AN ORDINANCE CREATING A
MAJOR DISASTER COUNCIL
AND PRESCRIBING ITS POW-
ERS. DUTIES AND FIINC-
TIONS:
BE IT ORDAINED BY THE PEO-
PLE OF THE COUNTY OF HA-
WAII:
SECTION 1. CREATION OF
MAJOR DISASTER COUNCIIa.
There is hereby created a major
disaster council which shall oonsist
of the Chairman and Executive Of-
ftcer of the County of Hawaii as
Chairman, the head of a department
of [he County of Hawaii, to be select-
ed by the Chairman and Executive
Officer of the County of Hawaii, as
Vice-Chairman, and such other per-
sons as the Chairman and Executive
Officer of the County of Hawaii may
deem necessary to be appointed by
the Chairman and Executive Officer
rf the County oY Hawaii, with the
ap~~roval of the Board of Supervi-
sors, for a term of office to be the
same as the appointing power. Any
vacancy in the office of an appoint-
ed member shall be filled for the
remainder of the unexpired term.
SECTION 2, DUTIES OF THE
COUNCIL. It shall be the duty oY
the council to undertake the coor-
dination of all the resources of the
County of Hawaii, together with the
rrsources of the various persons,
ftrms, associations and corporations
doing business or located in the
County, of Hawaii, and by means of
mutual cooperation and effort create
a plan which would permit an ef-
fretive and efficient methcd of ut1-
If?ing all available resources and
materials for the relief and the
general welfare of the people 'of
the County of Hawall in the event
of some major disaster, catastrophe,
calamity or cataclysm. The council
shall act in accordance with all
laws to which the County of Ha-
waii 1s subject and each and all
members of said council shall dili-
gently undertake to acquaint him-
self with and become familiar with
the resp-nsibillties imposed upon
him in the event of such emer-
gency.
SECTION 3. ~-DECLARATION OF
EMERGENCY: ~ DUTIES OF
CHAIRMAN AND EXECUTIVE
OFFICER. The Chairman and Ex-
ecutive Officer of the County of
Hawaii shall have the power In his
discretion to declare when an em-
ergency disaster exists and in the
event of the declaration of such
emergency he shall have power, sub-
ject to existing laws, to obligate the
County of Hawaii for the payment
of any and all supplies, equipment,
materials, food or other necessities
of relief that may be necessary for
the purpose of alleviating suffer-
ing to the people of the County
of Hawaii and for the purpose of
protecting the people from the
hardships anticipated in case such
condition arises. Should the Chair-
man and Executive O1Hcer of the
County of Hawaii de absent from
the County of Hawaii or disquali-
fied or unable to act for any reason
the powers and duties Imposed up-
on him by the provisions hereof
shall be vested in the Acting
Chairman and Executive Officer of
the County of Hawaii.
SECTION 4. COORDINATOR.
The Chairman and Executive OP-
flcer of the County of Hawaii, with
the approval of the Board of Su-
pervisors, shall appoint a coordin-
ator who shall serve for such term
and at such salary as shall be de-
termined 6y the Board. The co-
ordinator, subjeot to the Civil Ser-
vice Laws and with the approval of
the council, may appoint such as-
sistants and such clerical steno-
graphic and other employees as
shall be deemed necessary and for
which appropriations shall be made
by the Board. The coordinator
shall serve as secretary of the coun_
cif and it shall also be his duty to
act as liaison between the various
divisions of thecouncil and he shall
be responsible for the administra-
tion of the entire plan.
SECTION 5. DIVISIONS. The
council shall be in Charge of the
following divisions of the plan, and
such other divisions as may from
time to time be created by it:
1. Coordination and Intelligence
2. Transportation
3. Communications
4. Power and Light
5. Personnel -
6. Law and Order
7. Law Enfovicement
8. Fire Protection
9. Water and Water Supply
10. Streets and Highways
11. Medical
12. Health and Sanitation
13. Red Cross
14. Pescue, Demolition and Gas
Protection
15. Alr Raid ~ Warning
]0. Religious Worship
17. Recreation and Amusements
18. Mortuary Work
19. Law "~
20. FSnance and Supplies
21. Education
22. Rural Hawaii
The divisions above named, and
such other divisions as may be
created, shall have charge of and
direct such duties and functions as
shall be delegated to them by the
council. Each and all of the di-
visions hereinabove referred to shall
be under the control and direction
of a chairman and in the absence
of express declaration to the con-
trary by a majority of the council
he shall do any and all acts Im-
posed upon the division of which
he is in charge.
SECTION 6. HEADQUARTERS.
The headquarters of the council
shall 6e 1n the County Building,
at Hilo, Hawaii, and in the event
of the declaration of any emergen-
cy it shall be the duty of tine Chair-
man and Executive Officer of the
County of Hawaii to nw.ifly all
members of the council of said de-
claration and all of such members
shall forthwith assemble at the
County Building or such other place
as may be designated by the Chair-
man and Executive Officer of the
County of Hawaii.
The council may make such rules
and regulations as it may deem
necessa-y for the purpose of put-
ting the plan contemplated hereby
into full Porce and effect, provided,
however, that no person shell be
paid any compensation for any ser-
vice rendered hereunder except as
expressly provided for in this or-
dinance or an ordinance for such
purpose.
SECTION 7:. bECLARATION OF
NECESSITY. IC is hereby declared
that this ordinance is necessary to
protect health, life and property
and to preserve and enforce the
good government, order and secu-
rity of the County of Hawaii and
its inhabitanW.
SECTION 8. T h 1 s Ordinance
shall take effect upon its approval.
