Ordinance No. 152
AN ORDINANCE ESTABLISHING
MAXIMUM CHARGES FOR
TAXICAB SERVICE, AND PRO-
VIDING PENALTIES FOR THE
VIOLATION THEREOF.
BE IT ORDAINED BY THE BOARD
OF SUPERVISORS OF THE
COUNTY OF HAWAII:
Sec. 1. DEFINITION: The fol-
lowing terms as used herein shall be
deemed to mean:
a. TAXICAB SERVICE. "Taxi-
cab Service" as used herein shall be
deemed to mean the furnishing of
transportation in an automobile li-
censed under the provisions of Sec-
tion 7132, R.L.H. 1945, and designed
to carry not more than six passen-
gers, when ouch transportation is re-
quested and the termini and/or
routes are designated by or on be-
half of a passenger. The term shall
include all stops enroute for periods
in excess of 5 minutes made at the
request of the passenger The term
shall not include school buses, hotel
buses, chartered buses, motor vehi-
cles used solely for funerals, wed-
dings and similar events, touring au-
tomobile service, or vehicles furnish-
ing mass traxsportation service be-
tween regularly scheduled termini
over fixed routes.
b. PASSENGER. The term "pas-
senger" shall not include the oper-
ator of the taxicab nor any child
under the age of five years accom-
panied by a competent person.
Sec. 2. RATES OF FARE: It
shall be unlawful for the operator
of a taxicab to charge for taxicab
service at a rate in excess of that
hereinafter set forth for the type of
taxicab service rendered:
I. (a) From any taxi stand or
from any point to another
point, for the first mile or
fraction thereof, the fare
shall not exceed fifty cents
(50q).
(b) For each additional mile or
fraction thereof, thirty-flue
cents (35¢).
Provided, however, the taxi
fares and charges for pas-
sengers from incoming
boats or planes shall be by
each person, and not by the
entire taxicab, to wit: a
fare not exceeding 50y' per
passenger for the first mile
and 35y per passenger for
each additional mile there-
after or fraction thereof.
(c) Distance may be computed
from taxi stand to destina-
tion or from point of pick-
up to destination, which-
ever is greater.
(d) If within the city limits of
Hilo, five minute waiting
time shall be allowed all
returning or round trip
passengers without extra
charge. Waiting fora long-
er time may be charged at
the rate of 50y` for each
quarter hour, or fraction
thereof.
(e) For each taxicab hired for
Yuneral services, time not
to exceed two hours, and
used within the city limits,
fare shall not exceed $4.00;
for each taxicab hired for
funeral services held out-
side of city limits, the fares
may be fixed by agreement
between operator and pas-
senger.
(P) Shopping or making calls
when at least half of the
time is taken up on wait-
ing;
For the entire taxicab, per
hour, fare shall not exceed
$3.00 for the first hour, and
for each quarter hour or
fraction thereof thereafter,

fg) For continuous driving by
the hour, within the city
limits, the fare shall not
exceed $4.00 an hour.
(h) Any child under five years
of age in the custody of a
competent person, shall not
be considered a passenger,
if the child is at all times
seated on the lap of the
custodian.
II. The rates of fares and charges
for taxicabs operating from
a fixed stand outside the
city limits of Hilo shall be
as follows:
(a) For the first mile or frac-
tion thereof, not more than
fifty cents (60y).
(b) For each additional mile or
fraction thereof, not ex-
ceeding 15 miles, thirty-five
cents (3650 Per mile.
(c) The price for any trip from
within the city limits of
Hilo to a point outside the
city limits, or from any
point outside of the city
limits to another point out-
side the city limits, when it
exceeds 15 miles, or from a
point outside of the city
limits to any point with-
in the city limits, when it
exceeds 15 miles, may be
fixed by agreement between
the taxi driver and the pas-
senger, but in no event shall
said price exceed fifty cents
(50r,•) for the first mile and
Porty-flue cents (45y~) for
each additional mile there-
after, together with a
charge for waiting, which
charge shall not exceed
$2.00 per hour or fraction
thereof.
(d) Sightseeing tours shall not
be affected by this ordi-
nance.
Sec. 3. DISPLAY OF RATES. A
card showing the rates of fare shall
at all times be on display in a Promi-
nent location in each taxicab.
Sec. 4. TAXICAB STAND OR
GARAGE. A taxicab, when not en-
gaged in business or personal use,
shall be stationed or housed at its
garage or stand.
Sec. 5. PENALTIES. Any person
violating any of the provisions of
this ordinance, shall, upon convic-
tion thereof, be sub)ect to a ftne not
exceeding five hundred dollars or
imprisonment for a period not ex-
ceeding six months, or by both such
fixxe and imprisonment.
Sec. 6. REPEAL. All other ordi-
nances and parts of ordinances in
conflict with this ordinance are
hereby repealed.
Sec. 7. EFFECTIVE DATE. This
ordinance shall take effect on May
1, 1946.

considered at a meeting of the Board
of Supervisors of the County of Ha-
w:xii held at the County Seat upon
the 1st day of May, A. D. 1946, and
upon being put to vote said Ordi-
nance was adopted by a unanimous
vote of the Supervisors at said meet-
ing.
