HomeMy WebLinkAboutORD 1946-150COUNTY OF HAWAII TERRITORY OF HAWAII Ordinance No. 150 AN ORDINANCE AMENDING OR- DINANCE NO. 103 OF THE COUNTY OF HAWAII, KNOWN AS THE "BUILDING CODE, AS AMENDED BY ORDINANCE NO. 110 OF THE COUNTY OF HA- WAII. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF HAWAII: Section 1: The first paragraph of Section 4.130, Chapter 4, of Ordi- nance No. 103 of the County of Ha- waii, as amended by Section 2 of Ordinance No. 110, is hereby amend- ed by deleting the words "Third Class" in line 5 and to read as fol- lows; "Every building hereafter to be erected within Fire District No. 1 shall be First Class, Second Class, or Slow Burning Heavy Timber construction as defined in Section 3.200. Provided, how- ever, that buildings without walls may be erected as provided in Section 4.500. Buildings extend- ing into another district shall be of the construction required in the more stringently regulated district, wiles a division fire wall is constructed making, in effeot, two separate buildings. In addition to the above restric- tions, all buildings shall con- form to the requirements of height, area of lot covered, fire pipe lines, fire escapes and structural requirements else- where provided for in this Code. (See particularly Sections 3.200, 4.430 and Chapter 7.) This sec- tion shall be construed to affect existing buildings when altera- tions and/or repairs on such to- tal more than one hundred per- oent (100%) of the assessed value of the structure in the case of Second Class Buildings and slow burning heavy timber construc- tion buildings, and fifty percent (50%) of the assessed value of the structure in case of Third Class Buildings. The assessed value used shall be that for tax- ation purposes and shall be tak- en just prior to the proposed re- pairs. When the total of altera- tions and/or repairs exceed the above, such structure shall be made to entirely conform to the requirements of this Section, or shall be removed:' Section 2: Section 4.140, Chapter 4, of Ordinance No. 103, as amended by Section 3 of Ordinance No. 110, is hereby amended by deleting the words "Third Class" in line 6 and to read as follows: "Within Fire Districts Nos. 2 and 3, every building hereafter erect- ed shall be of First Class, Semi- First Class, Second Class, or Slow Burning Heavy Timber Construction, as defined in Sec- tion 3.200, provided, however, that buildings without walls may be erected as provided in Section 4.500. Buildings extending Into another district shall be of the construction required in the more stringently regulated dis- trict, unless a division fire wall without openings is constructed, making, in effect, two separate buildings. In addition to the above, all buildings shall con- form to height restrictions, area of building without fire walls, area of lot covered, fire pipe lines, fire escapee and structural requirements as elsewhere pro- vided for in this Code. Provided, however, that this Section shall be construed to affect existing non-conforming buildings when the alterations on such total more than fifty peroent (50%) of the assessed value of tihe structure just prior to the proposed altera- tions, in which event the owner shall make the entire building oonform to the requirements of this Chapter and/or remove the structure or adopt such other procedure as may conform to the intent of this Section. All fences constructed in fire districts shall conform to the requirements of section 2.125-1 of this Code." Section 3: This Ordinance shall take effect upon its approval.
