HomeMy WebLinkAboutORD 1947-012_ ~ ~ -~ COUNTY OF HAWAII ~ TERRITORY OF HAWAII ORDINANCE N0. 12 AN ORDINANCE TO FORBID THE CUTTING, MUTILATING OR DESTROYING OF CERTAIN TREES WITHIN THE COUNTY OF HAWAII. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF HAWAII: Section 1. It shell bs unlawful for any parson, association partnership or corporation engaged in the buaineas of transmitting electric power or conducting a telegraph or telephone business, or any other person, association, partnership or corporation, in am manner whatsoever, to cut, trim, mutilate, destroy or appropriate any shade, ornamental, fruit or other tree growing upon any sidewalk, highway or private property within the County of Hawaii without first having the written permission so to do as provided by this Ordinance. Seetlon 2. The owners of any private land within the County of Hawaii may permit any of the persona designated in Section 1 of this Ordinance to cut, trim, mutilate, destroy or appropriate any tree growing upon such private land by written permission setting forth the time within which and the manner by which such person may cut, trim, mutilate, destroy or appropriate any tree or trees growing upon such land. Section 3. Thin Ordinance shall be taken to supersede so much oP Section 892 of the Revised Laws of the Territory of Hawaii as relates to the appropriation of any trees growing by Nature. Section 4. Written permission to cut, trim., mutilate, destroy or appropriate any tree or trees growing upon any sidewalk or highway within the County of Hawaii may be obtained only Prom the Board of Supervisors of the County by resolution adopted at a regular meeting of such Board setting forth the time, place and manner in which any tree or trees may be cut, trimmed, mutilated, destroyed or appropri- ated end netting forth the peculiar tree or tress. Such written *~~,r=~ ...._ permission provided by this section shall not operate to eaempt any party from the penalties of this Ordinance until the written permission of the owner of the property abutting the sidewalk or highway immediately in front of said trey or trees shall be obtained. Section 5. Any person who shall violate any of the provisions of this Ordinance shall., upon conviction, be punished by a fine of not more than One Hundred Dollars (100.00) or by imprisonment for not more than six (6) months for each tree so cut, trimmed., mutilated, destroyed or appropriated. -~-
