ORDINANCE NO. 85
AN ORDINANCE RELATING TO
THE CONSTRUCTION OF SIDE-
WALKS, CURBS, STREETS, AVE-
NUES, ALLEYS, WATER AND
SEWER MAINS, IN ADDITIONS
AND SUBDIVISIONS OF REAL ES-
TATE WITHIN THE CITY OF
HILQ COUNTY OF HAWAII, FOIL
THE PURPOSE OF THE SALF, OF
BUILDING LOTS THEREIN BE-
FORE THE SAME ARE OFFERED
FOR SALE, AND PRESCRIBING:
THE CONDITIONS FOR SAID
CONSTRUCTION, AND PROVID-
ING PENALTIES FOR THE VIO-
LATION HEREOF.
BE IT ORDAINED BY THE PEO-
PLE OF TFIE COUNTY OF HA-
WAII:
Section 1. Any person, firm or
corporation, the ownter of, o: posses-
sed of any interest in, land, desiring+
to lay out an addition in tits city of
Hilo, County of Hawaii, or to sub-
divide land within said city for the
purpose of sale of building lots
therein, shall submit to the Board of
Supervisors a plat of the addi:ion or
subdivision desired, showing the lo-
cation of all sidewalks, curbs, streets,
avenues, alleys, water and sewer
mains therein, as desired, and their
relation to existing sidewalks, curbs,
stneets, avenues, alleys, water and
sewer mains, over adjacent lands,
together with written or printed spe-
cifications of the materials and the
proposed kind and method of con-
struction to be used in the construc-
tion of said sidewalks, curbs, st*°ets,
avenues, alleys, water and sewer
mains, in said 2ddition or subdiv'_
sloe. Said plat shall have all di-
mensions of sidewalks, curbs, streets,
avenues, alleys, water and sev/er
mains, and lots plainly marked
thereon.
The Board of Supervise ~ may, if
they deem it fox the convenienoe oP
the inhabitants of the said city and
the public, g:-ant to such person, firm
or corporation, by resolution, the
right to lay out such addition or
subdivision according to said pro-
posed specifications oY materials,
method and kind of construction of
the proposed sidewalks, curbs,
streets, avenues, alleys, water and
sewer mains, in said addition or sub-
division, o: may modify said plat and
said specifications in such manner as
to them may be deemed best for the
public interest.
Section 2. After the approval of
said plat and said specifications as
submitted or modified, and before it
shall be lawful to dispose of or offer
for sale any lots or tract of land in
said addition or subdivision, such
person, firm or corporation shall
cause the sidewalks, curbs, streets,
alleys, water and sewer mains, as
they appear on the approved plat of
said addition or subdivision to be ac-
curately surveyed and all street lines
marked on the ground by monu-
ments set firmly in the ground and
protected by cast iron monument
frames and covers, and, shall lay and
construct in accordance with the
specifications approved by said
Board of Supervisors all sidewalks,
curbs, streets, avenues, alleys, water
and sewer mains, set forth in said
plat as approved by the Board of Sa-
pervisors.

shall he properly co-ordinated to
Government Survey Triangulation
Stations and the true azimuths and
distances betwe^n them marked on
said plat. Said plat shall be filed ii:
the office of the City Engineer.
Section 3. It shall be unlawful for
any Person, firm o: corporation to
lay out an addition or subdivision iu
the City of Halo, or subdivide any
tract of land within said City of
Hilo, for the purpose of the sale cY
building lots therein, withoat com-
plying with the Provisions of this
ordinance.
Section 4. It shall be unlawful
for any owner or ether Person to se'_t
or offer for sal? or contract for the
sale of aay lot or tract of l~snd in
any addition or subdivision in the
City of Hilo hereafter platted, which
shall not be laid out, platted, and all
sidewalks, curbs, streets, avenues,
alleys, water and sewer mains, con-
structed in conformity with the pro-
visions of this ordinance, and of the
Resolution of the Board of SePer-
visors permitting the addition or
subdivision.
Section 5. The Beard of Super-
visors of the City of Hilo shall not
take over, receive by dedication, or
otherwise, or do any repair or con-
struction work upon or in any way
accept as pnhlic highways any
streets, avenues, alloys, water and
sews!' mains, in any addition or sub-
division hereafter opened or platted
in the City of Hilo, esoept upon a
compliance with the previsions of
this Ordinance and of th= Resolution
of the Board of 6upmā¢visms permitt-
ing Uhe addition ar subdivision.
Provided, however, That the grant
to any person, firm or corporation,
by resolution, oP the right to lay oui
such addition or subdivision accord-
ing to said plat and said sp~eciflca-
tions, as submitted or amended, shall
not be construed to operate as an
accep'ance or adoption of such
sidewalks. curbs, streets, avenues, al-
leys,.water and sewer mains, by the
Board of Supervisors.
Section 6. Any person, firm or
corporation who shall violate any of
tha provisions of this Ordinanoe
shall be deemed guilty of a msde-
meanor, and, upon conviction there-
of, shall be punished by a fine of
not less than Twenty-five Dollars
($25.00) nor more than Five Hun-
dred Dollars ($500.00).
Section 7. The words, "City of
Hilo" as used in this Ordinance shall
include all of that portion cf the
County of Hawaii which is included
in the Geographical Limits of Hilo
as provided by law.
Section 8. This Ord'.nance shall
take effect from and after the date
of its approval.
