagons, trucks and
apparatus under the control oP the
Fire Department and all the vehicles
under the control oY the Police De-
partment of the County of Hawaii,
and ambulances, publio or private,
while such vehicles are in the achxal
pm-iformance oY duty during emergen-
c'.ea.
(c) Ihily licensed pyhaiciuns shall
be exempt, in canes of emergency
only, upon complying with the con-
ditions of this Ordinance. The ve-
hicle driven by them shall display, in
at least two conspicuous places, one
in front and one in the rear oP such
vehicle, the sign of the "Red Cross,"
the same to be not less than flue
inches in height and of proportional
width, painted in red a white back-
ground.
These exemptions shall not be wn-
etrued to permit reckless driving at
any time.
CARE REQUIRED IN ALL CASES-
SPEED IN CERTAIN PLACES.
Section 9. No person shall operate,
drive or propel any vehicle nor drive
or ride any animal on any street at
a rate of speed greater than reason-
able and proper, having due regard to
the width, grade and condition of
such street, the grade of the adjoining
declivities or crossing, and the traf-
fic or occupation of such street by
others, or so as to endanger the life,
limb or property of others.
In turning corners or in going
around curves mxtside of District B
wherever the view in the direction in
which the vehicle is proceeding shall
be obstructed for any reason so that
an approaching vehicle may not he
plainly assn approaching at such
curves, Lhe speed shall be reduced to
such a rate as will tend to avoid dan-
ger of accident. In no case, however,
shall the speed exceed fifteen miles
an hour.
SPEED OF HEAVY VF.HICLF.S.
Section 10. No traction engine,
road engine, hauling engine, trailer,
steam roller, automobile truck for
passengers or freight, motor or other
power vehicle carrying a weight in
excess of four tons, including the
vehicle, shall be operated upon any
street at a speed greater than fifteen
miles an hour; and no such vehicle
carrying a weight in excess of Len
tons, including Lhe vehicle, shall bo
operated neon any street at a speed
greater than ten miles an hour.
TITLE.
Section 11. This Ordinance may be
designated by the brief title of "Speed
Ordinance."
V TOLATYONS-PUNISHMENT
Section 12. Any person violating
any of the provisions oY this Ordin-
ance shall be punished by a fine of
not less than Fice Dollars and not
mm-e than Five Hundred Dollars.
The Court having jurisdiction of
any charge brought. under this Ordin-
anc.c, in addition to the penalty above
set forth, may, upon the motion of the
prosecuting officer, cancel the chanf-
fenr's certificate of any person found
guilty under this Ordinance, in which
event the Court shall fix a period, not
exceeding twelve months, wherein
such person shall not be entitled to
receive a new chauffeur's certificate.
Section 13. All Ordinances and
parts of Ordinances in conflict with
the provisions of this Ordinance are
hereby repealed.
Section 14. This Ordinance shall
take effect fifteen days from and after
the date of its approval.
