HomeMy WebLinkAboutORD 1928-097 LIGHT TESTING ORDINANCE COUNTY OF HAWAII ORDINANCE N0. 97 An ordinance providing Yor the test- ing, adjustment and approval of any headlight or tail lighp to be used on any motor car or motorcycle in the County of Hawaii and prescribing Yor the same. Be it ordained by the Board of SLL- pervieora of the County of Hawaii: DEFINITIONS SECTION I. The terms used hereid shall be defined to be and include each by the meanings herein respectively set forth, an3 any such terms used in the singular shall be held to include the plural. (a) "Headlight"-shall mean and be taken to be every light used on the front of a motor car or a motorcycle for lighting purposes while traveling on any street. (b) "Tail light"-shall mean and be taken to be any light used in the rear part of any motor cat or motot- cycle for the purpose of showing the registration number ChereoY while traveling on any street. (c) "Sheriff, Deputy Sheriff, Exam- iner of Chauffeurs and Official Head- light Testers"-shatl mean and be tak- en to mean the Sheriff and Deputy Sheriffs and Examiner oP Chauffeurs bf the County of Hawaii. (d) "Official Light Tester"-shall mean and be taken to mean any pub- lib garage in the County of Hawaii as shall he qualified under this ordi- nance to test anfl adjust motor vehicle lights. (e) "Official Light Testing Station" -shall mean and be taken to mean any public garage in the Couuty of Hawaii which shall qualify; ae here- inafter provided, for testing and ad- justing motor vehicle lights. (Y) "All other terms used herein, so Yar as the context will permit, shall be given the same meaning as de- fined in Ordinance 96 of the County of Hawaii. SECTION II. No headlight or tall light shall be used on any motor car br motorcycle for lighting purposes while traveling on any street in the County of Hawaii, unless tae same has been tested 'and approved by an official light tester at ad official light testing atatiou. SECTION III. It shall be the duty of the official light testers to teat and adiust shy headlight or tail ligfit which may be submitted to them for approval, and if he finds that such headjight or tail ltght conforms tb the requirements hereinafter prescrib- ed, fits shall approve tjfe same and is- sue a certiltcate of approval; such certificate shall be such as the Sheriff br Deputy Sheriff shall deem sufficient to cover the requirements hereof. SECTION IV. Such headlight shall be equipped with a dimming device and a globe of sufficient strength so as to distinguish any object plainly at a distance of not less than 200 Yeet ahead of such light and it shall be so adjusted that the beam of such light shall be directed downwards on the street in such a manner as to ptevent the blinding of auy person travelling in the opposite direcGOn. SECTION V, Such tai] light shall be of such a construction and be ad- justed and placed in the rear part of any motor car or motorcycle in such a manner as to display a red light visible Yor a distance of not leas than one hundred and fifty Yeec from the rear [hereof and a white light illuminating and displaying the registration number plate, carried in the rear part of such motor car or motorcycle so that the number on such number plate can be plainly distin- guished for a distance of not leas than liYty feet from the rear thereof. SECTION VI. It shall be the duty of the official light teatera when re- quested so to do, to cause all head- lights used in the front part oY any motor car or motorcycle for lighting purposes while traveling on any street to the County of Hawaii, and all tali lights used in the rear part oP any motor car or motorcycle for the put- poses of ilhxminating and displaying the registration number thereof while travelling on any sheet in the County of Hawaii, to be tested, adjusted and approved. SECTION VII. Every person own- ing any mOi0i Car Or mOim'CyCle Or any person operating any motor car or motorcycle upon which any head- light is used in the front part thereof for lighting purposes and a tail light is used in the rear part thereof for the purpose oY illuminating and display- ing the registration number of each motor car or motorcycle while travel- ing on any street in the County oY Hawaii, shall immediately upon his finding that any head light or tail light upon such motor car or motorcycle has become disarranged or disadjust- ed from any cause whatever, submit such headlight or tail light to one of the official light teatera for retesting, readjustment and approval. SECTION VIII. Tho cost oP testing and adjusting any headlight or tail light shall be paid by the person sub witting the same Por approval as 401- lows: For testing any light or lights $ .56 For tenting and adjusting any light or lights ................ 1.00 The maximum charge Yor testing and adjusting auy light or lights shall not exceed tlxe sum of $1.00 SECTION IX. The Sheritf, Deputy Sheriff or Examiner of -0hauffeure shall collect the above described fees upon the adjustment oP any headlight or tail light submitted to him for ap- proval, and pay the same over to tits County Treasurer as a County realiza- tion; provided, however, that all such Yeea colected by auy bffirial light test- er ottier tfian the Sheriff, Deputy Shei- iff or Examinsr oY Chauffeurs, shall be retained by him as his own property in lieu oY official salary. SECTION X. Any public garage fu the County oY Hawaii which shall con- struct and maintain an official light testing station in conformity with this ordinance shall be qualified and au- thorized to act as an official light test- er and to test and adjust motor vehi- cle lights in the County oY Hawaii up- on receiving Prom the Sheriff tlf tae County of Hawaii a certificate show- ing that such public garage has con- structed an official light testing sta- tion in conformity with this ordinance. All such official light testing stations shall be subject to such rules and re- gulations, not in conflict with this ordinance, as the Sheriff, with the ap- proval oP the Board oC Supervisors, shall prescribe. SECTION XI. Official Testing 9ta- tione: A level Floored dark room oY sufficient size shall be selected. At a distance oP 2b Yeet ahead oY the front glasses of the headlights a screen of cloth or paper shall be held or ar- ranged about 4/ feet square, or the automobile so positioned that head- light glasses will be 26 feet from a vertical light colored wall (preferably white). The fore and aft axis of the car should be perpendicular to the screen or wall. After the lamps are lighted and the front rims oY the head- lights and all glasses, lenses or modi- fying devices of any nature are re- moved, the automobile shall be load- ed with Yull number oY passengers carried. SECTION XII. Method nt Adjust- ment: The method of adjustment oC the lamp bulb forward or backward within the reflector is to be determ- ined, and while covering one head- light this adjustment may be made on the other, meanwhile watching the ef- fect upon the shape oP the spot oY light on the screen or wall. A posi- tion of each lamp bulb may be found thus at which position the spots oP light will be moat compact, round and small. When this condition is attain- ed the lamps may be considered as be- ing focused, that is the filament of the ]amp is at the focus of the reflec- tor. To adjust far the condition of parallelism and no tilt, the headlight brackets must be so bent, set or ad- justed that the two spots as described above, have their centers just as Yar apart on a horizontal line, as are the centers oY the headlights. Also the height of the center of each spot from the floor moat be the same as the height of the headlight centers from the floor. When this condition ie attained the head lights may be considered as being adjusted for focus, for parallelism and for no tilt. SECTION XIII. The County Treas- urer shall not hereafter register or re- register any motor car or motorcycle unless the applicant shall present to the Treasurer an official certificate showing that the lights on such motor car or motorcycle have been tested and (or) adjusted within 14 days prior to the date oY the application for such registration or re-registration. Pro- vided, however, that any applicant for registration or re-registration, who shall file an affidavit with the Treas- urer that the motor car is not being and will not be operated during the night time, need not be required to file any each certificate, and, provided further, that it any person shall make a false affidavit under this Section he will be guilty of a misdemeanor and punished by a flue of not less than $25.00 and not more than $250.00. SECTION XIV. Every operator, driver or owner of say motor car or motorcycle, when requested by the Sheriff, Deputy Sheriff, police officers or Examiner of Chauffeurs, shall sub- mit the lights oY such vehicle to the nearest official light testing station Por testing and (or) adjustment. SECTION XV. VIOLATIONS-PUN- ISHMENT: Any person who shall op- perate amotor car or motorcycle frmn 30 minutes after sunset to 30 minutes before sun up on any street in the County oY Hawaii ,the lights of which are not adjusted according to the pro- visions oP this ordinance and of any rules and regulations promulgated pursuant hereto, shall be punished by a fine of not less than $5.00 and not more than $250.00. And provided further, that any per- son violating any o[ the provisions oY this Ordinance, wherein no specific punishment has been provided for, shall be punished by a fine aP not less than $5.00 and not more than $250.00.
