ORDINANCE N0. 46
AN ORDINANCE RELATING TO THE ESTABLISHING OF WATER RATES AND REGULATIONS
FOR THE WATER WORKS A1QD WATER WORKS SYSTEMS OF THE VARIOUS DISTRICTS OF
THE COUN'PY OF HAWAII, AND REPEALING ALL SECTIONS AND PARTS OF SECTIONS
OF ORDINANCES OF THE COUNTY OF HAWAII IN CONFLICT THEREWITH.

Section 1. Management: The County Engineer of the County of
Hawaii shall, in addition to his other duties, assume the duties of
the Genarel Manager of the Bureau of Water Works of the Countycf Hawaii,
and shall have full charge of the design, •peration and maintenance of
the water works systems of the County of Hawaii, under such rules and
regulations as may be established from time to time by the Board of
Supervisors of the County oP Hawaii.
The General Manager may delegate tc his Superintendent or other
authorized agent, authority to grant and sign permits for water
privileges; make agreements in connection therewith; send out bills;

collect moneys; cause to put into effect and enforce regulations
required from time to time, especially in periods of emergency, drought
or scarcity of water; maze rules regarding the use of water for lawn,
garden or agricultural purposes as well es for other large water demand.

Section 2. Pay of Superintendents: The Superintendent: of each
district water works shall receive such salary and/or allowances es may
be fixed by the Board of Supervisors.
Section 3. Bonds: The General Manager and each Superintendent of
district water works shall furnish to the County of Hawaii, a bond for
the faithful accounting of all moneys received and the faithful
performance of his duties, end the amount of such bonds shall be X5,000
for the General Manager and $p1,000 each for the Superintendents. ~

Section 4. Application for water: Any parson, firm or corpora-
tion desiring to be supplied with water from any of the County of Hawaii
water works systems shall make application therefor on a printed form.
obtainable at and furnished by the various district water works offices,
which application shall be signed by such applicant.
Every privilege granted upon such application shall ba subject
to the rules and regulations herein provided for.
Section 5. Water: Each applicant for water shall sign an
application end make a deposit of Fifteen (~p15.00) Dollars for which a
temporary deposit voucher shall be issued to the applicant•~ The
Fifteen Dollars shall be used to pay for the connection from the main
to the meter adjacent to the property line, and shall include all
material and labor, a mater-box if a meter is to be instal}.e d, and
street or road repairs if any are needed. Should the deposit be
insufficient to pay all the charges, the amount over Fifteen Dollars
shall be charged to the privilege holder on his first water bill there-
after.
There shall be returned to the applicant by the Water Vilor.ka within.
seven days after the completion of the connection, any unused portion

of the temporary deposit.
Sec ti on 6. Connecti®na & Cut-offs: No person other than the
duly authorized employees of the Waterworks shall make conriectiona to
water lines of the County of Hawaii Water Systems, and any person or
persons, firm. or corporation connecting, or. attempting to obtain water
without permission, or tampering with the water mater or breaking the
seal thereon, shall be guilty of a misdemeanor and, upon conviction
thereof, shall be punished by a fine not exceeding Five Hundred (500.00)
Dollars, in the discretion of the Court.
The duly authorized employees of the Waterworks shall, at all
reasonable hours, be permitted to enter upon the premises of a
privilege holder for the purpose of connecting, inspecting, turning-off
or turning-on the water, qr for the purpose of making repairs to the
water lines, stop cocks or meters, and to see that the provisions hereof
and the rules and regulations of the Waterworks of the County of Hawaii

are being complied with.
Privilege holders who are delinquent for 60 days shall be
shut-ofP, and if the privilege is a metered one the meter ahrll be
removed, and service not resumed until. all back charges together with
penalties and a Five 05.00) Dollar labor charge for reinstalling the
meter and/or turning on the water, is paid.
Privileges may be granted only to owners of property or to
those having leases with at least a one year term.
Privileges other than the delinquent one but held by the
delinquent privilege holder may also be shut-off.
No privilege shall be given. to any delinquent privilege holder.
Section 7. minimum charge: There will be a minimum charge
for each meter at the following rates per month.

S®etion 8. Rates - Meters: All Water furnished by the Nater
Works Systems of the County of Hawaii thru meters to privilege holders
may be sold at the following rates in cents per thousand gallons,
except to shipping and other Special privileges;

All water furnished to ships or weasels shall be sold at the
following rates per thousand gallons:
(e) Foreign and other weasels, including weasels engaged
exclusively in inter-island trade, 50~ per thousand gallons.
Section a. Rates - Flat and/or Specisl: All water .furnished
by the Water Works System of the County oP Hawaii, other than that
furnished thru meters, to privilege holders, may be sold at the following
flat rates and/or special rates per annum:

Where business establishments are also used as dwellings, the
flat rate may be increased by the minimum flat rate specified for
dwelling for the System concerned.
The General Manager of the Water Works is directed to install
Meters, if and when funds permit, on all flat rate privileges, where
deemed necessary in best interests of the Ccunty of Hawaii.
Section 10. Meters: The Mater shall be furnished free to the
privilege holder, but shall be the property of the Bureau of Water
Works of the County oP Hawaii. It shall be installed adjacent to the
property line in an approved type of mates box.
The safe maximum delivery of the meter used in each privilege
shell be greater than the maximum capacity and requirements of the
privilege.
Should a privilege holder believe that his meter is not
registering correctly, he may request to have it tested. Should the
test show it to be in error, a new meter shall be put in its place and
an adjustment made in the charges affected; but should the meter be
found to be registering correctly, it shall be replaced and the entt.re
cost of testing and that incidental thereto, shall be paid by the
privilege holder.
The privilege holder shall be responsible far the proper care
and safety of the water meter, and any damage that is done to it shall
be repaired by the Water Works division and the cost of such repairs
shall be added to the current water hill of said privilege holder.
If a privilege holder requests to have a different sized meter
installed from the one already in his privilege, or to have the location
of the meter changed, it shall be done provided the changes do not
operate as a hardship to or a loss of revenues against the Water Works,

and that all costs incident thereto shall be paid by the privilege
holder requesting such change.
Section 11. Billing and Collecting: Water rates shall be charged
to and payable by the privilege holder for all premises whether occupied
or not, until such time as the water is ordered ^shut-off^ in writing,
or in person or is shut-off by Authority.
The owner of the premises wt71 be he:Ld responsible for the
settlement of water rates in cases whore said rates have not; been paid
by the tenants.
All metered water rates shall be paid. monthly, except; for vessels
which have no local.. agents, under whir,h circumstances payment shall be
made by the ship's officers upon presentation of an officis]_ numbered
water bill and receipt by a duly authorized representative of the Water
Works;, otherwise, water rates shall be due on the first daY of each
month, shall be payable at the district water works office, except that
Por South Hila they shall be payable at the Office of the Treasurer of
the County of Hawaii., end shall become de]inquent thirty days after due.
Flat rates and/o.r special rates for water shell be due and
payable quarterly in advance, on the first day of January, t;he first day
of April, the first day of July and the first day of October of each year,
at the district water works office, except that for South Hj.1o they shall
be payable at the office of the Treasurer of the County of Hawaii, end
shall become delinquent thirty days after due. Should these; privilege
holders desire to, they may pay the rates semi-annually, or annually, in
advance.
A bill and Notice to pay water rates shall be sent out to each
privilege holder by mail end/or delivered by a representative of the
Water Works, not less then ten days before such rates becomes due and
payable.
Section 12. Penalties: In all cases of non-payment of water
rates for two months after due date, there shall be added ten per cent
in addition to the regular rate as the amount due and payable by said
privilege holder.
As stated in Section ti, privilege holders who become delinquent

and cause their water to be cut-of P, shall pay a penalty of Five 0 5.00)
Dollars to cover costs of cutting-off and turning-on water before service
will be resumed.
Section 13. All sections and parts of sections of Ordinances of
the County of Hawaii, in conflict herawith, be and the soma are hereby
repealed.
