This Ordinance shall be known as the "Building COUNTY OF HAiNAII TERRITORY OF HAWAII ORDINANCE N0. 6 AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, R~uIOVAL, CONVERSION, DEMOLITION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF BUILDINGS OR STRUCTURES IN THE CITY OF HILO AND OOUNTY OF HAWAII; PROVIDING FOR 'THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE DECLARING AND ES'PABLISHING FIRE DISTRICTS; PROVIDING PENALTIES F'OR THE VIOLATION THEREOb'. BE IT ORDAINED BY THE BOARD OF SUPERVISUitS OF THE COUNTY OF HAWAII: ~i Code," may be cited as such, and will be refex•red to herein as "this Code." Section 102. Purpose. The purpose of this Code is to provide minimum standards to safeguard life or limb, health, property, and public welfare by regulating and controlling the design, construction, quality of materials, use and occupancy, location and maintenance of all buildings and structures within the city and certain equipment specifically regulated herein. The provisions of this Code shall supplement any and all laws of the County of Hawaii releting to buildings. Section 103. .SOOpB. New buildings and. structures hereafter erected in the County of Hawaii shall conform to the requirements of this Code. Additions, alteratione., repairs and changes of use or occupancy in all buildings and structures shall comply with the provisions for new buildings and structures except as otherwise provided in Sections 104, 306, and 502 of this Code. Where, in any specific case, different sections of this Code specify different materials, methods of construction or other requirements, the most restrictive shall govern. Section 104. The new construction shall conform to the requirements of this Code for a new building of like area, heigYit, and occupancy. Such building or structure, including new additions, shall not exceed the areas end heights specified in this Code. (d) additions, alterations •~nd Repairs• 25 Per Cent or Less. Structural additions, alterations, and repairs to any portion of an exist- ing buildinE or structure, within any 12-itiouth period, not exceedir~; z5 per cent of the value of the building or structure shall comply with all of the requirements for new buildings or structures, except that minor structural additions, elteretions, or repairs, when approved by the Building Official, may be made with the same material of which the build- ing or structure is constructed. (e) Non-Structural alterations and Repairs• 25 Per Cent or Less. Alterations or repairs, not exceeding 25 per cent of the value of an existing building or structure, which are non-structural and do not affect any member or part of the building or structure having required fire resistance, may be made with she same materials of which the building or structure is constructed. (f) Repairs: Roof Coverin€. Not morn than 25 per cent of the roof covering of any building or structure shall be replaced in any 12-month period unless the new roof covering is made to conform to vhe requirements -2- -( of this Code f'or new buildings or structures. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, altar, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure in the County, or cause the same to be done, contrary to or in violation oP any of the provisions aP this Code. Any person, firm or corporation violating at~y of the provisions of this Cade shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty oP a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued or permitted, and upon the conviction oP any such violation such person shall be punishable by a fine of not more than X1,000, or by imprisonment Por not more than six months, or by both such fine and imprisonment. CHAPTER 3--PERMITS AND INSPECTIONS Section 301. Applications for Permits. No person, firm or corporation shall erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish any building or structure in the County, or cause the same to be done, without first obtaining a separate building permit for each such building or structure from the Building Official. (b) Application. To obtain a permit the applicant shall first Pile an application therefor in writing on a Porn furnished for that purpose. Every such application shall: 1. Describe the land on which the proposed work is to be done, by lot, block, tract, and house and street address, or similar description that will readily identify and definitely locate the proposed building or work; 2. Show the use or occupancy of all parts of the building; 3. Be accompanied by plans and specifications as required in Subsection (e) of this Section; 4. State the valuation of the proposed work; 5. Restrictions in Fire Zone No. 2. (a) General. Buildings or structures hereafter erected, constructed, moved within or into Fire Zone No. 2 shall be one of the types of construction as defined in this Code and shall meet the requirements of this Section. (b) limitation of Types of Construction. If any section, subsection, sentence, clause or phrase of this Ordinance. is, for any reason held to be uncon- -16- atitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The quality of all materials, method of connecting or assembling such materials, stresses allowed and live and dead loads assumed in the design and construction of elf buildings or structures shall be in accord with nationally recognized standards of quality and with generally recog- nized and well established methods of structural design and construction. Compliance with all the provisions of the Uniform Building Code, 1946 Edition, of the Pacific Coast Building Officials Conference, one copy of which is on file with the County Clerk as a public record, shall be and is hereby declared to be prima facie evidence of the reduction of fire and east hazards, acceptable quality of material and generslly recognized and well established methods of structural design and construc- tion. Section 6004. For the purpose of this Ordinance, Exceptions 1, 2 and 3 provided in Section 2204, on Page 79 of the Uniform Building Code, 1946 Edition, are hereby excepted and in lieu thereof there shall be the following exceptions: Exception No. 1. Interior and exterior bearing walls in one-story building may be sup,orted on piers. 4 Exception No. 2. For Type V buildings, isolated piers of wood, solid masonry or concrete may be used for post and girder construction. Exception No. 3. V~ood frame Type V buildings may be constructed -20- r of single one (1) inch nominal thickness board walls without studs for one (1) story in height where such has cross partitions of at least for every thirty (30) feet of such wall. Two-story wood frame Type V buildinbs may be constructed of single wall for the upper story, but shall be supported by studded walls below. Studding shall be not less than t~,vo by three (2 x 3) inches, and sha12 be so braced to amply carry the loads Imposed. When wood frame dwellings are supported by posts, knee bracing shall be provided of sufficient strength to stabilize the structure against movement from wind pressure in any directicn.
