BE IT ORDAINEll BY THE BOARD OF SUPERVISORS OF THE COUNTY OF HAWAII: PART I-DEFINITIONS SECTION 1.-The following terms whenever used herein, except as otherwise specifically indicated, shall be defined to be and shall he held to include each of the mean- ings herein respectively set forth, and any snob terms used in the singular shall be hold to include the plural. (a) "STREET"-e h a 11 include every avenue, boulevard, highway, roadway, lane, alley, parkway, drive- way, strip, path, square and place used by or laid out for the use of vehicles within the County of Ha- waii. (b) "CURB"-shall include the lateral boundaries of that portion of a street designed or intended for the use of vehicles with marked curbing constructed of lumber, stone, cement, concrete, or other material, or not an marked. (c) "STREET INTERSECTION" -Street intersection shall mean and taken to be any street which joins another at an angle whether or not it crosses the other. (d) "VEHICLES"-Shall mean and taken to be every wagon, hack, coach, carriage, omnibus, push car[, bicycle, tricycle, automobile, or any kind of conveyance, except baby carriage and children's play wagon, in whatever means or by whatever force of Bower the same may be used for or adapted to pleasure rid ing or transportation of passengers, baggage, merchandise, or freight upon any street; and every draft or riding animal, whether ridden, driven or lead, excepting that au anima] or animals attached to any vehiole shall with such vehicle con- stitute one vehicle, provided, how- ever, that nothing herein contained shall be construed to effect in any way the operation of railroad upon any street, which said railroad are expressively exempt from the pro- visions of this ordinance. (e) "MOVING TRAVEL AND TRAFFIC"-for the purpose of this Ordinance the term "MOVING, TRAVEL AND TRAFFIC" is in- tended to include vehicle 1n actual motion and also those which may be at rest upon any street. (f) "MOTOR CAR"-Eor the pur- pose of this ordinance the words "MOTOR CAR" shall apply to and include all vehicles propelled by any power other than muscular power, excepting such ae run upon rails, and further excepting trac- tion engines and road rollers. (g) °GARAGE"s h a I1 mean every place where motor care are received for housing, storage or re- pair for compensation. - (h) "MOTORCYCLE"-for the purpose of this ordinance the word "MOTORCYCLE" shall include all motor vehicles designed to travel on not more than three wheels in contact with the ground when oper- ated without a trailer, and weigh- ing not over 700 lbs. (i) "RENT CARS"-RenT cars shall mean and taken to be every vehicle operated under a license to carry passengers or freight, for hire. (j) "PARKING OR PARKED"- for the purpose of this ordinance the words "PARKING OR PARK- ED" shall refer to vehicles drawn np to a stop and allowed to remain standing on any street for a period of more than 10 minutes. (k) "OPERATOR"-shall mean any person who operates a motor vehicle and any person who oper- ates, rides. drives, or propels any vehicles other than a motor vehicle. (1) "PERSON"-e h a 1 ] include any corporation, firm, company, or other aggregation of individuals. (ml "SILENT OFFICER"--for the pm-poae o£ this ordinance, shall mean and refer [o lamp poets monu- ments, stnmtnrea, or other design- ating mark, placed in the center of street intersection. Ot) "TRAILER"-Trailer shall be deemed to be any vehicle which is at any time drawn upon any street by a vehicle. (nl "SHERIFF"--Sheriff as used in this ordinance shall mean the Sheriff of the County of Hawaii, firs deputy or deputies. SECTION II. "SPEED LIMITS" -The speed limits are hereby de- clared Co be as follows: DISTRICT A.-All of that section of the Uist~rict oC South Hilo de- scribed as Yellows:-Commenoing at a po tt at the mouth of Uxe Ma- hiula Streaw and running west along center line of said stream to the intersection of said stream with the west edge of Wainaku Avenue Extension thence in a straight line io the southwest corner of Rainbow Falls Park; thence running in a straight line to the intersection of the Hilo Boarding School Ditoh and the east edge of Kaumaua Road; thence rnmxing in a straight line to the 4 Mile Bridge on Kilauea Ave- nge; thence naming in a straight line to the shore end of the Hilo Breakwater; thence following the sea-coast line to the point of begin- ning; And in other towns and settle- ments in the County of Hawaii, shall mean the Territory coutignous to and the streets included be- tween eouspicuons signs placed on the right hand aide oP the street looking toward such district. DISTRICT B.-Corners of meet- ing or intereecting streete within the limits described in District A, and also all dangerous street curves. DISTRICT C.-Passing a garage entrance or exit on the aide of the street next the garage; passing a school house on school days be- tween the hours oY 7:30 A. M. and 6:00 P. M.; on approaching an iron, steel, concrete, or wodden bridge oP ten foot span or morp. DISTRICT D.N:ntm•ing streete Yrom garages or private places. DISTRICT E.-All other plaoea not included in Districts A, B. C, and D. PART II-SPEED REGULATIONS SECTION III. DISTIICT A.--No person shall operate, drive or propel any vehicle and no owner thereof riding thereon or therein shall cause or permit such vehicle to be operated, driven or propelled on any street within DiaLricl A at a rate of speed exceeding 20 miles an hem'. SECTION IV. DISTRICT B.-In turning or passing corner of meet- ing or intersecting streets within Dlatrict A, [he person operating, driving or propelling any vehicle shall not proceed, nor shall the own- er of any such vehicle, riding there- on or therein, cause or permit We same to Proceed, nor shall any per- amx riding or driving any anima] cause such aninxa] to proceed at a rate of speed exceeding 10 miles an hour. SECTION V. DISTRICT 0.-In passing a Karage entrance or exit on the aide of the street next the garage, or in passing a school home on school days between the hours of 7:30 A. M. and 5:00 P. M., or on approarlxing an iron, steel, concrete or wooden bridge of 10 ft. span or more, Uhe person operating, driving or propelling any vehicle or riding or driving any animal chat] nol. pro- ceed aL a rate of speed exceeding 15 miles an boor. SECTION V1. DISTRICT D.In entering any street from any gar- age or any private place, no person shad operate, drive or propel any vehicle at a -tits of speed exceeding 1'onr miles a_ hour. SECTION t lI. DISTRICT E.-No person shall operate, drive or pro- pel any vehicle on any street or place not included in Districts A, B, G and D at a rale of speed ex- ceedinh' 3G miles an hoar. SECT]ON VIIL-N otb ing con- tained in any oY the provisions in Seca ions 3, 4, 6, 6 and 7, Part II oY this ordinance shall apply to any of the following vehicles, to wit: (a) Vehicles which run only on rails and tracks. (bl Vehicles, wagons, trucks, and apparriis under the control of the Firs llepa.rtment and all of the vehicles under the control oY the Police Department, County oY Ha- waii and ambulances pllblic or pri- vate, while each vehicles are in the actual performance o4 duty during emergencies. (c) Dnly licensed physicians shall be extmpt, in cases of emer- gencies mrly, ..pon complying with the conditions of this ordinance. The vehicle driven by them shall display in at least two conapicuoua places, one in tlxe front and one in the rear of such vehicle, the sign oT a "green cross" the same [o be not loss than five inches in height and of proportim.al widllx painted in green, a white back ground, or an "American Medical Association" radiator emblem green cross, with the aesculapian staff and the initials' "M. ll:' same to be ^ot lees than three and one half inches in dia- meter. These exemptions shall not be cmxstrned to permit reckless driving a.. any time. SECTION IX.-NO Person shall operate, drive or propel any vehicle nor drive or ride any animal on any ;treat at :u mate of speed greater than reasonable and proper, having due regard to the width, grade and cmxdition of. such street, the grade of the adjoining declivitiee or croe- aing, and the traftlc or occapat;on of arch street by others, or so as to endanger the life, limb or prop- erty of others. In turning corners or in going around curves outside of District B, wherever the view in the direction in which the vehicle is proceeding shall 6e obstructed for any reason so that an approaching vehicle may not be plainly seen approaching at such curves, the speed shall be re- duced to such a rate as will tend to avoid danger oY accident. In no case, however, shall the speed ex- ceed fifteen miles an hour. SECTION X. _-No traction engine, road engine, hauling engine, trailer, steam roller, motor bus for passen- gers or freight, motor or other pow- er vehicle carrying a weight in ex- cess of 4 tons including the vehicle, shall be operated upon any streett at a speed greater than 16 miles an hour; and no such vehicle carrying a weight in. excess of 10 tons in- culding the vehicle, shall be oper- a.tnd upon any street at a spend greater than 10 miles an hoar. 6ECT10N XI. 9IONS-It shall be the duty of the Sheriff, his deputy or deputies, to erect or cause to be erected, maintain any cause to be mainmined, oIDcial si ns to inform the public of provisio is of Sections 3, 4, S. 6, 7, 9 and 10 hereof; and it shall be the like duty of the ShoriH, his deputy or deputies, to erect and maintain, such signs to inform the public of the contents of this ordi- nance or any other provisions of law or ordinances of similar nature; provided, however, that the absence of such signs shall not excuse any person violating the provisions of this ordinance or any other law. PART III-RULES ON PARKING SECTION XiI. PARKING ON NARROW STREETS.-On etreete the width less than 38 feet motor vehicles may be parked only on the right hand side parallel with the curb Ilne or aide of said streets, and no motor vehicle shall be park- ed parallel with any other vehicle parked in I:he same street, but shall be parked at least fifty feet away from any parked vehicle thereon. SECTION XIll. PARKING ON SIDE STREETS.-On streets the width of which ie 3S feet or more motor vehicles shall be parked only in the center of such streets and at a 45° angle to the macadam cen- ter of such etreete, provided, how- ever, tlxat on Kamehameha Street between Shipman Street and Kilo- hana Street, vehicles shall be parked at right angles to the maca- dam center of said street and pro- vided Pnrther that on Waianuenue Street between Kapiolani and Jail Streets, vehicles shall be parked only along the aides parallel with the curb or side line of said Streets. SECTION XIV. NO PARKING AT CER'PAIN POINTS-No vehicle shall be parked in front oC and con- Lignous to any Fire Department or I'o:ice Station in the County of Ha- waii. SECTION XV. SHERIFF MAY llN:S1CN ATF. O T H E R PARKING PLACES.-The Sheriff may desig- nate and select parking Dlace or places for rent service vehicle stand or stands and such other and ad- ditional parking places when neces- sary and indicate or delineate same by suitable marks, signs or other- wise; may delineate or indicate any parking apace or spaces in this ordinance mentioned when neces- sary, and designate same by suit- able signs or otherwise; sad on oc- casiona of public parade, exhibitions, entertainments. ceremonies or pub- lic emergency, the Sheriff may sus- pend the use of [he parking spaces in thin ordinance designated, pend- ing such parades, exhibitions, en- tertaimnents, ceremonies or public emergency. SECTION XVI. LIMIT ON` TIME FOR PARKING-It shall be unlaw- ful for anY Person driving, operat- ing or propelling any motor vehicle, motorcycle, bicycle, tricycle, velo- cipede or otlxer vehicle, to park any such vehicle for a period lmxger than 30 minutes in say parking place on any street in Uxe District of South Hilo between Kameha- meha and Ululani Streets; on Kea- we S'ireet between Bridge and Mo- oheau Streets; on Kamehameha Street between Shipman and Po- nohawai Streets. I'rovld~d, how- ever, that rent service motor ve- hicles shall have the use oP and may park motm• vehicles iu parking place or place on Kamehameha Street to be designated by the Sheriff, from 7 o'clock A. M. to 5 o'clock P. M. (a) It shall be unlawful Yor any person, firm or corporation to make use of say street or parking place or places for the repair and/or sale of motor Vehicles. PART IV. SECTION I. SOUND SIGNAL DEVICE-It shall be unlawful for any person to drive operate or pro- pel an automobile, motorcycle, bi- cycle, tricycle, velocipede or other similar vehicle, upon any highway without having attached to such ve- hicle shorn or other sound signal device in good working order and of proper size and character sufficient to give warning of the approach oY such vehicle. Said horn or other sound signal device shall be of such size only as may be necessary to give such warning and shall not be used to make any unnecessary noises. The use of siren or Aer- more exhaust horns, gong, bell or similar instruments Yor the pur- pose of producing any unusual, loud, or distressing or annoying sounds, except upon motor vehicles in charge of the Police and Fire Departments of the County of Ha- waii and other vehicles given spec- ial right of way by ordinance, is hereby prohibited. PART V. ' SECTION I. DUTY-CAREFUL DRIVING-Every person riding, driving or in charge of any vehicle upon any of the streets, shall ride, drive or propel each vehicle upon any street in a careftll manner and with due regard for the safety and convenienoe of pedestrians and ve- hicles on such streets. Such person shad travel on the right aide of the center of arch streets in the direct tion he is traveling and as near the right hand edge oP such street as possible, excepting when the right side of such street is obstruc- ted by motor vehicle truck, teams, buildings or any material, or when such street is closed for repairs; in such cases such person shall travel as far away from the left edge of such street as possible so as to allow other vehicles to freely pass, and further excepting when such car shall be traveling on etreete that have two wheel tracks or well beaten paths for vehicles; in such cases, such person shall upon meet- ing any other vehicle traveling in the opposite direction, turn to the right and surrender the left hand one-half thereof to each vehicle; nd whenever two vehicles traveling in opposite directions on streets that have but two wheel tracks meet at a point on such a street where it is impossible to pass one another, then, if the street at such a point be on the incline, the ve- hicle descendin6 down the incline shall give the right of way to the other vehicle and back up to some point on the street where passage may be made with safety; and if the road at such point shall be level, the vehicle having the near- est point on the road back oP it, where passage can be made with safety shall give way to the other vehicle and back up to each point and allow the other vehicle to pass. SECTION II. RULES OF PASS- ING VEHICLES AND ANIMALS BEING RIDDEN-F.very person driving or operating any automo- bile, motorcycle, bicycle or any other vehicle, or riding any animal upon any street, in overtaking any other vehicle, shall pass to the left of such vehicle or animal, and the person in charge of such vehicle or animal being so overtaken shall, give way to the extreme right to allow such overtaking vehicle or animal Yo pass with safety as soon as practicable and with all conveni- ent speed upon a signal given by the overtaking person. If necessary, on account oY road conditions, such overtaken person shall stop for a sufficient length of time to allow such overtaking vehicle to pees. SECTION III. SLOWLY MOV- ING VEHICLE-Every person rid- ing, driving, propelling or in charge of any vehicle moving slowly upon any street shall keep such vehicle as close as possible to the mtrb or side line on the right, allowing more swiftly moving vehicles free passage on the left. SECTION IV. SIGNALS ON TL`RNING OR STOPPING. (a) The driver of any vehicle upon a public highway before starting, turning or stopping such vehicle shall first see that such movement can be made in safety, and if it cttnnot be made in safety, shall wait ^ntB it can be made in safety; then, if the opera- timt oC any other vehicle rosy rea- sonably be affected by such move- ment, the driver shall give a signal plainly visible to the driver of such other vehicle of the intention to make such movement. Such signal shall be given either by the use of Lhe hand an arm in the manner hereinafter provided, or by means of a mechanical or electrical device which meets the requirements hereinafter set forth and which has been approved by the Sheriff, Deputy Sheriff or Examiner oY Chauffeurs as hereinafter provided. Whenever the signal is given by means of the hand and arm, U:e driver shall indicate his intention to turn to the left by extending his hand and arm horizontally from and beyond We left side of the ve- hicle; his intention to tarn to the right by extending his hand and arm upward and beyond the left aide of the vehicle, and his inten- tion to stop or suddenly decrease speed by extending hie hand and arm downward from and extending beymtd the left side of the vehicle. The signal herein required to he given before turnhtg to the right or left, whether given by means of hand and arm or by means of an approved mechanical or electrical device, shall bo 6~iven continuously during the ]set fifty (60) feet or more traveled by the vehicle be- fore turning. (b) Any person may snbm~t a mechanical or electrical signal de- vice to rho Sheriff, Deputy Sheriff or Examiner of Chauffeurs of the Coun- ty of Hawaii i'or inspection and ap- proval. No signal device shall be approved nnles-s such signet device when used upon a vehicle shall give a stop signal plainly visible daring the time specified in section 23 of Lhis ordinance, for a distance of at least ono hundred (1001 feet to the rear of such vehicle or any device intended to give a signal that the vehicle which it is used is about Co turn, unless such device, when used upon a vehicle, clearly indicates the direction in which such vehicle is to he turned; which signal shall be plainly visible and so placed, that the operator or driver of the vehicle upon which the same is need, moat see the de- vice; also, the operators or drivers of the vehicles approaching Yrom the front and rear must see the signal. (c) Any vehicle which is so con- structed or carries a load in such manner as to prevent the hand and arm signal specified in subdivision (a) oY this section from being vis- ible shall be equipped with an ap- proved mechanical or electrical sig- nal device which shall fulfill the requirements of this section with reference thereto. When giving a signal to a traffic officer Umt the person desires tq ptroceed and/or go straight ahead, the full arm shall be used, extend- ing it as near as practicable straight ahead; when signalling to tarn so as to travel in an opposite direc- tion the full arm signal as herein before specified for turning shall be used, and in addition thereto Lhe hand shall indicate a circle. RULE OF TURN- ING CORNERS TO RIGHT-Every pm•son riding, driving, propelling or iu charge of any vehicle upon any street shall, in turning to th,~ right into another sLreat, turn the corner as near the right hand curb as possible. SECTION VI. RULE OF TURN- 1NG CORNERS TO LEFT--Every persmt, riding, driving, operating, propelling m• in charge of any ve- hicle upon any highway, shall, in tm-ning to the left into another highway, pass to the right of and beyond the center lamp post and/ or other designating mark of the highway intersection. SECTION VII. SECTION X RIGHT OF WAY OF AMBULANCE AND OTHER GOVERNMENT VEHICLES-T h e officers and firemen of the Fire lle- partment and Htoir apparatus of all kinds, when going to, or on duty at, and all ambulances, whether of a public or private character, and all other vehicles when employed in carrying sick or injured persona to hospitals or other places for re]ieY or treatment; doctor's automobiles when the same is occupied by a dOCLOr and responding Wan emer- gency call, and the officers and po- ]icemen and vehicles of the Pollee Uepartmextt shall have the right oP way over all vehicles or persons on any street and through any pro- cession, excep', over vehicles can•y- ing the IInited States mail; and when vehicles of the Fire Depart- ment or Police Department arc re- eponding~ Lo a call, all other vehicles shall come to a standstill along the right curb in the directiot being traveled by each vehicles until the vehicles of the Fire llepartment or Police Department shall have pass- ed, and no vehicle shall atop on a,ny street intersection excepting close to the curb and twenty Teot away from such intersection to allow the vehicles of the Fire Department or Police llepartment to safely turn. Provided, however, that such ve- hicle shat] not have the right of way as herein described, when (or) axul while returning from any fire, call or emergency call after the dis- charge of their duties. (a) Every tire, police depart- ment, ambulance and doctors' ve- hicle shall he plainly marked to designate its character, and shall be provided with a distinguishing sound signal device. Until eo de- signated such vehicle shall not be given the right of wa,y as aforesaid. SECTION XI. RULE OF STOP- PING AT CURB OR STUE L1NP: No peremt riding, driving, propel- ling or ht charge of any vehicle shall stop Lhe same upmt any street with the left side of such vehicle toward or along Lhe curb or side- line. SF,CTION XiI. SIGNAL T O STOP--Every person operating or driving any automobile, motorcycle or any other kind of motor car on or almtg any 9l ree t, upon a signal given by puttinK up a hand or other signs: 04 distress made by a person ruling or driving a male, donkey, horse or horses, which are frighten- ed, shall cause such vehicle to stop unless a movement fonva,rd is nec- essvy W avoid accident or injury and upon request shall stop all mo- tor power until such anima] or ani- male are under control or the danger passed; and, if requested, shall as- sist such person or persona to pass such vehicle in safety. (a) No person or persons shall give such signal or sign of danger or distress or call for assistance upon any person operating any such vehicle on a street without reason- able cause for so doing. SECTION XIII. RULE OF STOP- PING IN ROAD ~VAY-No person riding, driving, propelling or in charge of any vehicle, shall atop the same upon any street except with each of the right wheels with- in 1 foot of the curb or aide of the street, and not less than four (4) Pent from [he rear of any vehicle parked on same curb or aide line of such street. (b) Vehicles shall not stand on any street except to let passengers on or ofY in front oY the entrance oY any pn6lic building or plane of pub- lic resort; within 20 feet of any street intersection; within 15 feet of a fire hydrant or in front of any alley or lane. (c) No person riding, driving, operating or in charge of any motor vehicle shall bring such vehicle to a stop on any street at any point other than on a parking place for more than 30 minutes, except such vehicle as shall be actually engaged in loading or unloading freight. (d) No person riding, driving, operating or in charge of any motor vehicle, shall park such vehicle nearer than 20 feet to a street in- tersection. (e) In moving any vehicle out of the parking place, on Kameha- meha Street between Shipman and Kilohana streets, the driver, oper- ator or person in charge of any such vehicle, shall cause the saxne to move forward and in the direc- tion in which the traffic on that aide of the street is moving and shall not cause the same to be back- ed out of the narking-pines, and on streets where vehicles are permit- ted to be parked at an 45° angle ae provided in section 13 PART III of this Ordinance, the driver, operator or person in charge of any vehicle shall cause the same to be backed out of Lhe parking sir ~, and in ad- dition thereto a wary mg shall be sounded by the use of a horn or other adequate device. SECTION XIV. RULF. PROHIB- ITING BACKING UP AGAINST THE CURB-No person riding, driving, propelling or in charge of any vehicle upon any street shall allow such vehicle to bo backed up to the curb or side of such street. SECTION XV. RIGHT OF WAY AT STREET INTERSECTION-At any street. interaectimr the operator or driver of any vehicle, or the rider of any animal, shall have the right of way over the operator or driver of any vehicle or the rider of any animal approaching him at sgrh in- tersection from the left, excepting only in cases in which a Police Officer shall be in actual charge of such intersection. SECTION XVI. RULE REGU- LATING VEHICLES STANDING ON GRADES OR OTHERWISE-It shall be unlawful for any person operating or driving any automo- bile, motorcycle or any kind of motor vehicle to leave such vehicle standing on grades with only the brakes set. (a) In such case the front or rear wheels of such vehicle shall be thrown in towards [he curb in such a manner as to prevent such vehicle from running down the grade if the brakes should be re- leased. (b) All vehicles ]eft standing shall have brakes set, and on all motor vehicles requiring cranking from without, the brakes shall re- main set until engine ie started. SECTION XV1I. BRAKES-Every motor vehicle, motorcycle and any oDxer vehicle, while being used upon any street, shall be provided with efficient brakes which shall be kept in good working order. fa) All brakes shall be of suf- ficient power to bring such vehicle when traveling at a rate of speed of ten miles an hour over a dry level macadam road, to a full atop within ten feet from point of appli- cation of brakes. Every operator, driver or owner of such vehicle, when requested by the Sheriff, hie Deputy, any police officer or any Examiner of Chauffeurs, shall sub- mit such vehicle to a brake test. SECTION XVIlI. STF,ERING AP- PATiATTIS-Every motor vehicle shall be equipped with a steering device in good working order. Such device shall be subject to test in the same mamrer as provided in paragraph (a) Section XVII. SECTION XIX. GARAGE EXIT- Whenever any public garage has a passage way connecting with any street of such construaCion that there is an obstructed view from such street of any vehicle emerg- ing from such public garage, such public garage shall have a sign ex- tending across the sidewalk or side- line in front of such public garage, in close proximity to such pas- sage way, containing the words "GARAGE EXIT" in conspicuous letters, not less than six inches in height, which sign shall be visible to all parties approaching such en- trance from either side at e'1 times. Such sign shall be lighted uy a red light during all hours of darkness. (a) Any and all vehicles upon approaching a street intersection Yrom any garage exit, alley, side street, lane or roadway, shall promptly come to a atop at the in- tersecting side line and within the garage exit, alley, aide street, lane or roadway, give sound signal, and clear right-of-way to pedestrian and vehicle traffic on the main street. SECTION XX. BREAKING ANI- MALS FORBIDDEN-It shall be unlawful for any person to dirve upon any street any unduly danger- ous or partially broken animal or animals or to use any street for the purpose of "breaking' animal or animals, it being the intention of this section to define the words "broken" and "breaking" as fhe act of accustoming any animal or ani- mals to saddle and/or harness for the purpose of subjection. This sec- tion shall apply to district A- SECTION XXI. LEADING ANI- MALS OR TOWING VEHICLES- It shall be unlawful to lead auy ani- ma] behind any vehicle which, by reason oC its top or otherwise ob- structs aplain view of said anima] to those approaching Prom the oppo- site direction, or to tow more than one vehicle or trailer, provided per- mission be granted by the Chair- man an(1 eXOelltlye Officer Of the Doard of Supervisors, County of Hawaii, or by some person by him am horized to g'i'ant such permis- sion; and no tow connection shall ba mm'o than sixteen feet in length. SF.C'l'ION XXII. NUISANCN:S- lt shall be unlawful fm• any person operating any motor car upon any street, to permit the motor oY the same to operate in such a manner ae to visibly emit a great amount oC steam, smoke or products of com- bustion from exhaust pipe or other opuxing, except while starting the motor, nor shall such person race the motor of such tnotor car nor leave such motor car standing with the motor thereof running without any duly licensed operator in charge oC such vehicle, nor make unneces- sary noise, nor allow such motor vehicle W be repaired in the streets or parking place, except in case oY emergency. One of Lhe purposes of this paragraph is to prevent the repairing of or leaving of motor vehicles for ropair on the public streets ox' Parking place by garages. (a) No person or persons shat] unreasmtably obstruct or impede the right of travel of any other vehicle. (b) No person riding a bicycle shall hold onto any other vehicle while is motion. (c) No vehicle shalt be driven over any curb or across any park, along and upon any sidev,-elk or across any sidewalk, except aL an alley or private entrance for ve- hicles. This section shall apply to district A. (d) Lt shall be unlawful for any person op~ratinfi any motor car within district A or within 600 fast oP a school, courthouse, church or hospital, to porxnit the pipes, muff- lers or other device thereof W emit the sotmds of exhaust in a loud and annoying maim er. (e) No person shall jump upon, alight from or ride upon the run- ning board of any vehicle while such vehicle is in motion. (f) No person shall sit or ride upon the door or doors of any ve- hicle while sneh vehicle is in mo- tion. (g) It shall be unlawful for any person operating a motor vehicle upmt any street, to have any per- son or child in hie or her lap, arm or arms, while such motor ve- hicle is in motion. (h) No vehicle or pedestrian shall pass through a funeral pro- cession authorized by the Sheriff or his Deputy, without the permis- sion of a police officer. (i) Any person operating any vehicle on any street, upon ap- proaching arailroad crossing, shall heed the signals given by any per- son or device for that purpose, of approaching locomotive, engine, train or trains and stop until each locomotive, engine, train or trains have passed. SECTION XX[II. DRIVING OR RIDING BY CERTAIN PERSONS PROHfBTTPIDNO person under the age of hfteen years, whether accompanied by a duly licensed chauffeur or not, shall operate or drive any motor car along or upon any street or in any public place. (a) No person shall teach an- other, and no person shall learn to operate any motor vehicle on any strret within district A. (b) [t shall be unlawful for any person, firm, or em'poration W allow and/or permit any unliconsed por- son to drive and/or oporate any motor vehicle without having a chauffeur's license to so drive and /or operate a motor vehicle. (c) It shall be unlawflil for any person iu control of any animal- drawn vehicle, or riding any ani- mal, to proceed upon any street or itblic place without having or keep- ing conscious control of such aati- mal by moans of proper reins or harness. (d) No person of fender years obviously unfit for the control of any anima] shall drive or ride each animal along any street or public place, or be permitted to drive or ride such animal in such street or public place. (e) No person while under the influence of intoxicating Rquor or any other intoxicating beverage, shall operate or drive any vehiclo along or upon any street or in any public place. (f) Proof that a person accused of having operated or driven any vehicle while intox'cated partook of intoxicating liquor within one hour before the alleged offense shall consGtnte prima facia proof of intoxication and such person shall be presumed to have b<eu in- Loxicaled until such prima facia proof shall have been rohutted by sufficient evhlenco Lo the contrary. S79C7 ON fiXIV. LIGHTS. (a) From thirty minutes after sunset until thirty minutes before sunrise. there shall be displa.3'ed on Lhe front of every motor vehicle or car, while being operated or driven along any street. a[ least two lamps of equal candle power, mre on each side, so arranged, adjusted, conelrneted and so placed that any pair oP headlights tinder conditions of use mast. produce a light aufliei- ent to reveal any person, vehicle or substantial object on the high- way straight ahead of each motor vehicle for a distance of at IeasL 160 feet. Such lights, when meas- ured at a distance oP 1d0 feet di- rectly in front of the motor vehicle and at a height of sixty inohos above the level surface on which the motor vehicle or car stands, shall not exceed two thousand four hundred apparent candle power, nor shall thin candle power be exceed- ed at greater height than sixty inches. When measured at a dfe- tance of one hundred feet ahead of the motor vehicle and seven Peet or more to the left of the axis of the same, and at a height of sixty in- ches above the level surface on which the motor vehicle stands, such lights shall not exceed eight hundred apparent candle power; provided, however, the foregoing provisions shall apply to any ve- hicle at roat upon any street not includod within district A. (b) During the time herein be- fore specified every motm'cycle while moving on a highway shall carry at the front tb ereof at least one lighted headlight which shall give a light OL sneh power and so distributed as provided in enbdi- vision (al; provided, howevor, that any motm'cycle with a side car or similar contrivance attached, shall, in additi mx to the foregoing requir- ed light, carry on such side cal' or similar contrivance a lighted lamp visible from a point at leas[ two hundred feet ahead of said motor- cycle. (c) A71 devices or adjustments used in connection with lights upon motor vehicles to enable the same Lo comply with the Urovisions- here- of shall not be used until approved by the 6heriR, Deputy Sheriff or Examiner of Chauffeurs of the County of Hawaii. The cost of testing any device sha^ be borne by the person submitting the same; provided, however, that this cost shag not exceed the sum of one dollar in any one year; PROVIDED, further, that whenever such light or lights become disarranged, dis- adjusted and/or displaced by rea- son or in consequence of colliding with any other motor vehicle, com- inK in eontact with any object and/ or otherwise, the cost of testing or retea ling shall not exceed the sum of one dollar. (d) No person shall drive, oiler. ate or propel a. motor vehicle wilb- out an approved device or adiust- ment upon its headlights unless the said headlights shall have been tested and approved by the Sheriff, llepntY Shy •ifP or Examiner of Chauffeurs. PERMISSION TO OPERATE CERTAIN HEAVY VF HICLES-The Chairman and Exe- cutive officer oY the Board of Super- visors, in and for the County of Ha- waii, may grant Permission Por the moving of heavy vehicles, loads, ob- jerts or structures in excess of a total weigh[ oP 15 tons over any street upon proper application in writing being made therefor; pro- vided, however, that the said Chair- man and Executive officer may re- quire a sufficient bond to protect the county from any lose, injury or damage by reason of such oper- ation. SECTION VI. IMPROPER USE OF STREETS BY HEAVY VEHI- CLES YROHIBITEI)It shall be unlawful to operate, drive, haul or use in any street or public place any vehicle of such weight or con- struction or in such a manner that the edges of the tires of such ve- hicle shall cut into the roadbed and cause ruts therein by reason of being operated on the crown of the roads without sufficient bearing sur- face to sustain the load of such ve- hicle. SECTION VII. The owner, driver, operator or mover of any heavy vehicle, using any street or public plane, shall be responsible Co the County for all damage which said street or place may sustain as a result of a violation of any of the Provisions of this Ordinance. PART VII S E C T I O N III. VIOLATIONS- PUNiSHMENT-Any person violat- ing any of the provisions of this Ordinance shall be punished by a fine oP not leas than five dollars and not more than two hundred fifty dollars. The court having jurisdiction oP any charge brought tinder this' Or- dinance, in addition to the penalty above set forth, may. upon the mo- lion of the prosecuting officer, can- cel the Chanffmtr's Certificate oY any porson found guilty under this Ordinance, in which case the Court shall fig a period, not exceeding twelve months, wherein such per- son shall not be entitled to receive a new Chauffeur's Certificate. SECTION II. Ordinances num- bered 63, 87, 88, S0, 90 and 93 and all older ordinances or parts of Or- dinances in conflict with the pro- visimxs of this Ordinance are here- by repoaled. SECTION III.
