Ordinance No. 92
AN ORDNANCE RELATING TO
7'HE WATER AND SEWER UE-
PAHTMENTS OF THE COUNTY
ON` HAWAII.
Be it ordained by the Board of Sup-
ervisors in and for the County of Ha-
waii:
SECTION 1. Appointment oY Sup-
erintendents oT Water Works. The
Chairman and Executive Officer of
the County of Hawaii shall appoint a
Superiniendent of ~i'ater Works for
each and every District within the
County, where Water Arorks Depart-
ment are or hereafter may be estab-
lished, and said appointment shall be
submitted to the Board of Supervis-
ors for approval.
SECTION 2. Regulation oL Rates. The
Superintendent of each Water Works
Department may from time to dme
with the approval of the Board of Su-
pervisors of the County oY Ha-
waii, rsgulate the rates t0 be p~iid
for water or sewer privileges, and when-
aver such rates shall be changed, no-

that in the City oY Milo, if the change

Hawaiian and English languages in
two or more newspaper; puhliehed in
the city of Hilo; and he may publish

he may deem advisable.
SECTION 3. Pay of Superinten-
dents. Tho Superintendent of each
Water Works Department shall re-
s;ive such salary as may be fixed by
the Board OP 9uperyls0l's.
SECTION 4. Bonds of Superin-
tendents. Each Superintendent of
Water Works steal] furnish to
the County of Hawaii a bond for
the faithful accounting of al] moneys
received and the faithful performance
of his duties as snrh superintendent:
and the amount of bonds shall be as
follows:-
Sttperintendent oY Water Works and
Sewers, City of Hilo, $3,000.00, and
all other Superintendents, $1,000.00

SF, C,TION 5. Applications for wa4
er or newer connoctione. All applica-
tions for mater suPPly or for sewer
connection shall be in writing, and
signed by tbo applicant. Such applica-
tion shall be mx printed form supplied
by the Superintendent of Water Works,
and shall contain a statement of the
terms and conditions upon which
water and sewer may be used. If per-
mission shall be granted, the applicant
shall be furnisher) with a duplicate
form n[ appliaati nn, and be entitled to
wits or :ewer privilege as epecifled
in such ,a ppliration.
SECTION 6. Rates payable semi-
annually. All water and sewer rates
shall be payable semi-annually in ad-
vance on the first day of January and
the first day of July in oath year at
the office of the County Treasurer.
SECTION 7. Notice to pay water
and sewer rates. The Superinten-
dent of Water Works oY the City of
Hilo, shall at least ten days be~tore
such water or sewer rates become
payable, notify all persona then
holding water and sewer privileges
u.a aforesaid, by mailing each a notice,
and also by advertisement in one or
more newspapers published In the
Englis}r and Hawaiian languages that
such rates are payable o^ the first
day oP Jauuary and July, next follow-
ing such notice; and in other districts
the Superintendent shall mail written
notices to persons holding water pri-
vileges xt least fifteen (15) days be-
fore water rates become payable.
SF.CTIOPS 8. Penalty for non-pay-
ment of water or sewer rates. If any
water or sewer rates remain unpaid fif-
teen (15) rlnys after [he same becomes
due a.nd payable, it shall become de-

which will be collected as part of such
rate. In all cases in which water or
sewer rates have become delinquent,
the Superintendent may canes the

on again until Che rates from such
privilege a.nd all penalties and ex-
penees have been paid.
SECTION 9. Penalty for ecnnect-
ing water and sewer connections with-
out permission. Any person or persona,
firm or corporation, oonuecting any
water or sewer pipe with the govern-
ment water or sewer pipes without
permission shall be guilty oP a mis-
demeanor and upon conviction there-
of shall be punished by a fine not ex-
ceeding One Hundred ($100.00) Dol-
lars, in the discretion of the Court.
SECTION 10. Penalty for trea-
passiug on water sources or reserva-
tions. Any person trespassing upon
any Water anllreea, shed Or reserva-
tion without permission from the Su-
perintendent o£ Water Works shall
be guilty of a misdemeanor and
upon conviction thereot :;hall be pun-
ished by a fine not exceeding Five
Hundred ($500.00) Dollars in the dis-
cretion of the court.
SECTION 11. This Ordinance shall
take e8ect from and after the date
of its approval,
