ORDINANCE N0. 35
~~ AN ORDINANCE CREATING A BBAJOR DISASTER'COUNCIL AND PRESCRIBING ITS
POWERS, DUTIES AND FUNCTIONS,
BE IT ORDAINED BY 'PHE BOARD OF SUPERVISORS OF THE COUNTY OF HAWAII:
Section 1. CREATION OF -QAdOR DISASTER COUNCIL. There is hereby
created a major disaster council which shall consist of the Chairman
and Executive Officer of the County of Hawaii as Chairman, the head of
a department of the County of Hawaii, tc be selected by the Chairman
and Eaecutive Officer of the County oP Hawaii, es Vice Chairman, and
such other persons as the Chairman and Executive Officer oP the County
of Hawaii may deem necessary to be appointed by the Chairman and
Eaecutive Officer of the County oP Hawaii, with the approval of the
Board of Supervisors, for a term of office to be the same as the
appointing power. Any vacancy in the office of an appointed member
shall be filled Por the remainder of the unexpired term.
Section 2. DUTIES OF THE COUNCIL. It shall be the duty of the
council to undertake the coordination of all the resources of the
County of Hawaii, together with the resources of the various persons,
firms, associations and corporations doing business or located in the
County of Hawaii, and by means of mutual cooperation and effort create
a plan which would. permit an effective and efficient method oP utilizing
ell available resources and materials for the relief and the general
welfare of the people of the County of Hawaii in the event of some
major disaster, catastrophe, calamity or cataclysm. The council shall .~~~~.,k
act in accordance with all laws•to which the County oP Hawaii is
subject and each and all members of said council shall diligently
undertak@ to acquaint himself with and become familiar with the respon-
sibilities imposed upon him in the event of such emergency.

Section 3. DECLARATION OF EHflERGENCY: DUTIES OF CHAIRMAN AND
EI~CUTIVE OFFICER. The Chairman end Executive Officer of the County
of Hawaii shall have the power in his discretion to declare when en
emergency disaster exists and in the event of the declaration of such
emergency h® shall have power, subject to existing laws, to obligate
the County of Hawaii for the payment of any and all supplies, equipment,
materials, food or-other necessities of relief that may be necessary
for the purpose of alleviating suffering to the people of t h® County
of Hawaii and for the purpose of protecting the people from the hard-
ships anticipated in case such co ndition arises. Should the Chairman
and Executive Officer of the County of Hawaii be absent Prom the
County of Hawaii or disqualified or unable to act for any reason the
powers and duties imposed upon him by the provisions hereof shall be
vested in the Acting Chairman and Executive Officer of the County of
Hawaii.
Section 4. COORDINATOR. The Chairman end Executive Officer of
the County of Hawaii, with the approval of the Board of Supervlsors,
shall appoint a coordinator who shall serve for such term and at such
salary as shall be determits d by the Board. The coordinator, subfect
to the Civil Service Laws and with the approval of the council, may
appoint such assistants and such clerical,stenographic and other
employes as shall be deemed necessary end for which appropriations
shall be made by the Board. The coordinator shall serve as secretary
of the council and it shall also be his duty'to act as liaison between
the various divisions of the council and be shall be responsible for
the administration of the entire plan.
Section 5. DIVISIONS. The council shall be in charge of the
following divisions of the plan, and such other divisions as may from
time to time be created by it:
1. Coordination and Intelligence
2. Transportation
3. Communications
4. Power and Light
5. Personnel
6. Law and Order

7. Law Enforcement
e. Fire Protection
9. Water and Water Supply
10. Streets and Highways
11. Medical
12. Health and Sanitation
13. Red Cross
14. Rescue Demolition and Gas Protection
15. Air Raid Warning
16. Religious Worship
17. Recreation and Amusements
18. Mortuary Work
19. Law
20. Finance and Supplies
21. Education
22. Rural Hawaii
The Divisions above named, and such other divisions as nay b®
created, shall have charge of and direct such duties and functions as
shall be delegated to them by the council. Each and all of the
divisions hereinabove referred to shall be under tip control and direc-
tion of a chairman and in the absence of eapress declaration to the
contrary by a majority of the council he shell do any and all acts
imposed upon the division of which he is in charge.
Section 6. HEAnQ,UARTERS. The headquarters of the council shall
be in the County Building, at Hilo, Hawaii, and in the event of the
declaration of any emergency it shall be the duty of the Chairman and
Executive Officer of the County of Hawaii to notify all members of the
council of said declaration and all of such members shall forthwith
assemble et the County Building or such other place as may be designated

by the Chairman and Ea®cutive Officer of the County of Hawaii.
The councll may make such rules and regulations es it may deem
necessary for the purpose of putting the plan contemplated hereby into
Pull force and effect, provided, however, that no parson shall be paid
any compensation for any service rendered hereunder except as eapressly
provided for in this Ordinance or an ordinance for such purpose.
Section 7. DECLARATION OF NECESSITY. It is hereby declared that
this Ordinance is necessary to protect health, life and property and to
preserve and enforce the good government, order and security of tho
County of Hawaii end its inhabitants.
