HomeMy WebLinkAboutORD 1920-087County of Hawaii, Territory of Hawaii ORDINANCE NO. 87 AN ORDINANCE REGULATING MOVING TRAVEL AND TRAFFIC UPON STREETS AND OTHER PUBLIC PLACES IN THE COUN- TY OF HAWAII AND PROVID- ING PENALTIES AND REMEDIES FOR VIOLATIONS THEREOF AND REPEALING ORDINANCE NO. 62. Be It Ordained by the Board of Supervisors of the Comity of Ha- waii: CHAPTER I DEFINITIONS SECTION 1. The following terms whenever used herein, except as otherwise speci- fically indicated, shall be defined to have and shall be held to include each of the meanings hereinbelow respectively set forth, and any such terms used in the singular number shall he held to include the plural. STREET shall mean and taken to be every avenue, boulevard, high- way, roadway, lane, alley, strip, palh, scnore and place used by or laid out for the use of both vebicle and pedestrian in the County of Ha- waii. CURB. The ,ateral boundaries of that portion of a street, designed or Intended for the use of both vehicles and pedestrian whether marked by curbing constructed of stone, cement, conmrete or other material. SIDEWALK shall mean and taken to be every path, strip, square or place laid out for the sole use of pedestrians in the County of Hawaii. VEHICLE shall mean and taken to be, every wagon, hack, coach, car- riago, omnibus, pushcart. bicycle, tricycle, motorcycle, automobile, or any kind of conveyance, except baby carriages and children's play wagons, in whatever manner or by whatever force or power the same may be used for or adapted to pleasure riding or transportation of passeego'rs, bag- gage, merchandise, or freight upon any street; and every draft or riding -animal, whether ridden, driven, or lead, excepting that an animal or animals attached to any vehicle shall with such vehicle constitute one vehicle, provided, however, that nothing herein contained shall be construed to effect in any way the operation of railroads upon any street, which said railroads are ex- pressly exempted from the provisions of this Ordinance. MOVING TRAVEL AND TRAF- FIC. For the purpose of this Ordin- ance, the term "Moving Travel and Traffic" is intended to include ve- hicies in actual motion and also those which may be at rest upon the streets. MOTOR CARS. For the purpose of this Ordinance the words "Motor Car" shall apply to and include all vehicles propelled by any power, other than muscular power, excepting such as run upon rails, and further excepting traction engines and road rollers. GARAGE. A garage is a building used for the housing, storing or re- pairing of motor cars. MOTORCYCLES shall mean and taken to be every self-propelled ve- hicle having two or three wheels. RENT CARS. Rent cars shall mean and taken to be every vehicle operated under a license to carry passengers or freight and baggage, for hire. CONGESTED DISTRICT Defined. The Congested Traffic District shall be as follows: AB that section of «amehameha Avenue between Shipman Street and Kekaulike Street, and all of Keli like Street between Kamehameha Avenue and Kilohana Street; all of that section of Waianuenuo Street between Kamehameha Avenue and Kinoole Street; all that section of Keawe Street from the lower Wai- luku Bridge to Mooheau Street; all that section of Mooheau Street from Keawe Street to Kamebamha Av- nue; all of that section of Hail] Street from Keawe to Kamehameha Avenue; all that section of Kala- ka.na Street from Keawe to Kameha- meha Avenue. PARKING STRIP. Parking Strip shall mean and taken to be all the macadam center portion of Kameha- meha Avenue between Shipman Street and the center lamp -Post on Ka.mehamehz, Avenue opposite the Volcano Garage. STREET INTERSECTION. Street intersection shall mean and taken to be the side lines of intersecting streets, and not the center lines of such streets. CHAPTER H RULES COVERING TRAFFIC SECTION 1.—DUTY. CAREFUL DRIVING. Every person riding, driving or in charge of any vehicle upon any of the streets, shall ride, drive or propel such vehicle upon any street in a careful manner and with due regard for the safety and convenience of pedestrians and ve- hicles on such streets. Such person shall travel on the right side of the center of such streets in the direction he is traveling and as near the right hand edge of such street as possible, excepting when the right side of such street is obstructed by teams, build- ings or other material, or when such street is closed for repairs; in such cases such person shall travel as far away from the left edge of such street as pessible so as to allow other vehicles to freely pass, and further excepting when such car shall be traveling on streets that have two wheel tracks or well 'beaten Paths for vehicles; in such cases, such person shall upon meeting any other vehicle traveling in the op- posite direction, turn to the right a.nd surrender the left one-half there- of to such vehicle; and whenever two vehiclos traveling in opposite directions on streets that have but two wheel tracks meet at a point on such street where it is impossible to pass one, another, then, if the street at such a point be on the in- cline, the vehicle climbing up the :..,., .. ..,u.,. . ,....... ....... ,... ,_i...,.«. ,.�5.. .. e. Incline shall give way to the other vehicle and back up to some point on the street where passage may be made with safety; and if the road ac such point shall be level, the vehicle having the nearest point on the road back of it, where passage call be made with safety, shall give way to the ther vehicle and back up to such point and allow the other vehicle to pass. No person or persons shall un- reasonably obstruct or impede the right of travel of any other vehicle. SECTION 2.—RULES OF PASS- ING', Ell fCLF.S. Every person driv- ing or operating any automobile, motorcycle, bicycle or any other ve- hicle, or riding any animal, upon any street, in overtaking any other ve- hiele, shall pass to the left of such vehicle or animal, and the person in charge of such vehicle or animal bo- Ing so overtaken 4liall, give wav to the extreme right to allow such over- taking vehicle or animal to pass with safety as so)n as practicable and with all conven.ent sp^sed upon a sig- ncl given by the overtaking p^rson. If necessary, on scream, of road con- ditbns, such overbIIra person shall stop for a suffmienc length of tine to o;ow such over Liking vehicle to Pass. SECTION o.—SLOWLY MOVING VEHICLE. Every person riding, driving, propelling or in charge of any vehicle moving slowly upon any street shall keep such vehicle as close as possible to the curb on the right, allowing more swiftly moving vehicles free passage on the left. SECTION 4.—RULE FOR VEHI- CLE: CHANGING COURSE OR STOPPING. Every person riding, driving, propelling or in charge of any vehicle upon any street, first, be- fore stepping or changing the course of such vehicle, shall give a visible sfi�n of his intention to make such change as follows: 1. When turning to the right, ex- tend his arm upwards from`the car as far out as practicable at an angle of 45 degrees. 2. When turning to the left, ex- tend his arm out front the car as far as practicable at right angles—and 3. When stopping or backing up, extend his arm as far out from the car as practicable downwards at an angle of 45 degrees. SECTION 5.—RULE ON TURN- ING CORNERS TO RIGHT. Every person riding, driving, propelling or in charge of any vehicle upon any street shall, in turning to the right into another street, turn the corner Lis near the right hand curb as pos- sible. SECTION 6—RULE ON TURN- ING CORNERS TO LEFT. Every person riding, driving, propelling or in charge of any vehicle upon any street shall, in turning to the left in- to another street, pass to the right of and beyond the center of the street intersection before turning. SECTION 7.—RULE ON CROSS- ING FROM ONE SIDE OF STREET TO ANOTHER. Every person rid- ing, driving, propelling or in charge of any vehicle crossing from one side of any street to the other side there- of shall make such crossing by turn- ing to the left to the opposite side of the street so as to head in the same direction as the traffic on that side of the street. In the Congested Traffic District such turn shall be, )Wade at street intersections or at such other points as may ba established by the Board of Supervisors for such purposes and designated as such. Streets joining but not intersecting, shall, for the purpose of this Ordinance, be con- strued to constitute an intersection. SECTION 8—TRAVELING IN WAKE OF VEHICLE. It sball be unlawful for any person operating or driving any vehicle on any street to travel so closely in the wake of any vehicle in such manner as to imperil life or limb, or to travel so closely in the wake of such preced- ing vehicle as not to give such fol- lowing vehicle ample room in which to stop or turn out in case such pro - ceding vehicle comes to a sudden stop. SECTION 9.—RIGHT OF WAY OF AMBULANCE AND OTHER GOV- ERNMENT VEHICLES. The officers and firemen of the Fire Department and their apparatus of all kinds, when going to, or on duty at, or re- turning from any fire, and all ani - balances, whether of a public or priv- ate character, and all other vehicles when employed in carrying sick or injured persons to hospitals or other places for relief or treatment; doctors automobiles when the same is occupied by a doctor and respond- ing to an emergency call, and the of- ficers and policemen and vehicles of the Police Department shall have the right-of-way over all vehicles or per- sons on any street, and through any procession, except over vehicles car- rying the United States mail; and when the Fire Department or Pol`.ce Department is responding to an alarm all vehicles shall come to a standstill along the right curb in the direction being traveled by such ve- hicles/mitil the vehicles of the Fire Department or Police Department shall have passed, and no vehicle shall stop on any street intersection excepting close to the curb and far enough away from such street inter- section to allow the vehicles of the Fire Department or Police Depart- ment to a safely turn. Every fire, police department, am- bulance and doctor's vehicle shall be plainly marked to designate its character, and shall be provided with a distinguishing sound signal de- vice. Until so designated such vehi- cle shall not be given the right-of- way as aforesaid. Every ambulance or private ve- hicle used for carrying the sick or injured shall not have the right-of- way as described, unless the driver or the person in control thereof shall cause to be sounded continuously while claiming such right-of-way, some adequate sounding device as a warning of the emergency character of its business. SECTION 10.—RULE ON STOP- PING AT CURB. No person riding, driving, propelling or in charge of any vehicle shall stop the same upon any street with the left side of such vehicle toward or along the curb. SECTION 11.—SIGNAL TO STOP. Every person operating or driving any automobile, motorcycle or any other kind of motor car on or along any street, upon a signal given by putting up a hand or other signal of distress made by a person rid'ng or driving a horse or horses which are frightened, shall cause such vehicle to stop unless a movement forward is necessary to avoid accident or in- jury and upon request shall stop all motor power until such animal or animals are under control or the danger is passed; and, if requested, shall assist such person or persons to pass such vehicle in safety. No person or persons shall give such signal or sign of danger or dis- tress or call for assistance upon any person operating any such vehicle on a street without reasonable cause for so doing. SPCTTON 12—RULF1 ON STOP- PING IN ROAD WAY. No person riding, driving, operat- ing, or in charge of any vehicle on any other portion of the Congested District, shall park such vehicle, nor shall such person stop and stand such vehicle along the side of the curb within said Congested District for more than 15 minutes, except while actually engaged in loading_ and unloading freight. Every person driving, riding, ope,atring, or in charge of any ve- hicle outside of the Congested Dis- tr:rt a.nd within tile, City limits, shall, f" bringing such vehicle to a stand- still, stop and stand such vehicle on the richt side of the such street fac- ing marks, on all streets running to- ward the m,utain and sea, or fao- ing towards Pun,' on all streets run - rin' towards Iianrakun and Puna; excepting, however, when taking on or letting off passengers or loading and nrilnadieg, baggage, or freight. In such case the front or real- wheels earwheels of such vehicle shall be, thrown in towards the curl, in each a manner as to prevent such vehicle from r"nnlng down the grade if the brakes should be released. All automobiles left standing shall hnve brzoces set, and on all automo- biles requiring Clanking from the street the brakes shall remain set un- til the engin, is started. ShICTTON 16—BRAKES Every antomobile, motorcycle nr any other kind of motor car, while being used anon any street, shall be provided vilh efficient brakos which shall be kept in gnOd working order. All brakes shall be of sufficient power to bring such vehicle, when traveling at a rate of speed of ten miles an hour over a dry level ma- cadam road, to a full stop within ten feet from point of application of the brakes. Every operator, driver or owner ,f such vehicle, when re- quested by the Sheriff, his deputies, any police officer, or any Examiner of Chauffeurs, shall submit such ve- hicle to a brake test. Every motor vehicle shall be equipped with a steering device in good working order. Such device shall be subject to test in the same manner as provided in paragraph 2 of this section. SECTNION 17 — GARAGE EXIT. Whenever any garage has a passage way connecting it with any street of such construction that there is an ob- structed view from such street of any vehicle emerging from such garage, such garage shall have a sign ex- tending across the sidewalk in front of such garage, in close proximity to such passage wap, containing the words "GARAGE EXIT" in conspic- uous letters, notless than six inches in height, which sign shall be visible to all parties approaching such en- trance from either side at all times. Such sign shall be lighted by a red light during all hours of darkness. SECTION 18 -- BREAKING AN- IMALS FORBIDDEN. It shall be unlawful for any person to drive upon any street any unduly danger- ous or partially "broken" animals, or to nee any street for the purpose of "breaking" animals, it being the intention of this section to define the words "broken" and "breaking" as the act of accustoming animals to saddle and harness for the purposes of subjection. This section shall apply to the City of ITilo only. SECTION 10 LEADTNG AN- IMALS OR VEHICLES. It shall be unlawful to lead any animal behind any vehicle, which, by reason of its Lot) or otherwise obstructs a plain view of said animal to those ap- proaching from the opposite direc- tion, or to tow more than one other vehicle or trailer, provided, permis- sion bo granted by the Chairman and l:xeculive Officer of the Board of Supervisors, County of Hawaii, or by some person by him authorized to grant such permission; and no tow connection shall be more than six- teen feet in length. SECTION 20—NUISANCES, AN- NOYING SMOKE. It shall be unlaw- ful for any person operating any motor czar upon any street, to permit the motor of the same to operate in such a. manner as to visibly emit a great amount of steam, smoke or products of combustion from exhaust pipe or other opening, except while starting the motor, nor shall such person race the motor of such motor car nor leave such motor car stand- ing with the motor thereof running without any duly licensed operator in charge of such vehicle, nor make unnecessary noise, nor allow such motor car to be repaired On the streets, except in cast, of emergency. One of the purposes of this paragraph is to prevent the repairing of or the loaving of automobiles for repair on the public streets by garages. No person riding a bicycle shall hold onto any other vehicle while in motion. No vehicle shall be driven over any curb or across any park, along and upon any sidewalk or across any sidewalk, except at an alley or private entrance for vehicles. This section shall apply to the City of Hilo only. It shall be unlawful for soy person operating any motor ear within any city, town, or village, or within 500 feet of a school, courthouse, church, or hospital, to permit the pipes, mufflers or other device thereof to emit the sounds of exhaust in a loud and annoying manner. No person shall ride or jump upon any vehicle without the consent of the operalor, or driver, or person in control thereof. No vehicle or pedestrian shall pass through a funeral procession; and no vehicle or pedestrian shall pass through a procession authorized by the sheriff or his deputies, without the permission of a police officer. Any person operating any vehicle on any street upon approaching a railroad crossing shall heed the sig- nals given by any person or device for that purpose, of approaching trains and stop until such trains have passed. SECTION 21—DRIVING OR RID- ING BY CERTAIN PERSONS PRO- HIBITED. No person under the age of sixteen years, whether accom- panied by a duly licensed chauffeur or not, shall operate or drive any motor car along or upon any street or in any public place. This provi- sion shall not apply, however, to any person under the age of sixteen years who may hold a chauffeur's certi- ficate. No person shall learn or teach another to operate any motor car on the streets within that portion of the City of Hilo bounded on the north by the Mahiulu Stream; on the south by a s.raight line from Mahi- ulu Stream to Ponahawai Street run- ning through the South Hilo Jail at right angles to said Ponahawai Street, thence by a straight line from the intersection thereof with the line from said Mahiulu Stream to Waialrea Mill; theucc by a straight line from said Waiakea Mill to the Shops of the Matson Navigation Company at Reed's Bay; thence by the shore line from the said shops to the mouth of said Mahiulu Stream. It shall be unlawful for any per- son in control of any animal -drawn vehicle, or riding any animal, to pro- ceod upen any street or public place, without having or keeping conscious cenUol of such animal by means of proper reins or harness. No person of tender years obvious- ly unfit for the control of any animal shall drive or ride such animal along any street or public place, or be per- mitled to drive or ride such animal in such street or public place. No person while under the influ- ence of intoxicating liquor or any other intoxicating beverage, shall upeate or drive any vehicle along or upon any street or in any public place. Proof that a person accused of having operated or driven any ve- hicle while intoxicated partook of intoxicating liquor within one hour before the alleged offense shall con- stitute prima facia proof of intoxi- cation and such person shall be pro- sumed to have been intoxicated until such prima facia proof shall have been rebutted by sufficient evidence to the contrary. SECTION 22—LIGHTS. From 30 minutes after sunset until 30 minutes before sunrise, there shall be dis- W played on the front of every motor car, while being operated or driven along or at rest upon any street, at least two lamps of equal candlepower, which lamps shall be equipped with some dimming device approved by the Sheriff or his Deputy, one on each side, giving a reasonably bright light in the direction in which such motor car is facing or going, and so placed as to reflect upon the road in the direction in which it is facing or proceeding, providing a light suffi- cient to reveal any person, vehicle or substantial object on the street straight ahead of such motor car for a distance of at least 160 feet, and there shall be displayed on the left side of the rear of every such motor car, one tail light, which shall display a red light visible not less than 200 feet from the rear, and which shall display a white light reflecling upon the registration num- ber of such car in such a manner as to make such number plainly visible and legible at a distance of not less than 60 feet from the rear during the hours specified. SPOTLIGHTS --No spot light shall be, used in the City of Hilo and no spotlight shall be so used as to shine in the eyes of the driver of approach- ing passing vehicles, and when used every spotlight must be turned off at a distance from an approaching vehicle sufficient to enable such ap- proaching vehicle/to proceed and pass without stopping and with safety. MOTORCYCLES—The foregoing shall apply to bicycle and motor- cycles, except that no tail light, and only one head light, shall be re- quired. OTHER VEHICLES—Every an- imal -drawn vehicle shall display two lights, one on each side thereof, showing a white light visible within a reasonable distance in the direction towards which such vehicle is pro- ceeding. Such vehicle shall also dis- play one tail light set on the left side, which tail light shall be a red light. OFFICER'S POWERS—Police Of- ficers, at steamer landings, street intersections, railroad depots, thea- ters, places of, general resort, at all places of public gathering or assem- bly, and also along routes of pro- cessions, shall have full control of the movement or placing of all ve- hicles and pedestrians. Such Police Officers shall signal by wave of the arm, cane, or other instrument, the direction in which vehicles shall move or where and how standing vehicles shall be placed. Whenever there is a Police Officer in charge of any such place, the operator or driver of a vehicle or pedestrian shall indicate the direc- tion in which he wishes to travel and shall not proceed until ordered so to do by such Police Officer. CHAPTER III. HEAVY VEHICLES SECTION 1—USE OF FLANGES, ETC., ON WHEELS RESTRICTED. No traction engine, road engine, hauling engine, trailer, steam roller, automobile truck, motor or other power vehicle shall be operated upon or over any street the tires of which are wound with chains or the face of the tires of which are fitted with flanges, ribs, clamps, lugs, or spikes, other than rubber or wooden blocks. This regulation applies to all rings or flanges upon guiding or steering wheels on such vehicle. In case of traction engines and steam plows which are equipped or provided with flanges, ribs, clamps, rings or lugs, such vehicles shall be permitted to pass over said streets provided per- mission be granted by the Chairman and Executive Officer of the Board of Supervisors, County of Hawaii, or by some person by him authorized to grant such permission; or that cleats are fastened upon all the wheels of such vehicles, not less than 2% inches wide and not more than 11h inches high, so placed that not less than two cleats on each wheel shall touch the ground at all times, and that the weight shall be the same on all parts of said cleats. SECTION 2—WEIGHT OF VE- HICLES RESTRICTED. No trac- tion engine, trailer, steam roller, automobile truck, motor or other power vehicle shall be operated upon or over any street, nor shall any object be moved over or upon any Buell street upon wheels, rollers or otherwise in excess of a total of 16 tons, including the vehicle, object or contrivance and load without first obtaining the permission of the. Chairman and Executive Officer as hereinafter provided. No weight to excess of 8 tons shall be carried on any one axle of such vehicle. SECTION 3—LIMIT OF WEIGHT DEFINED. The tire. of each wheel of any motor or other power vehicle other than those described in the Prior section shall be smooth, and the weight of such vehicle, including load, shall not exceed 800 pounds upon an inch in width of the tire, wheel, roller or other object, and any weight in excess of 800 pounds upon an inch in tire is prohibited unless permission is obtained from the Chairman and Executive Officer as hereinafter provided. SECTION 4—WIDTH OF VE- HICLES RESTRICTED. No motor or other power vehicle shall be. omr- ated upon any street of a greater width than 90 inches, except traction engines, which may have a width of 120 inches. SECTION 6PERMISSION TO OPERATE CERTAIN HEAVY VE- HICLES. The Chairman and Execu- tive Officer of the Board of Super- visors, in and for the County of Be - wait, may grant permission for the moving of heavy vehicles, loads, objects or structures in excess of a total weight of 16 tons over any street, upon proper application in writing being made therefor; pro- vided, however. that the said Chair- man and Executive Officer may re- quire a sufficient bond to protect the County from any loss or damage by reason of such operations. SECTION 6—IMPROPER USE OF STREETS BY HEAVY VE- HICLES PROHIBITED. It shall be unlawful to operate, drive, haul or use in any street or public place any vehicle of such weight or construc- tion or in such a manner that the edges of the tires of such vehicle shall cut into the road -bed and cause ruts therein by reason of being operated on the crown of the road without sufficient bearing surface to sustain the load of such vehicle. SECTION 7. The owner, driver, operator or mover of any heavy vehicle, using any street or public place, shall be responsible to the County for all damage which said street or place may sustain as a re- sult of a violation of any of the provisions of this Ordinance. CHAPTER IV SECTION 1 — VIOLATIONS — PUNISHME.NT. Any person violat- ing any of the provisions of this Ordinance shall be punished by a fine of not less than five dollars and not more than five hundred dollars. The. Court having jurisdiction of any charge brought under this Or- dinance, in addition to the penalty above set forth, may, upon the mo- tion of the prosecuting officer, cancel the Chauffeur's 'Certificate of any person found guilty under this Or- din:mce,..in which event the Court shall fix a period, not exceeding twelve months, wherein such person shall not beentitled to receive a new Chauffeur's Certificate. SECTION 2. All Ordinances and parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed. SECTION 3.
