HomeMy WebLinkAboutORD 1946-158BY AUTHORITY COUNTY OF' HAWAII TERRITORY OF HAWAII ORDINANCE NO. 158 AN ORDINANCE AMENDING ORDINANCE NO. 149, KNOWN AS ZONING ORDINANCE OF THE COUNTY OF HAWAII. BE IT ORDAINED 'BY THE BOARD OF SUPERVISORS IN AND FOR THE COUNTY OF HAWAII: SECTION I. The twelfth para- graph of Section 2, subtitled "Area Regulation" and Paragraph "C" of Section 3 oY Ordinance No. 149 of tre County of Hawaii are respec- tively amended so that the same shall respectively read as follows: "Section 2. DeSnitions: Area Regulation; On every lot in the residential districts there shall be the minimum lot requirement as prescribed herein. "Section 3. IIse Districts: C. Except as hereinafter provided, (ll no building shall be erecteil, reconsiructed ar structurally altered; nor shall any building or land be used for any purpose other than is permitted in the district in which such building or land is located; (2) no lot area shall be so reduced or d5minished that the yards or other open spaces shall be smaller than prescribed by this Ordinance or by other ordinances of the County of Hawaii; (3) no yard or open space provided about any building for the purpose of complying with the provi- sions of this Ordinance or other ordinances of the County of Hawaii shall be consdiered as providing a yard ar open space of the adjoining lot whereon a building 1s to be erected:' SECTION 2. The following two sections, Section 4 and Section 27, of Ordinance No. 149 of the County of Hawaii are hereby amended so that each of said sections shall respectively read as follows: "Section 4. IIse Districts in the Rural Districts: In the rural districts of the County oP Hawaii, being all districts outside of the City of Hilo, the various use dis- tricts enumerated in the fore- going section may be set aside or established under the pro- cedure set forth in Section 5 - of Ordinance No. 146 of the County of Hawaii, or changes or variances establashed in accordance with the provisions of Section 22, 23, 24, or 25, provided, however, that all parts of the rural districts not so set aside or established shall re- main and be subject to all re- quirements and restrictions of Phis Ordinance new or here- after made applicable to rural districts. "Section 27. Enforcement: The Building Official of the Bureau of Construction and Inspections is hereby authorized and it shall be hia duty t oen- force the provisions of Lois Ordinance. Appeal from the decision of the Building Offi- cial shall be made to the Plan- ning and Traffic Commission:' SECTION 3. The following sec- tions 79, ]?, 14, 17, and 26 of Ordi- nance No. 149 of the County of Hawaii are hereby repealed. SF1G'I'ION 4. This Ordinance shall take effe^t upon its approval.
