ORDINANCE NO. 81
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 26 OF THE HAWAII COUNTY
CODE RELATING TO SALARY GRADES FOR DEPUTIES IN THE OFFICE OF THE
CORPORATION COUNSEL AND THE OFFICE OF THE PROSECUTING ATTORNEY
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Article 26 of Chapter 2 of the Hawaii County Code
is amended to read as follows:
Section 2-143. Definitions.
(a) "Deputies" means deputies in the office of the
corporation counsel and the office of the prosecuting
attorney.
(b) "Appointing authority" means the corporation counsel or
the prosecuting attorney.
[Section 2-144. Placement in grade; step.
Deputies shall be placed in appropriate salary grades
and steps in accordance with this article.
Section 2-145. Salary grades; steps.
(a) There shall be two salary grades, each with a set
number of steps, as follows:
(1) Law Grade 1 (LG-1), with steps "A" through "J,"
shall be the non-supervisory grade.
(2) Law Grade 2 (LG-2), with steps "A" through "E,"
shall be the supervisory grade.
Section 2-146. Law Grade 1.
(a) Minimum qualifications Deputies in Law Grade 1 shall
be admitted to practice before the Supreme Court of
Hawaii. Additional qualifications may be required as
the appointing authority deems necessary.
(b) Initial placement within grade for inexperienced
deputies Deputies with no legal work experience
shall be placed initially in Step "A."
(c) Initial placement within grade for experienced deputies
Deputies with legal work experience may be placed
initially in whatever step the appointing authority
deems appropriate, provided that the step is no higher
than the highest step to which the deputy could have
advanced had the deputy begun employment with the
County with no legal work experience.
Section 2-147. Law Grade 2.
(a) Minimum qualifications --Deputies in Law Grade 2 shall
be admitted to practice before the Supreme Court of
Hawaii and shall have practiced law, or supervised
employees, for a period of at least two years.
Additional qualifications shall set out in guidelines
adopted by the appointing authority pursuant to this
article.

(b) Initial placement within grade Deputies appointed to
supervisory positions as defined in the guidelines
adopted by the appointing authority pursuant to this
article may be placed initially in the step designated
by the guidelines.
Section 2-148. Advancement within grade.
(a) Law Grade 1 A deputy may be advanced one step within
grade after having completed a sis-month period of
initial employment with the County. Thereafter, upon
completion of subsequent sia-month periods of
employment, a deputy may be advanced one step within
grade or not more than two subsequent steps within
grade in a one-year period.
(b) Law Grade 2 A deputy may be advanced one step within
grade after having completed a si$-month period of
employment in the step from which the deputy is
advancing or not more than two subsequent steps within
grade in a one-year period.
(c) Advancement within grade is at the discretion of the
appointing authority and shall be based upon merit
principles and governed by the guidelines adopted
pursuant to this article.
Section 2-149. Guidelines for advancement within grade
and supervisory placement.

(a) The appointing authority shall adopt guidelines setting
out the following:
(1) The criteria or conditions that must be met before
a deputy may be advanced initially after having
completed a six-month period of initial employment
or one step within grade in any six-month period.
(2) The criteria or conditions that must be met before
a deputy may be advance more than one step within
grade in any one-year period.
(3) The responsibilities and duties that must be
performed by any supervising deputy placed in or
advanced to any step within the supervisory grade.]
Section [2-150.] 2-194. Salary Schedule.
The Appointing Authorities shall [establish salary
schedules for [Grades LG-1 and LG-2] within a range
between] set the salaries for deputies within their
offices• provided no deputy shall be compensated at a rate
which is less than fifty percent (50$) [and] nor more than
ninety percent (90$) of the salary which has been
established for the [appointing authority by ordinance]
Prosecuting Attornev or Corporation Counsel whichever is
higher. The department head shall set the salary for the
individual deputies based upon the individual's
professional experience and performance.

SECTION 2. Bracketed material is repealed. New material is
underscored.
SECTION 3. This ordinance shall take effect upon its adoption.
