HomeMy WebLinkAboutORD 1932-099COUNTY OF HAWAII TERRITORY OF HAK'AII ORDINANCE NO. 99 AN ORDINANCE RELATING TO THE ESTABLISHING OF WATER RATES AND REGULATIONS FOR THE WAT- ER WORKS AND WATER WORKS SYSTEMS OF THE VARIOUS DIS- TRICTS OF THE COUNTY OF HA- WAII. AND REPEALING ALL SEC- TIONS AND PARTS OF SECTIONS OF ORDINANCES OF THE COUNTY OF HAWAII IN CONFLICT THEREWITH. Be it ordained by the Board of Supervi- sczs in and for the County of Hawaii. SECTION I. MANAGEMENT: The County Engineer of the County of HawaII shall. !n addition to his other duties, assume the du- ties of the General Manager of the Bureau of Water Works of the Coun- ty of Hawah, and shall have full charge of the design, operation and maintenance of the water works systems of the County of Hawaii, under such rules and regulations as may be established from time to time by the Board of Supervisors of the County of Hawaii. The General Manager may delegate to his Superintendent or other authorized agent, authority to grant and sign permits for water privileges; make agreements in connectiCn therewith; send out bills; collect moneys; cause to put Into effect and enforce regulations required from time to time, especially in periods of emergency, drought or scarcity of water; make rules regarding the use of water for lawn, garden or agricultural purposes as well as for other large water demand uses; and shall give reasonable notice to pr[vilege holders of such rules and regu- lations. SECTION II. PAY OF SUPERINTENDENT'S: The Superin- tendent of each district water works shall receive such salary and-or allowances as may be fixed by the Board of Supervisors. SECTION III. BONDS: The General Manager and each Su- perintendent of district water works shall furnish to the County oP Ha- waii, abond for the faithful accounting of all moneys received and the faithful performance of his duties, and the amount of such bonds shall be $5,000 for the General Manager and $1,000 each for the Superinten- dents. SECTION IV. APPLICATION FOR WATER: Any person, firm or corporation desiring to be supplied with water from any of the County of Hawaii water works systems shall make application therefor on a printed form obtainable at and furnished by the various district water works offices, which application shall be signed by such applicant. Every privllege granted upon such application shall be subject to the rules and regulations herein provided for. SECTION V. WATER: Each applicant for water shall sign as application and make a deposit of Fifteen ($15.00) Dollars for which a temporary deposit voucher shall be issued to the applicant. The Fifteen Dollars shall be used to pay for the connection from the main to the meter adjacent to the property line, and shall include all material ~~ and laboq a meter-box if a meter is to be installed, and street or road repairs if any are needed. Should the deposit be insul8cient to pay all the charges, the amount over Fifteen Dollars shad be charged to the privilege holder on his first water bill thereafter. .gi There shall be returned to the applicant by the Water Works within seven days after the completion of the connection, any unused portion of the temporary deposit. SECTION VI. CONNECTIONB & CUT-OFFS: No person other than the duly authorized employees of the Waterworks shall make con- nections to water lines of the County of Hawaii Water Systems, and any person or persons, firm or corporation connecting, or attempting to obtain water without permission, or tampering with the water meter or breaking the seal thereon, shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine not exceeding Five Hun- dred (E500.00) Dollars, k the discretion of the Court. The duly authorized employees oY the Waterworks shall, at all reasonable hours, be permitted to enter upon the premises of a prvllege holder for the purpose of connecting, inspecting, turning-oH or turning- oa the water, or for the purpose of making repairs to the water lines, stop tacks or meters, and to see that the provisions hereof and the rules and regulations of the Waterworks of the County of Hawaii are being complied with. Privilege holders who are delinquent for 60 days shall be shut-of[, and 1f the privilege is a metered one the meter shall be removed, and service not resumed untll sll back charges together with penalties and s FIVE ($5) DOLLAR labor charge for reiastalling the meter and-or turn- ing-oa the water, is paid. Privlleges may be granted only to owners of property or to those having leases with at least a one year term. Privileges other than the delinquent one but held by the delin- quent privilege holder may also be shut-off. No new privilege shall be given to aqy delinquent privllege holder. SECTION VII. The General Manager of the Water Works is directed to install Meters, if and when funds permit, on all flat rate privileges, where dcem- ed necessary in best interests of the County of Hawall. SECTION X. METERS: The Meter shall be furnished free to the privilege holder, but shall be the property of the Bureau of Water Works oP the County of Hawaii. It shall be installed adjacent to the property line in an approved type of meter box. The safe maximum delivery of the meter used in each privilege shall be greater than the mfximum capacity and requirements of the privilege. Should a privilege holder believe that his meter 1s not registering correctly, he may request to have it tested. Should the test show it to be in error, a new meter shall be put in its place and an adjustment made in the charges affected; but should the meter be found to be registering correctly, it shall de replaced and the entire cost of testing and that in- cidental thereto, shall be paid by the privilege holder. The privilege holder shall be responsible for the proper care and safety of the water meter, and any damage that is done to it shall be repaired 6y the Water Works division and the cost of such repairs shall be added to the current water 6111 of said privilege holder. If a privilege holder requests to have a different sized meter in- stalled from the one already in his privilege, or to isve the location of the meter changed, it shall be done provided the changes does not op- erate as a hardship to or a loss of revenues against the Water Works. and that all costs incident thereto shall be paid by the prlvllege holder requesting such change. 6ECTION XI. BILLING AND COLLECTING: Water rates shall be charged to and payable by the privilege holder for all premises whether occupied or not, until such time as the water is ordered "shut- off" fn writing, or in person or fs shut-off by Authority. The owner of the premises wfll be held responsible for the set- C.ement of water rates in cases where said rates have not been paid by the tenants. All metered water rates shall be paid monthly, except for vessels which have no local agents, under which circumstances payment shall be made by the ships officers upon presentation of an official numbered Hater bill and receipt by a dully authorized representative of the Water Works, otherwise, water rates shall be due on the ftrst day of each month, shall be payable at the district water works office, except that for South Hilo they shall be payable at the Office of the Treasurer of the County cf Hawaii, and shall become delinquent thirty days after due. Flat rates and-or special rates for water shall be due and pay- able quarterly in advance, on the first day of January, the first day o1 April, the first day of July and the first day oT October of each year, at the district water works office, except that for South Hilo they shall be payable at the office of the Treasurer of the County of Hawaii, and shall become delinquent thirty days after due. 6hould these privilege holders desire to, they may pay the rates semi-annually, or annually, in advance. A bill and Notice to pay water rates shall be sent out to each privilege holder by mail and-or delivered by a representative of the Water Works, not less than ten days before such rates become due and payable. SECTION XII. PENALTIES: In all cases of non-payment of water rates for two months after due date, there shall be added ten per cent in addition to the regular rate as the amount due and payable by sold privilege holder. As stated in Section VI, privilege holders who become delinquent and cause their water to be cut-off, shall pay a malty of Five ($5.00) Dollars to cover costs of cutting-off and turning-on water before service will be resumed. SECTION XIII. All sections and parts of sections of Ordinances of the County of Hawaii, in conflict herewith, be and the same are here- by repealed. SECTION XIV.
