HomeMy WebLinkAboutORD 1940-123,~rd r: n •., is-:.<r2 /+..E.~ ~.,~ L' BY AUTHORITY COUNTY OF HAWAII TERRITORY OF HAWAII Ordinance No. 123 An ordinance creating a HAWAII HUMANE COMMISSION for the County of Hawaii. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF HAWAII: Section 1. There is hereby cre- ated aHawaii Humane Commission for the County of Hawaii. The Commission shall consist of five (5) members who shall serve for a term of three (3) years and who shall be of good repute and standing in the community and who snail De. appointed by the Chairman and Executive Officer of the Board of Supervisors with the approval of the Board of Supervisors; provided, however, that of the first commis- sion appointed, one (1) member shall be appointed fora term ex- piring April 1st, 1941, two (2) for a term expiring April 1st, 1942, and two (2) for a term expiring April 1st, 1943. The appointment to fill any vacancy in the office of Com- missioner caused by the death, resig- nation, inability to serve or removal of any commissioner, shall be for the unexpired term of such commis- sioner. All commissioners must, during their term of office be bona fide residents of the County of Ha- waii. Section 2. Immediately upon the appointment, the members shall or- ganize the Commission and shall elect from its membership a Chair- man and a Secretary. The Com- mission shall establish a regular place of business and a regular time oT meeting which shall be not less than once a month. Special meet- ings may be called at any time on personal notice, or notice by mail, by the Chairman. The members of the Commission shall serve without compensation. The Commission shall keep an accurate record of all its proceedings and transactions and shall make a full report of the Com- mission's transactioH to the Board of Supervisors each month. The Commission shall upon demand of the Board of Supervisors make other reports upon subjects within its jurisdiction. Section 3. POWERS AND DU- TIES. The Commission shall have complete charge and management of all matters pertaining to the animal home to be established by the Board; It may make rules and regulations for its organization and procedure, except those mentioned in Section 2 hereof, consistent with the laws of the Territory of Hawaii and the Ordinance of the County of Ha- waii; it is hereby authorized and empowered to seize and impound al] stray and diseased cats, all un- licensed and stray dogs running at large and disposing of the same all in accordance with the provisions of Section 2155, R.L.H. 1935, Act 217, Series A-9 of the Session Laws of Hawaii 1937, or as hereafter amended ar revised from time to time; ft is hereby authorized and empowered to use and expend all money realized by said Commission, other than by means of dog tax, for any purpose the said Commission as in its discretion and judgment shall deem necessary; and it may make recommendations to the Board for the employment of a poundmas- ter and any other person whose services may be deemed necessary to aid the Commission in the perform- ance of the duties placed upon the .said Commission. I HEREBY CERTIFY that the foregoing Ordinance was regularly considered at a meeting of the Board of Supervisors of the County of Hawaii held at the County Seat upon the 3rd day of May, A. D. 1940, and upon being put to vote said Ordinance was adopted by a majority of the Supervisors at said meeting.
