HomeMy WebLinkAboutORD 1943-131BY AUTHORITY COUNTY OF HAWAII TERRITORY OF HAWAII ORDINANCE NO. 131 AN ORDINANCE REGULATING POI SHOP BE IT ORDAINED BY THE BOARD OF SUPERVISORS IN AND FOR THE COUNTY OF HAWAII: Section I. PERMITS REQUIR- ED FOR POI SHOPS. No Poi shop or shop for the manufacture of poi or paiai for sale shall be erected, maintained, used or op- erated within the County of Ha- waii except under a permit there- for as hereinafter provided. The treasurer of the County of Hawaii is hereby authorized, em- powered and directed to issue, up- on the receipt of a fee of one dol- lar, a permit for such shop, upon the recommendation, in writing, of the Board of Supervisors of the County o£ Hawaii. No such permit shall be recom- mended by the Board of Supervi- sors unless such shop shall be properly ventilated, laid with ce- ment side walls to a height of at least three feet and draining to a trap connected with a cesspool, sewer or such other means for the proper disposal of drainage as may be approved by the building and plumbing' inspector; nor for any such shop in any place where there is not available an adequate supply of pure water or which is incanable of proper drainage, or which is in such close proximity to sleeping compartments, stable, laundry, abattoir or other placa where any business or process is carried on or condition maintain- ed which, in the opinion of the Board of Supervisors, might be a source of contamination or infec- tion to the poi or paiai manufac- tured threat. No such shop shall be maintained, used, or operated for any other purpose than the manufacture of poi or paiai, nor unless only pure water shall be used thereat and proper drainage maintained therefor, nor unless it shall be kept so screened as to prevent flies and insects from en- tering therein, nor unless all im- plements, tools, machinery, con- tainers, and all other utensils used for or in connection with the man- ufacture, distribution or storage of poi or paiai shall be sterilized each time before being used, nor if any person or individual is employed or engaged 1n or about such shop or building who is afflicted with zny contagious or infectious dis- ease or any disease whioh in the oI'inion of the Board of Supervi- sors, may contaminate or infect the poi or paiai. SECTION II. TERM OF POI SHOP PERMIT. Each permit so issued shall be for a term of one year and shall be subject to revo- cation at any time by the treasurer on the recommendation of the Board of Supervisors when it ap- pears that the place for which it is issued or the manner in which such place is maintained, used or operated does not comply in all respects with the conditions and restrictions of Section I. SECTION III. Any person now operating in the County of Hawaii poi shop or shop for the manu- facture oP poi or paiai for sale shall obtain the permit as provid- ed herein within ninety days after the enactment of said Ordinance. SECTION IV. REQUIRED AN- ALYSIS FOR POI. Poi, which on analysis is found to contain less than thirty per cent of total solids, shall be deemed unfit for human food, and it is hereby provided that the sale of such poi shall be prohibited. SECTION V. PENALTY. Any person who violates or fails to com- ply with any provision of the sec- tions herein provided, shall be guilty of a misdemeanor and upon conviction thereof shall be pun- ished by a fine of not less than twenty-five dollars, nor more than five hundred dollars, or by im- prisonment for not more than three months, or by both such fine and imprisonment. Further, if such person has a permit, the same shall be forfeited. SECTION VI. This Ordinance shall take effect from and after its approval. Introduced by: (SgdJ T. M.
