HomeMy WebLinkAboutORD 1947-025a COUNTY OF HAWAII ~` TERRITORY OF HAWAII ORDINANCE N0. 25 AN ORDINANCE PROVIDING FOR THE TESTING, ADJUSTMENT AND APPROVAL OF ANY HEADLIGHT OR TAIL LIGHT TO BE USED ON ANY MOTOR CAR OR tdOTOHCYCLE IN THE COUNTY OF HAWAII AND PRESCRIBING FOR THE SAME. BE IT ORDAINED BY 'PRE BOARD OF SUPERVI~OxS OF THi; OOUNTY OF HAWAII: DEFINITIONS Section 1. 'Phe terms used herein shall be defined to be and include each of the meanings herein respectively set forth, and any such terms used in the singular shall be held to include the plural. ,;~.~'! (a) "Headlight"--shall mean and be taken to be every light used on the front of a motor ear or motorcycle for lighting purposes while traveling on any street. (b) "Tail light"--shall mean and be taken to be any light used in the rear part of any motor car or motorcycle for the purpose of showing the registration number thereof while traveling on any street. (c) "Sheriff, Deputy Sheriff, Examiner of Chauffeurs and Official Headlight Testers"--shall mean and be taken to mean the Sheriff and Deputy Sheriffs and Examiner of Chauffeurs of the County of Hawaii. (d) "Official Light Tester"--shall mean end be taken to mean any public garage in the County of Hawaii as shall be qualified under this Ordinance to test and adjust motor vehicle lights. (e) "Official Light Testing Station"--shall mean and be taken to mean any public garage in the County of Hawaii which shall qualify, as hereinafter provided, for testing and adjusting motor vehicle lights, (f) All other terms used herein, so far es the context will permit, shall be given the same meaning as defined in Or dinence 19 oP the County oP Hawaii. ,; ,, ,, .. ~ Section 2. No headlight or tail light shall be used on any motor car or motorcycle Por lighting purposes while traveling on any street in the County oP Hawaii, unless the same has been tested and approved by an official light tester at an official light testing station. Section 3. It shall be the duty of the official light teeters to teat and adjust any headlight or tail light which may be submitted to them for approval, and if he finds that such headlight or tail light conforms to the requirements hereinafter prescribed, he shall approve the same and issue a certificate of approval; such certificate shall be such as the SheriPP or Deputy Sheriff shall deem sufficient to cover the requirements hereof. Section 4. Such headlight shall be equipped with a dimming device and a globe of sufficient strength so es to distinguish any object plainly at a distance oP not less than 200 Peet ahead of such light and it shell be so adjusted that the beam of such light shall be directed downwards on the street in such a manner as to prevent the blinding of any person traveling in the opposite direction. Section 5. Such tail light shall be of such a construction and be adjusted and placed in the rear part of any motor car or motorcycle in such a manner as to display a red light visible for a distance of not less then one hundred and fifty feet from the rear thereof and a white light illuminating and displaying the registration number plate, carried in the rear part of such motor car or motorcycle so that the number on such number plate can be plainly distinguished for a distance oP not less than fifty Peet from the rear thereof. Section 6. It shall be the duty of the official light testers, when requested eo to do, to cause all headlights used in the front part oP any motor car or motorcycle for lighting purposes while traveling on any street in the County oP Hawaii, and all tail lights used. in the rear part of any motor car or motorcycle for the purposes of illuminating -2- and displaying the registration number thereof while traveling on any street in the County of Hawaii, to be tested, adjusted and approved. Section 7, Every person awning any motor car or motorcycle or any person operating any motor car or motorcycle upon whioh any head- light is used in the front part thereof for lighting purposes and tail light is used in the rear part thereof Por the purpose of i:Lluminating and displaying the registration number of such motor car or motorcycle while traveling on any street in the County of Hawaii, shall immediately upon his finding that any head light or tsil light upon such motor car or motorcycle has become disarranged or disad,justed from any cause whatever, submit such headlight or tail light to one of the official light testers for retesting, read,juatment and approval. Section 8. The cost of testing and adjusting any headlight or tail light shall be paid by the person submitting the same for approval as follows: For testing any light or lights ...................... .50 For testing and adjusting any light or lights........ X1.50 The maximum charge Por testing and adjusting any light or lights shall not exceed the sum of.,,,,,~;~,00 Section 9. The Sheriff, Deputy Sheriff or Examiner of Chauffeurs shall collect the above described fees upon the ad,juatment of any head light or tail light submitted to him for approval, end pay the same over to th® County Treasurer as a County realization; provided, however, that all such fees collected by any official light tester other than the Sheriff, Deputy Sheriff or Examiner of Chauffeurs, shall be retained by him as his own property in lieu of official salary. Section 10. Any public garage in the County of Hawaii which shall construct and maintain an official light testing station in conformity with this Ordinance shall be qualified and authorized to .act as an official light tester and to test and adjust motor vehicle lights in the County oP Hawaii upon receiving from the Sheriff of the Caunty of Hawaii a certificate showing that such public garage has constructed an -3- official light testing station in conformity with this Ordinance. All such official light testing stations shall be subject to such rules and regulations, not in conflict with this Ordinance, ea the Sheriff, with the approval of the Board of Supervisors, shall prescribe. See ti on 11. Official Testing Stations: A level floored dark room of sufficient size shall be selected. At a distance of 25 feet ahead of the front glasses of the headlights a screen of cloth or paper shell be held or arranged about 4~ feet square, or the automobile so positioned that headlight glasses will be 25 feet from ei vertical light colored wall (preferably white). The fore and aft axis of the car should be perpendicular to the screen or wall. After the lamps are lighted and the front rims of the headlights and all gl.eases, lenses or modifying devices of any nature are removed, the automobile shall be loaded with full number of passengers carried. Section 12. Method of Adjustment: The method of adjustment of the lamp bulb forward or backward within the reflector is to be determined, and while covering one headlight this adjustment may be made on the other, meanwhile watching the effect upon the shape oP the spot of light on the screen or wall. A position of each lamp bulb be may be found thus at which position the spots of light will, most compact, round and small, when this condition is attained the lamps may be considered as being focused, that is the filament of the lamp is et the focus of the reflector. To adjust for the condition of parallelism and no tilt, the headlight brackets must be so bent, set or adjusted that the two spots as described above, have their oenters just as Par apart on a horizontal line, as are the centers of the headlights. Also the height of the center of each spot from the floor must be the same as the height of the headlight centers Prom the floor. when this condition is attained the headlights may be considered as being adjusted for focus, for parallelism and for no tilt. Section 13. The County Treasurer shall not hereafter register or re-register any motor car or motorcycle unless the applicant shall present to the Treasurer an official certificate showing that the -4- lights on suoh motor car or motorcycle have been tested and/or adfusted within 14 days prior to the date of the application Por such registration or re-registration. Provided, however, that any applicant for registration or re-registration, who shall file an affidavit with the Treasurer that the motor car is not being and will not be operated during the night time, need not be required to Pile at~y such certificate, and, provided further, that if any person shell make a false affidavit under this Section he will be guilty of a misdemeanor and punished by a Pine of not less than X25.00 and not more than X250.00. Section 14. Every operator, driver or owner of any motor oar or motorcycle, when requested by the Sheriff, Deputy Sheriff, police officers or Examiner of Chauffeurs, shall submit the lights of such vehicle to the nearest official light testing station for testing and/or ad3ustment. Section 15. Violations-Punishment: Any person who shall operate a motor car or motorcycle Prom 30 minutes after sunset to 30 minutes before sun up on any street in the County oP Hawaii, the lights oP which are not adjusted according to the provisions of this Ordinance and of any rules and regulations promulgated pursuant hereto, shall be punished by a Pine oP not less than X5.00 end not more then $250.00. And provided further, that any person violating any of the provisions of this Ordinance, wherein no apeeiPic punishment has been provided for, shall be punished by a fine of not less than X5.00 and not more than X250.00. -5-
