HomeMy WebLinkAboutORD 1944-135By Authority - COUNTY OF HAWAII TERRITORY OF IIAWAII Ordinance No. 135 AN ORDINANCE AMENDING OR- DINANCE NO. 126 OF THE COUNTY OF HAWAII TO PER- MIT STANDING PASSENGERS TO CERTAIN VEHICLES. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF HAWAII: Section 1. Section 1 of Ordinance 126 is hereby amended by adding thereto a new paragraph to read as fellows: "iD [L In fixing the capacity of vehicles whose passenger seating capacity, as de- termined above, is in ex- cess of 17 passengers, it the Examiner of Chauf- feurs of the Police De- partment oP the County oP Hawaii, shall find that the minimum inside distance from the aisle floor to the ceiling of any such vehi- cle is 74 inches, and that the construction of such vehicle is such that it may safely carry an additional number of standing pas- sengers in excess of the actual passenger aeatiug capacity of such vehicle, then Lhe Examiner of Chauffeurs aforesaid may, iu his discretion, fix and allow a rated passenger carrying capacity to such vehicle in excess of the 'rated seating capacity', and for all purposes of this ordinance, such rated pas- senger carrying capacity, so determined, shall be deemed the Yated seating capacity' of suoh vehicle. "t2) In determining the num- ber of standing passengers which such vehicle may carry in excess of its ac- tual passenger seating ca- pacity, the Examiner of Chauffeurs, aforesaid, shall consider as a basis for such determination (but not be limited thereto), a minimum area oY 1'/_ square feet of aisle floor space per standing pas- senger. "B) No such vehicle, whose `rated seating capacity', as above determined, ahall include standing passen- gers therein, shall be per- mitted to carry passengers in excess of its actual pas- senger seating capacity tas distinguished from its `rated seating capacity') within any area of the County of Hawaii outside the geographical limits of the city of Hilo; Provided that the Board of Super- visors may by resolution extend and take away the privilege of carrying stand- ing passengers in any such vehicle to such other areas of the County of Hawaii and for such pe- riods as the Board shall find necessary."
