ORDINANCE NO. 107
TO AMEND SECTION 2.159
CHAPTER 2; BV ADDING A NEW
SECTION TO SAID CHAPTER 2,
TO BE NUMBERED 1.137.1; A
MENDING SECTION 13.20], CHAP-
TER 13, AND AMENDING SEC-
TION 13.300 CHAPTER 13 OF
ORDINANCE NUMBERED 103 OF
THE COUNTY OF HAWAII, RE-
LATING TO BUILDING CODE.
BE IT ORDAINED BY THE
BOARD OF SIIPERVISORS OF
THE COUNTY OF HAWAII:
SECTION 1. Section 2.159, Chap-
ter 2, of Ordinance numbered 103
of the County oY Hawaii, is hereby
amended to read ae followe:
"SECTION 2.169 THEATER. A
building containing a room for ath-
letic, theatrical or operatic exhi-
bitinna or other public entertain-
ments, having a tots] sitting capa-
city of 450 or more persons."
SECTION 2. Ordinance number-
ed 103 of the County of Hawaii 1s
hereby amended by adding a new
section to Chapter 2 thereof to be
numbered 1.137-1, and to read as
followe:
"SECTION 2.137-1 M OV I N G
PICTURE HOUSES. Buildings Yor
public assemblages which contain
no balconies and only a small stage
and a little or no movable scenery."
SECTION 3. Section 13.200
Chapter 13 of Ordinance numbered
103 of the County of Hawaii is
hereby amended to read as follows:
"SECTION 13.200 MOVING PIC-
TURE HOUSES. All moving pic-
ture houses, outside of the Yire
limits, may be first class, semi-
4irat class, second class, slow burn-
ing heavy timber construction or
third class buildings, provided,
however, [hat where a moving pic-
ture I:ouse is a third class building
it shall be covered on the outside
by corrugated or sheet iron or oth-
er equivalent fire resisting materi-
el; on the inside with plaster, plas-
ter board, caned, corrugated or
sheet iron or other material ap-
proved by the building inspector;
the ground floors shall be of con-
crete or other equivalent Yire re-
sisting material; the root shall be
of corrugated irou, tits or equiva-
lent Yire resisting material; the
ceilings and Partitlone shall be
made of plaster, concrete or other
material approved by the Building
Inspector; the stage may be of any
aubatanttal material. Such buildings
shall have exit facilities, moving
picture booth construction, exit
lights, seats arrangement and spac-
ing, doors opening outward with
self-release bars, floor gradients,
aisle spacings, unobstructed pasea-
gea and outside passage areas the
same as required Yor theaters pro-
vided in Section 13.100 oY this
Chapter. In addit[on, fire extingui-
shers or hose lines shall be provi-
ded as deemed necessary by the
Building Inspector and the Chief of
the Fire Department, or either oY
them:'
SECTION 4. Section 13.300
Chapter 13 oY Urmnanee numbered
103 of the County of Hawaii is
hereby amended to read ae follows:
"SECTION 13.300 PLACES OF
INSTRUCTION. Outside oY the
Fire Districts of the City of Hilo,
all schools or places pf instruction,
over one story in height, may be
of Third Class construction. Third
Clara buildings constructed for this
purpose shall have exits so arrang-
ed that no matter in what portion
of the building fire might occur,
at least one (1) exit shall be ac-
cessible. No Third Class building
for the above use shall exceed two
(2) stories in height."
