ORDINANCE N0. 40
AN ORDINANCE REGULATING POI SHOP.
BE IT ORDAINED BY THE $OARD OF SUPERVISORS OF THE COUNTY OF HAWAII:
Section 1. PERMITS REQUIRED FOR POI SHppS,, No poi shop or
shop for the manufacture of poi or paiai for sale shall be erected,
maintained, used or operated within the County of Hawaii,eacept

under a permit therefor as hereinafter provided.
The treeaurer of the County of Hawaii is hereby authorized,
empowered and, directed to issue, upon the receipt of a Pee of one
dollar, a permit for such shop, upon the recommendation, in writing,
of the Board oP Supervisors of the County of Hawes i.
No such permit shall be recommended by the Board oP Supervisors
unless such shop shall be properly ventilated, laid with cement side

with a cesspool, sewer or such other means for the proper disposal of
drainage as may be approved by the building and plumbing inspector;
nor Por et~y such shop in any place where there is not available an
adequate supply oP pure water or which is incapable of proper drainage,
or which is in such close proaimity to sleeping compartments, stable,
laundry, abattoir .or other place where any business or process ie
carried on or condition maintained which, in the opinion of the Board

the poi or paiai manufactured thereat. No such shop shall be maintained,
used or operated for any other ;purpose than the manufacture of poi or •~
paiai, nor unless only pure water shall be used thereat and proper,~~

drainage maintained therefor, nor unless it shall be k®pt so screened
as to prevent flies and insects from entering therein, nor unless all.
implements, tools, machinery, containers and ell other utensils used for
or in connection with the manufacture, distribution or storage of poi or
peiai shall be sterilized each .time before being u:ied, nor if'sny person
or individual. is employed or engaged in or about such shop or building
who is afflicted with any contagious or infectious disease or any disease

Section 2, TERM OF :POI SHOP PERMIT. Each permit so issued shall
be for a term of one year and shs.ll be subject to revocation at any
time by the treasurer on the recommendation of the Board of Supervisors
when it appears that the place for which it i.s issued or the manner
in which such place is maintained,. used or operated does not comply in
ell respects with the conditions and. restri.ctiona of Section 1.
Sectton3. Any person now operating in the County of Hawaii
poi shop or chop fox the manufacture of poi. nr peiai for sale shall
obtsin the permit as provided herein within ninety days after the
enactme.~t;'of said Ordinance.
Section 4. RE~,UIRED ANAT.YSIS FOR POI. Poi., which on analysis
is found T.o contain less than thirty per cent of tcta7. solids, ahal.l.
be deemed unfit fnr human food, and it is hereby provided that tha
sale of such poi shall be prohibited.
Section 5. PENALTY. Any person who violates or Pails to comply
with any provision of the 9eCt10II8?>herein provided, shall be guilty

fine of not lASS than Twenty-fives Do1.lare, not mere than Five hundred
Dollars, or by imprisonment fbr not morn than three months, or by both
such fine and imprisonment. Furt4ter, if such person has a permit, the
same shall be'forfeited.
