ALLEYS, WATER AND SEVrER MAINS. IN ADDI- TIONS AND SUBDIVISIONS OF REAL ESTATE WITHIN THE COUNTY OF HAII'AII, FOR THE PURPOSE OF THE SALE OF BUILDING LOTS THEREIN BE- FORETAE SAME ARE OFFERED FOR SALE, AND PRESCRIBING THE CONDITIONS FOR SAID CONSTRUCTION, AND PROVID- ING PENALTIES FOR THE VI- OLATION THEREOF. BE IT ORDAINED BY THE PEO- PLE OF THE COUNTY OF HA- WAII: Section 1. Any person, firm or corporation, the owner of, or pos- sessed of any interest in, land, de- siring Lo lay out an addition in the County of Hawaii, or to subdivide land within said County for the purpose of sale of building lots therein, shall submit to the Depart- ment of Public Works a plat of the addition or subdivision desired, showing the location of all sidewalks, curbs, streets, avenues, alleys, watec and sewer mains therein, as desired, and their relation to existing side- walks, curbs, streets, avenues, alleys, water and sewer mains, over adja- cent ]ands, together with written or printed speciftcations of the materi- als and the proposed kind and meth- od of construction to be used in the construction of said sidewalks, curbs, streets, avenues, alleys, water and sewer mains, in said addition or subdivision. Said plat shall have all dimensions of sidewalks, curbs, streets, avenues, alleys, water end sewer mains, and lots plainly marked thereon. The Department of Public Works may, if it deems it for the conve- nience of the inhabitants of the said County and the public, grant to such person, firm or corporation, the right to lay out such addition or subdivi- sion according to said proposed spe- cifications of materials, method and kind of construction of the proposed sidewalks, curbs, streets, avenues, alleys, water and sewer mains, in said addition or subdivision, or may modify said plat and said specifica- tions in such manner as it may be deemed best for the public interest. Section 2. After the approval of said plat and said specifications as submitted or modified, and before it shall be ]awful to dispose of or offer for sale any lots or tract of land in said addition or subdivision, such person, firm or corporation shall cause the sidewalks, curbs, streets, alleys, water and Sewer mains, as they appear on the approved plat of said addition or subdivision to be accurately surveyed and all street lines marked on the ground and pro- tected by cast iron monument frames and covers, and, shall ]ay. and con- struct in accordance with the spe- cifications approved by the Depart- ment of Public Works all sidewalks, curbs, streets, avenues, alleys, watet• and sewer mains, set forth in said plat as approved by the Department of Public Works. Monuments marking street lines shall be properly co-ordinated to Government Survey Triangulation Stations and the true azimuths and distances between them marked on said plat. Said plat shall be filed in [he office of the Department of Pu6- ]ic Works. Section 3. It shall be unlawful for any person, firm or corporation, to lay cut an addition or subdivision in the County of Hawaii, or subdivide any tract of lend within said Coun- ty of Hawaii, for the purpose of the sale of building lots therein, without complying with the provisions of this ordinance. Section 4. IL shall be unlawful for any owner or other person to sell or offer for sale or contract for the sale of any ]ot or tract of land in any addition or subdivision in the Coun- ty of Hawaii hereafter platted, which shall not be laid out, platted, and all sidewalks, curbs, streets, avenues, alleys, water and sewer mains, constructed in conformity with the provisions of this ordinance, and of the grant of the Department of Public Works permitting the ad- dition or subdivision. Section 5. The Board of Supervi- sors of the County of Hawaii shall not take over, receive by dedication, or otherwise, or do any repair or construction work upon or in any way accept as public highways any streets, avenues, alleys, water and sewer mains, in anY addition or sub- division hereafter opened or platted in the County of Hawaii except upon a compliance with the provisions of this Ordinance, and of the grant of the Department of Public Works permitting the addition or subdivi- sion. Provided, however, that the grant to any person, firm or corporation, by resolution, of the right to lay out such addition or subdivision accord- ing to said plat and said speciflca- tions, as submitted or amended, shall not be construed to operate as an acceptance or adoption of such side- walks, curbs, streets, avenues, alleys, water and sewer mains, by the Board of Supervisors, or the Department of Public Works. Section 6. Any person, firm or cor- poration who shall violate any of the provisions Af this Ordinance shall be deemed guilty of a misde- meanor, and, upon conviction thereof, shall be punished by a fine of not less than Twenty-five Dollars /§25.00) nor more than Five Hun- dred Dollars ($500.00) for each vi- olation. D. 1944, and upon being put to vote said Ordinance was adopted by a majority of the Supervisors at said meeting.
