TO AMEND ORDINANCE NO. 104 OF THE COUNTY OF HAWAII EN- TITLED "AN ORDINANCE REGULATING TRAFFIC UP- ON THE PUBLIC STREETS AND HIGHWAYS OF TF3E COUNTY OF HAWAII." BE IT ORDAINED BY THE BOARD OF SUPERVISORS IN AND FOR THE COUNTY OF F-I A\NAII: Section 1. Article I, Section 1 of Ordinance No. 104 is hereby zunended by adding thereto at the rnd thereof two new paragraphs to read as follows: "Sns. Every vehicle operat- ing as common carrier of passengers, as defined in Act 186, Session Laws of Hawaii 1941, excepting motor vehicles operated as taxicabs. "Taxicab. A motor vehicle, oP 7 passenger capacity or less, which is held for hire at designated places and has no regular sched- ule or route, but operates for the purpose of carry- ing passengers at any time to any point and subject to call." Section 2. Article V, Section 26 of Ordinance No. 104 is hereby amended by repealing the same and 1n lieu thereof the same to read as follows: "(a) It shall be unlawful for the operator of any bus to stand or park, e:.- cepting between the hours of 8:00 P.M. and 12 midnight on week days and between the hours of 5:30 P.M. and midnight, and between midnight and 6:00 P.M. on Sundays and legal holidays, upon any street in any business district, as defined herein, at any place other than at a b'us stop or bus station, except that this provis- ion shall not prevent the operator of any such vehicle from temporarily stopping in accordance With other stopping or parking regulations at any place for the pur- pose of and while ar,- tually engaged in load- ing or unloading pas- sengers. "(b) It shall be unlawful for the operator of any taxi- cab to stop, stand or park his vehicle upon any street or highway in •any business district, as defined herein, for the purpose of soliciting fares." Section 3. Article V, Section 29, Paragraph (a) is hereby a- mended by,repealing the same and 1P ]]fll thereof the same to read as follows: "(a) Except when necessary in obedience to traffic regulations or traffic signs or signals, the op- erator of the vehicle shall not stop, stand or park such vehicle in a roadway other than pa- rallel with the edge of the roadway, headed zn the direction of traffic, and with the curb-side wheels of the vehicle within twelve inches of the edge oP the curb, ex- cept as provided in the following paragraph: "(1) In places where, and at hours when, stopping for the loading or unload- ing of merchan- dise or materials is permitted, veP~i- cles used for the transportation of merchandise or materials may back into the curb to take on or dis- charge loads, when the owner of such vehicle holds a p e r m i t granting him such special privilege, and pro- vided further that such permit shall be either in the possession of the driver or on the vehicle at the time such vehiGe is backed against the curb to take on or discharge a load, and it shall be un- lawful for a n y owner or driver to violate any of the special terms or conditions of any such special per- mit." Section 4. This ordinance shall take effect from and after its ap- proval. Introduced by: (Sgd.) T. M.
